Contract Time Schedule. Contractor shall put forth a good faith effort to ensure that the Work will be prosecuted by Contractor in accord with the schedule set forth in Exhibit B hereto (the “Contract Time Schedule”) and upon progress schedules mutually agreed upon with Owner.
Contract Time Schedule. 5.1 The Work to be performed under this Agreement shall commence on or about June 1, 2007 and shall reach Final Completion on or about November 30, 2008. All dates in this article are subject to Owner providing proof of financial commitment from its lender and equity funding for the entire contract value, entering an EPC contract with the Contractor and paying a down payment to the Contractor by June 1, 2007. At that point, concentrated detailed engineering work will begin by Bratney Company and Cimbria-Sket. (“Beginning of Performance”). Dates in this section will be adjusted earlier or later based on the June 1, 2007 target for “Beginning of Performance”, but not necessarily on a day-for-day basis subject to mutual agreement of both parties. Any delay caused by Owner due to the delay in construction or operating permit receipts or raw material and utilities (water, Power, natural gas) availability will also extend dates in this article and not necessarily on a day for day basis subject to mutual agreement of both parties. Contract Time Schedule. 5.1 The Project to be designed and constructed and the Work to be performed under this Agreement shall be commenced on or about December 30, 1996 and shall be substantially completed no later than April 1, 1998 ("Date of Substantial Completion" or "Start-up"). The Project and Work to be performed under this Agreement shall be completed so as to allow Owner to commence commercial operation of the Project on or before June 1, 1998 ("Final Completion Date"). 5.2 The portion of the Project to be performed under Phase 1 of this Agreement is anticipated to commence on December 30, 1996 and be completed on or before February 28, 1997. The portion of the Project to be performed under Phase 2 of this Agreement is anticipated to commence on or about March 1, 1997 and to be completed on or about May 30, 1997. In order to meet the Date of Substantial Completion and the Final Completion Date, the Work to be performed under Phase 3 of this Agreement relating to procurement and site work is anticipated to commence on or about April 1, 1997, and relating to erection-civil to commence on or about June 1, 1997. For that purpose and with respect to Phase 3, Owner may give Contractor a limited Notice to Proceed with all or part of procurement, site work and erection-civil, provided that Owner's power to terminate this Agreement pursuant to Article 2.1.4 shall continue until completion of Phase 2.
Contract Time Schedule. 5.1 The Work to be performed under this Agreement shall be commenced on or about One Week from receipt of Building Permit and Owners Authorization to proceed with the work and shall be substantially completed on or about 180 Calendar Days from the start date. 5.2 The Date of Substantial Completion of the Project or a designated portion thereof is the date when construction is sufficiently complete in accordance with the Drawings and Specifications so the Owner can occupy or utilize the Project or designated portion thereof for the use for which it is intended. Warranties called for by this Agreement or by the Drawings and Specifications shall commence on the Date of Substantial Completion of the Project or designated portion thereof. This date shall be established by a Certificate of Substantial Completion signed by the Owner and Contractor and shall state their respective responsibilities for security, maintenance, heat, utilities, damage to the Work and insurance. This Certificate shall also list the items to be completed or corrected and fix the time for their completion and correction. 5.3 If the Contractor is delayed at any time in the progress of the Project by any act or neglect of the Owner or by any separate contractor employed by the Owner, or by changes ordered in the Project, or by labor disputes, fire, unusual delay in transportation, adverse weather conditions not reasonably anticipatable, unavoidable casualties, or any cause beyond the Contractor’s control, or a delay authorized by the Owner pending arbitration, then the Date of Substantial Completion shall be extended by Change Order for the period of time caused by such delay.

  • Time Schedule 4.1. A project schedule is included in Appendix A. 4.2. Any delay of services or change in sequence of tasks must be approved in writing by Delaware. 4.3. In the event that Vendor fails to complete the project or any phase thereof within the time specified in the Contract, or with such additional time as may be granted in writing by Delaware, or fails to prosecute the work, or any separable part thereof, with such diligence as will insure its completion within the time specified in this Agreement or any extensions thereof, Delaware shall suspend the payments scheduled as set forth in Appendix A.

