Classification Procedure. Whenever a new position is created or the duties and/or responsibilities of an existing position are modified, the Personnel Officer shall review such positions and (if appropriate after meeting and conferring with the Association on the content of the job description) make such recommendations to the City Council to classify or reclassify the position to a suitable existing or new class. The reclassification procedure and form are included in Appendix “A” of this MOU.

13.02 In order to ensure the appropriate classification of jobs listed under Schedule "B" of the Collective Agreement, the parties agree that matters related to the classification of new jobs and the reclassification of existing jobs shall be dealt with in accordance with the Job Evaluation Manual of Procedures dated November 9, 1990 and forming part of this Collective Agreement. Should an employee be removed from the classification, he may reapply through a posting at a later date and if accepted, shall be given classification seniority as of the date of the latest posting. Classification Procedure. The following shall serve to satisfy the alleged working out of classification questions: The Human Resources Director has responsibility for initiating classification studies and recommending changes to the Classification Plan. As part of the responsibility, and within the limits of Human Resources Classification Division staff resources, the following procedure will apply to employees of Law Enforcement Management Unit: If a Department Head has twice refused to refer to the Human Resources Department an employee's written request for a classification review of their specific position, the employee may prepare a written request for a classification review to LEMU. LEMU may refer such written request to the Human Resources Director.
(1) Refer the request to the Classification Division for study; or (2) Return the request to LEMU with an explanation for non-action. Note: Requests referred to the Classification Division are subject to the same discretionary judgments regarding priority as other requests.
