AND REPRESENTATION. The Company recognizes the Union as the sole and exclusive bargaining agent for employees of the Company working at or out of its facilities in the City of Niagara Falls, Town of Fort Erie and the City of Port Colborne in the job classifications shown in the Index of Job Titles attached hereto and made a part hereof and any new job classifications not hereafter excluded which are created by the Company during the term of this Agreement, save and except forepersons and supervisors, persons above the rank of foreperson and supervisor, executive assistants, Manager of Human Resources, HR/ HS Assistant, administrative assistants, buyers, students employed during the school vacation period, students employed on a co-operative program from a school, college or university and persons employed for not more than twenty- four (24) hours per week, except those employees deemed to be regular part-time within the Customer Service Department. The words "employee" or "employees" where used in this Agreement shall mean only those employees in the aforesaid bargaining unit and not any other persons employed by the Company. The Company shall not employ more than four (4) co-op students at one time. In this Agreement words importing the singular number only include the plural and vice versa, and words importing any gender include all genders. The Company also agrees to recognize the following committees and stewards: (a) Grievance Committee of three (3) members. (b) Labour-Management Committee with four (4) Union representatives, which shall be the Bargaining Unit Chairperson and three (3) members. In addition, an outside Union Business Representative may attend meetings of this committee. There shall be four (4) management representatives on the committee. The Company and the Union recognize the advantage of joint meetings to discuss problems of general interest and working conditions within the Company. This committee shall meet on a regular basis and agenda items for discussions shall be presented in advance of meetings. Either party may call special meetings. (c) Negotiating Committee of five (5) employee members and, in addition, the Local Union Business Representative and/or Business Manager and/or a Representative of the International Office of the IBEW. (d) Joint Health and Safety Committee of employee and management members in accordance with the most current Occupational Health and Safety Act (Ontario). AND REPRESENTATION. The Association agrees that the Business Agent or the Chief Xxxxxxx of the Union shall be given the opportunity of interviewing each new employee once, within thirty calendar days of hiring, for the purpose of informing such employee of the existence of the Union at the Association. The Association shall advise the Union from time to time of the names of the persons to be interviewed, and the time and place for such interview, the duration of which shall not exceed ten (10) minutes. Union Stewards, Grievance Committee, Committee The Association agrees to recognize not more than seven (7) employees selected by the Union as stewards (one of whom shall be the Chief Xxxxxxx) for the pur- pose of representing employees and dealing with Union business as provided under this Collective Agreement. A Chief Xxxxxxx may be appointed or elected. The Chief Xxxxxxx may, in the absence of any xxxxxxx, assist in the presentation of any grievance, or with any xxxxxxx function. The Association agrees to recognize four ( 4 ) of the stewards, selected in accordance with (a) above as the Grievance Committee (one of whom shall be the Chief Xxxxxxx). A general representative of the Union may be present at any meeting of the Grievance Committee. The purpose of the Committee is to deal with com- plaints or grievances as set out in this Collective Agreement. The Association further agrees to recognize a Negoti- ating Committee comprised of six (6) employees to be elected, or appointed from amongst employees in the bargaining unit. In addition, a general representa- tive of the Union shall be permitted to assist the Negotiating Committee in all collective agreement negotiations with the Association. For the purposes of this Article, the names of the stewards and members of the Grievance Committee and Negotiating Committee shall be given to the Association in writing from time to time as well as the effective date of their respective appointments. The Association shall not be required to recog- nize any such stewards or committee members until it has been so notified. AND REPRESENTATION. Section 1. The Cooperative recognizes the right of its employees to organize and to bargain collectively through representatives of their own choosing. The Cooperative hereby recognizes the Union as the sole and exclusive collective bargaining representative with respect to rates of pay, hours of work and other conditions for work of all its regular production and maintenance employees heretofore certified as appropriate by the National Labor Relations Board. Accordingly, the Cooperative agrees to meet and deal with the duly accredited officers, committees and representatives of the Union for said employees in the said bargaining units upon all matters covered by the terms of this Agreement.
