Categories of Overtime. Overtime shall be categorized as 1) Prearranged; 2) Short Notice Call-Out; 3) Anticipated Extension of the Work Day; and 4) Unanticipated Extension of the Work Day. The definition of each category of overtime and an administrative procedure for the execution of such category of overtime is contained in the following Subsections. At the outset, the parties to this MOU recognize and agree that City of Alameda Municipal Power employees are Disaster Service Workers as defined in the State of California Government Code Title 1, Division 4, Chapter 8. Section 3100 of this Code provides, in part: “It is hereby declared that the protection of the health and safety and preservation of the lives and property of the people of the state from the effects of natural, manmade, or war-caused emergencies which result in conditions of disaster or in extreme peril to life, property, and resources is of paramount state importance requiring the responsible efforts of public and private agencies and individual citizens. In furtherance of the exercise of the police power of the state in protection of its citizens and resources, all public employees are hereby declared to be disaster service workers subject to such disaster service activities as may be assigned to them by their superiors or by law.” It is agreed that when a natural, manmade, or war-caused emergency which results in a condition of disaster or in extreme peril to life, property, and resources exists, the provisions of Subsection 11.4.2, Short Notice Call-Out, may be suspended.

Categories of Overtime. The following categories of overtime have been identified: (a) FLSA overtime for working in excess of 40 hours in a workweek; (b) Regular Day Off Overtime Scheduled in Advance: (1) Supervisors wishing to work overtime shall submit their request for overtime via the District approved online scheduling software on a weekly basis by 8:30 a.m. on the Monday proceeding the week they wish to work overtime. In the event of a failure with the online scheduling software, Supervisors shall be required to email their Superintendent, Assistant Superintendent and Senior Supervisors, within the specified time limit. An email from a supervisor will be accepted in lieu of the request through the District approved online scheduling software when the scheduling system is not working. It is the responsibility of each Supervisor to check the weekly detail post in the online scheduling software to see if they are assigned overtime work. (2) Supervisors who request weekly overtime will be placed on a rotational list based upon a combination of, department seniority and the amount of overtime worked in the last 30 days. A Supervisor will have the option of working at straight time rates (unless he/she qualifies for overtime in which case overtime rates will be paid) on his or her days off during vacation. To assist in ensuring the most fair distribution of weekly overtime the Senior Supervisors will keep a tally of the preceding month that will be posted, noting overtime worked and when, and using that as a guide when assigning overtime work. The main intent shall be the equitable distribution of overtime to all who request to work it, subject to the discretion of the Senior Supervisor. (3) A Supervisor who is assigned to work weekly overtime in advance, and who misses the assignment twice in one sign-up, will not be eligible to request and work overtime until the next Supervision sign-up. Exceptions to this provision include documented emergencies, or family/employee illness. For assignments that need to be filled on an emergency basis, the Senior Supervisor, at his/her discretion, may assign overtime to a Supervisor who is otherwise ineligible due to missed work. The official status of the Supervisor shall remain "ineligible" for the remainder of the sign-up.

Category 2: Employee who qualifies for retirement under the basic provisions of KPERS. These employees must have attained the age of 62 and have 10 years of vested service in KPERS but have not acquired eighty-five retirement points at the time of retirement and who have completed by June 30 of the retirement year fifteen (15) years of service in USD 434 that could include service given through the employment of the Three Lakes Cooperative.

  • Mandatory Overtime a. Mandatory Overtime is overtime that an employee is assigned and required to work involuntarily, and will only be required in operational emergencies when sufficient voluntary overtime cannot be secured to maintain the Company’s operation. Mandatory overtime will be limited to the number of employees and hours required to cover the emergency as determined by local management. b. Mandatory overtime will not exceed 4 hours past an employee’s scheduled shift in any 24 hour period. Employees will not be required to work mandatory overtime until the opportunity to work the additional hours has been offered to all qualified employees who are currently at work, and if there are an insufficient number of volunteers, then to otherwise eligible employees whose names remain on the overtime call sign up list. c. Mandatory overtime will be assigned in reverse bid seniority order according to shift time, except that employees already working overtime will be assigned last. d. Every attempt will be made to notify employees on duty of mandatory overtime at least 1 hour in advance. If 1 hour’s advance notice is not provided, the employee will receive 1 ½ hours’ pay as a penalty in addition to the pay earned for any mandatory overtime hours actually worked. e. Employees will not be assigned mandatory overtime during their vacation periods. For this purpose, the vacation period is defined as the period beginning 24 hours after the commencement of the employee’s last regularly scheduled shift before the vacation commenced. An employee may be assigned to mandatory overtime on the last regularly assigned shift prior to a vacation or DAT day, but will be placed at the bottom of the mandatory overtime list. f. If any mandatory overtime causes a rest period violation to occur, every attempt will be made to adjust the employee’s shift to provide the minimum 8 hours rest. g. All mandatory overtime hours will be paid at the applicable rate of pay but not less than the time and one half (1.5X) rate of pay regardless of work status or hours worked. If an employee is required to work mandatory overtime on two or more consecutive days, the minimum payment for all mandatory overtime hours worked will be at the double-time (2X) rate of pay.

The Certified Operating Histories collectively report on operations for a period equal to (a) at least a continuous three-year period or (b) in the event the Mortgaged Property was owned, operated or constructed by the Mortgagor or an affiliate for less than three years then for such shorter period of time, it being understood that for mortgaged properties acquired with the proceeds of a Mortgage Loan, Certified Operating Histories may not have been available.
