Commuted Overtime Allowance. 13.3.1 The parties agree, for operational purposes, nominated Marine Officers shall receive an allowance of 15% of their gross annual salary in return for being required to work up to five (5) hours unpaid overtime each fortnight before or after nominated rosters, in return for being required to be on call for up to 10 weeks in a calendar year. All hours worked in excess of the hours referred to in this paragraph are to be paid in accordance with Clause 22 – Overtime Allowance of the Award
13.3.2 The commuted overtime allowance is paid during periods of annual and long service leave and as part of any retiring allowance.
Commuted Overtime Allowance. Unless otherwise agreed between the Employee and the Employer, an eligible Employee will be paid a commuted overtime allowance of 20 per cent of their base salary in lieu of all entitlements for working overtime prescribed by clause 36 of Section I of this Agreement. This commuted overtime allowance will involve up to 14 hours of additional hours worked per fortnight. Overtime hours worked beyond the 14 hours per fortnight specified above will be worked at the direction of the Employer and paid according to clause 36 of Section I of this Agreement. The commuted overtime allowance specified in clause 256.1 above will not replace an Employee’s entitlement to payment for meal breaks worked during overtime and rest periods during overtime worked in accordance with clause 36 of Section I of this Agreement. For the purposes of this clause, an eligible Employee means an Employee working within the Office of the Governor, other than a casual Employee, who: regularly works overtime at the direction of the Employer in addition to their ordinary hours of work; occupies a position of Aide to the Governor, Driver, or occupies a position within the Services staff (such as Household Manager, Under Xxxxxx, Xxxxxxx or Chef); and started work with the Office of the Governor on or after the commencement of this Agreement (see clause 3 of Section I of this Agreement). The Employer will monitor the operation of this Appendix and six months prior to the nominal expiry of this Agreement, the Employer will consult with the affected Employees and the relevant Union regarding its findings. The uniforms described in clause 257.3 below are compulsory and must be worn at all times while on duty by those Employees identified in clause 257.3 below who are required to wear uniforms. Uniforms may only be worn for work purposes. An Office of the Governor Xxxxxxxx who presents for work in other than the required uniform will be considered ineligible for duties. The colours of uniform items and the need for clothing items to have a logo of Office of the Governor will be determined by Office of the Governor.
Commuted Overtime Allowance. This sub-clause is an enabling provision within clause 10, which will allow for two and one half (2.5) hours of accrued ordinary hours per week to be converted into a monetary equivalent. Governance and application of this sub-clause is subject to the following provisions;
a) Application for effect of this sub-clause has to be duly authorized by the Director-General or delegated officer, and, with the consent of the employee, as per Schedule 1.
b) Where Schedule 1 has been duly approved, the Employer will renumerate the Employee an allowance of 8%, in addition to the appropriate salary contained in the General Agreement.
c) The application period for Commuted Overtime will be for a minimum of 12 months, unless the employee’s assigned duties and / or position is subject to project funding, in which case the period will be for the term of the funding.
d) The salary schedule of the General Agreement shall be made available to an employee with an additional and corresponding column of the commuted overtime allowance.
e) Either party may withdraw from the provisions of this sub-clause by giving a notice period of no less than thirteen weeks.
f) Application of this allowance will automatically cease when the employee is promoted, transferred or re-assigned duties to a new project or funding source. In such circumstances continuation of Commuted Overtime may only occur as prescribed in (a) of this sub-clause.
g) Any variations and/or disputes in relation to this sub-clause or Schedule 1, shall be determined in accordance with the Clause 8- Dispute Settlement Procedure.
Commuted Overtime Allowance. (1) All employees covered by this Agreement who are required to work 1950 hours per annum in accordance with Clause 9. - Overtime to be Worked of this Agreement, shall receive an allowance of 15.38% of their salary, which will be counted as salary for all purposes.
(2) Part-time employees are required to work the appropriate proportion of ordinary hours and overtime in accordance with their employment contract and will receive the same proportion of this allowance.
Commuted Overtime Allowance. (a) Field work programs for which a commuted overtime allowance is paid shall be designed in order to ensure that the average overtime worked in a field trip by Employees is not in excess of the amount of overtime that the commuted allowance is intended to purchase.
(b) Employees undertaking approved duties in the field shall be paid the respective commuted overtime allowances as contained in this Agency Specific Agreement in addition to their base pay of 7.5 hours.
(c) For the purpose of this Agency Specific Agreement, it is recognised that the commuted overtime allowance compensates Employees for overtime, as there is an expectation for Employees to work additional hours. In addition a component of the allowance also compensates for irregular and unusual hours as follows:
i) Field Duties 20% 20% = 15% overtime hours plus 5% for irregular and unusual hours = 7.5 hours + 15% + breaks = 7.5 x 15% ٪ 1.5 + 0.75 hour = 9 hours on duty (i.e. Minimum 0.75 hour break, e.g. 30 minute lunch plus minor break of 15 minutes) ii) Day Trip (Seagoing Vessel) 38% 38% = 33% overtime hours plus 5% irregular and unusual hours = 7.5 hours + 33% + breaks = 7.5 x 33% ٪ 1.5 + 1 hour = 10 hours on duty (i.e. Minimum 1 hour break, e.g. 30 minute lunch plus 2 breaks of 15 minutes) iii) Overnight Trip (Seagoing Vessel) 45% 45% = 33% overtime hours plus 5% irregular and unusual hours plus 7% hard living allowance = 7.5 hours + 33% + breaks = 7.5 x 33% ٪ 1.5 + 1 hour = 10 hours on duty
Commuted Overtime Allowance. 19.3.1 The parties agree, for operational purposes, nominated Coastal Facilities Officers shall receive an allowance of 12.5% of their gross annual salary in return for being required to work 290 hours unpaid overtime per annum before or after prescribed hours of duty, Monday to Sunday. All hours worked in excess of the hours referred to in this paragraph are to be paid in accordance with Clause 22 – Overtime Allowance of the Award

12.1 Clause 12 of this Agency Specific Agreement shall be read in conjunction with Clause 21 – Shift Work Allowance of the Award and is made pursuant to Clause 22 (3)(c) – Overtime Allowance - of the Award and Clause 25 – Commuted Allowances – of the General Agreement, and only applies to Marine Officers, which includes Senior Investigations Officer and Principal Investigations Officer. DEFINITIONS:
12.2 Prescribed hours of duty,” means the hours prescribed in Clause 13 – Hours – of the General Agreement.
