BOOKS AND OTHER INSTRUCTIONAL MATERIALS AND SUPPLIES. The Board shall allocate such funds as are in its judgment sufficient to provide all books, equipment, instructional supplies, and materials deemed necessary by the administration to enable employees to fulfill properly their responsibilities.

In addition, the parties stipulate that, in the event the Board determines that any grievance is non-arbitrable or if there is any dispute regarding arbitration, the Board or the Association shall have the option of seeking a determination of arbitrability, either from the Public Employment Relations Commission (PERC) or the New Jersey Superior Court. In the event such an application is made to determine arbitrability, the Association agrees that the grievance shall be stayed voluntarily until a determination is made regarding the subject of arbitration.
e. The arbitrator shall be impartial and shall give reasons for any decision which he/she renders in connection with this provision. He/She is to confine his/her decision strictly to the terms of the contract and any evidence before him/her. The arbitrator shall have no authority to determine the issue of arbitrability. In such circumstances, where the issue of arbitrability is raised, it shall be determined as appropriate either by PERC or the Superior Court. Any decision of the arbitrator shall be based solely upon the interpretation of express contract terms or language.
5. The following matters shall not be the basis of any grievance filed under the procedure outlined in this article:
a. Any matter for which a specific method of review is prescribed and expressly set forth by law or any rule or regulation of the State Commissioner of Education or,
b. A complaint of a probationary or non-tenured employee which arises by reason of his/her not being re-employed except that such employee may exercise any of the prerogatives outlined in B.1. and B.2. above or,
c. A complaint by any certificated person occasioned by assignment to or retention in any position for which tenure either is not possible or not required and for which there are no qualified in-district volunteers or qualified out-of-district applicants available. However, such employee may exercise any of the prerogatives outlined in B. l. and B.2. above or,
d. Any matter which, according to law, is either beyond the scope of Board authority or limited by statute to unilateral action by the Board alone or,
e. A complaint of any non-tenured or probationary employee that he/she has received an unfavorable supervisory report or that he/she has failed to receive a favorable supervisory report, except that such employee may exercise any of the prerogatives outlined in B.1. and B.2. above.

BOOKS AND OTHER INSTRUCTIONAL MATERIALS AND SUPPLIES. 1. Within budget limitations, the Board will allocate funds to provide library books, instructional materials, supplies and equipment to support the instructional program of the District. Building meetings will be held in each school to determine teachers’ priorities for the expenditure of budget allotments. Sometimes, however, students may be given the opportunity to voluntarily work on personal projects which may require student expenditures. In such cases, the teacher will submit the following to the principal prior to initiating a student-funded activity:
a. the objectives for the activity,
b. the cost of the individual project(s),
c. the method of informing parents about the activity,
d. the relationships of the activity to the student’s grade,
e. the method of accounting if money is collected by the teacher. The principal will review and evaluate the information provided by the teacher and approve or disapprove the project(s).
2. Textbooks and other instructional materials and supplies will be selected by special committees in accordance with the Textbook Adoption Procedures of the State of Arizona, the Secondary School Textbook Policy of the District, and other Board adopted textbook and materials/ supplies guidelines. The guidelines for such special committees shall be as follows:
a. A separate committee will be established to make recommendations for each subject area.
b. School-based teachers will constitute a majority of each such committee.
c. The recommendations of such committees will be published and distributed to all schools.
d. The recommendation of each committee will be submitted with the signatures of all members of the committee to the Assistant Superintendent for Curriculum Services.
e. The recommendation will then be submitted to the Superintendent for the recommendation to the Board.
3. Special education self-contained students will be considered in a buildings projected enrollment for determining supplies and materials in special subjects (art, music, P.E., library, life management, industrial arts technology), and other building services (nursing, custodial, etc.).
4. Textbooks and instructional materials in all subject areas and at all grade levels will be selected so as to show the cultural diversity and pluralistic nature of American society. All instructional materials selected should be relevant to the subject area and grade level for which they are chosen.

BOOKS AND OTHER INSTRUCTIONAL MATERIALS AND SUPPLIES. A. An instructional expenditure fund shall be established for use in purchasing incidental supplies for classroom instructional use. Expenditures from this fund shall be at the discretion of the teacher. The teacher shall be reimbursed upon presentation to the Superintendent, of a paid receipt for such expenditures up to One hundred dollars ($150.00) per year, presentation no later than May 15th of that year.

B. A procedure for reviewing and evaluating books and other instructional materials and supplies shall be instituted as soon as possible after the effective date of this agreement. Said procedure shall provide, among other things, for a Curriculum Committee which shall continue to make recommendations to the Board for each subject area.
C. Each teacher may purchase up to fifty dollars ($50) worth of instructional materials at the New Jersey Association Convention and will be reimbursed for these upon presentation of the receipts to the Board Secretary.

The Board of Education shall allocate funds to provide for the purchase and/or replacement of textbooks, library books, instructional materials, supplies, and equipment of quality and quantity to enable employees to properly fulfill their responsibilities. Extra-curricular coordinators shall be provided with materials to perform their duties.
B. A revised book and supply list shall be returned to the teachers after the supply list has been approved.
C. With prior approval of the superintendent, teachers shall be permitted to request the business office to substitute comparable priced items for all no-bid supplies not received prior to October 15. Teacher requests for such items are due in the business office on October 20.

Section 4. The Board realizes that an outstanding development in modern education is the growth of the use of audio-visual materials for instruction, and that audio-visual materials are most effective when available to be properly integrated into regular classroom teaching.
