Consequences of a Positive Drug Test on the INL Site After management verifies that all procedural requirements and considerations have been met, an employee who tests positive for illegal drugs will be discharged. The employee will not be eligible for rehire for one year; provided, however, an employee who completes rehabilitation in less than one year, at his own expense, may be eligible for rehire if approved by the MRO. If rehired, such employee must show proof of completion of a rehabilitation program and agree to random testing for illegal drugs for up to two calendar years. An employee who tests positive for illegal drugs during said two year period will be discharged and denied access to the Site. An employee who abuses the use of legal drugs or alcohol will be suspended for up to 30 days or may be discharged under appropriate circumstances. Such employee will be subject to random testing for up to two calendar years. An employee that tests positive for [the abuse of] legal drugs and/or alcohol during said two year period will be discharged and denied access to the Site. Random testing may include monthly urine drug tests the first year and quarterly urine drug tests the second year following the positive test. Signed acceptance of the terms of a rehabilitation plan by the employee is a condition of continued employment. Violations of the terms of a rehabilitation program will result in termination of employment and denial of access to the Site. The Operating Contractor, or any other contractor, undertakes no obligation to pay for any rehabilitation, counseling, and/or treatment costs incurred by an individual under this policy. An employee may contact the OMP’s Employee Assistance Program for recommended counseling and/or treatment programs. (Footnote 51, Executive Board 9/15/2011) Stipulations of Understanding are available upon request and shall be in conformance with the Site Stabilization Agreement. The Operating Contractor’s Security organization will notify DOE-ID Security immediately of all MRO positive test results or other security concerns relating to an incumbent who holds, or is an applicant for, an access authorization.

Consequences of a Positive Drug Test. (a) A pilot who has a confirmed positive test result for a drug specified in DOT/FAA regulations and/or for other drugs of abuse (or for any metabolite for such drugs) shall be removed from flight status with pay by Flight Management if Flight Management receives such a recommendation from the MRO. The reason given by the MRO to Flight Management for such removal will be "for medical reasons." The MRO shall make no further communication regarding the individual's test results until the MRO review process is completed. Flight Management shall ensure that all reasonable efforts are made to maintain the confidentiality of such withholding from service.

If this second analysis result is negative, the City shall pay for second analysis. If this second analyses result is positive, the employee shall pay for second analysis. Consequences of a Positive Drug Test. A member who has a positive drug test result pursuant to the procedures of 2.3, must be immediately removed from full duty and placed in a modified police officer duty capacity without loss of pay or benefits, unless the member is unfit to perform modified police officer duty as determined by the medical review officer. If the member is unable to return to duty then the member may use sick leave or any other accumulated leave time. Any member who has a verified positive drug test result pursuant to section 2.3 shall surrender his/her firearm weapon(s) to the Police Chief or his designee. The member will not be allowed to return to full duty until the member has been evaluated by a substance abuse professional. The member must make an appointment to see a substance abuse professional at the City's EAP within five (5) calendar days of being informed by the MRO of a final positive drug test result. Thereafter, the substance abuse professional will make a determination as to whether the member should be allowed to continue working in a modified duty capacity or returned to full duty. Depending on the extent of treatment determined necessary by the substance abuse professional and any referral agency, the officer may be allowed to continue on modified duty or be placed on sick leave or any other accumulated leave time while under treatment. In addition, before any member who has tested positive returns to full duty, the member must undergo and pass a return- to-duty drug test pursuant to 2.4 with a negative result. Should the member fulfill all the initial requirements as outlined above and as determined by the EAP substance abuse professional, the member shall be allowed to return to full duty after executing a written "last chance" agreement which shall contain the following elements: -A brief review of the circumstances involving the positive test result, the administrative action taken, the fact that the member sought, and has completed, an initial course of treatment and further agrees to continue participation in the professionally recommended treatment program(s); -The member will agree to execute proper authorization forms to allow all treatment providers permission to communicate with the City's Personnel and Safety Director regarding compliance with all recommended treatment programs; -The member will agree, as a condition of continued employment, to submit to follow-up drug testing (at the member's expense) as set forth in section 2.4.e.; -In the eve...