  • Part-time Scheduling Subject to Section B of this Article, the Employer and the Association endorse the principle that less than full time equivalent ("FTE") positions shall, within reason, be expected to work a biweekly work period that equates to an eighty (80) hour work period multiplied by the position's FTE. (e.g., 80 hours @ .75 = 60 hours). It is further understood by both parties that ASF Members assigned to less than a FTE position may be required, during the peak work periods, to exceed their normal biweekly work period. FLSA non-exempt ASF Members who work a part-time schedule will earn overtime for hours worked in excess of forty (40) in a work week. The Employer agrees to review any ASF position that is less than one (1) FTE if the Association can demonstrate that the position has regularly been required to work a work period that substantially exceeds the normal work period as defined above, and adjust the FTE of the respective position as deemed appropriate by the Employer.

  • Contract Time The period of time established for completion of the Project by the Contract Documents. Contract Time commences upon the date specified in the Proceed Order and ends upon the Material Completion and Occupancy Date, as it may be amended.

  • Contract Task Order A- E shall be assigned work via a task order by COUNTY which shall subsequently be referred to as the “Contract Task Order” (hereinafter “CTO”). A CTO for each project shall be developed by A-E in conjunction with COUNTY Project Management staff. The County Project Manager shall manage all A-E’s work including monitoring the CTO work schedule, quality of deliverables, review of invoiced amounts, adherence to set budget, and internal review of submittal packages. A-E shall follow all requirements as outlined in the CTO; this general Scope of Work, the project specific Scope Statement, and the Architect-Engineer Guide (Rev July 2018). The CTO shall include a detailed Scope Statement, describing tasks to be performed with a specific list of deliverables for each task, schedule of work and cost to complete the work. The schedule of work shall allow enough time for meetings with County Management staff to review the work progress, provide technical and policy direction, resolve problems and ensure adherence to the work completion schedule. The CTO shall include a cover sheet provided by County Project Management staff with the appropriate signature blocks and contract information. Once both Parties agree, and all Parties have signed the CTO, County Management staff shall provide A-E with a Notice to Proceed (NTP) to begin work. A-E shall submit all plans, reports and other documents produced under the CTO to the assigned County Project Manager within the timeframe indicated in the CTO or as directed by County Project Management staff.

  • PROGRESS SCHEDULE The Contractor, within ten (10) working days of receiving notice of the award of the contract, shall prepare and submit for the State's and Architect's information an estimated progress schedule for the Work. The progress schedule shall be related to the entire Project to the extent required by the Contract Documents, and shall provide for expeditious and practicable execution of the Work.

  • Wage Schedule ‌ The pay rate (including increments and stated extras) as agreed to and hereinafter in this Schedule provided, shall be in effect during the term of the Agreement, from April 1, 2019 to March 31, 2022.

  • Project Schedule Construction must begin within 30 days of the date set forth in Appendix A, Page 2, for the start of construction, or this Agreement may become null and void, at the sole discretion of the Director. However, the Recipient may apply to the Director in writing for an extension of the date to initiate construction. The Recipient shall specify the reasons for the delay in the start of construction and provide the Director with a new start of construction date. The Director will review such requests for extensions and may extend the start date, providing that the Project can be completed within a reasonable time frame.

  • Outage Schedules The Connecting Transmission Owner shall post scheduled outages of its transmission facilities on the NYISO OASIS. Developer shall submit its planned maintenance schedules for the Large Generating Facility to Connecting Transmission Owner and NYISO for a minimum of a rolling thirty-six month period. Developer shall update its planned maintenance schedules as necessary. NYISO may direct, or the Connecting Transmission Owner may request, Developer to reschedule its maintenance as necessary to maintain the reliability of the New York State Transmission System. Compensation to Developer for any additional direct costs that the Developer incurs as a result of rescheduling maintenance, including any additional overtime, breaking of maintenance contracts or other costs above and beyond the cost the Developer would have incurred absent the request to reschedule maintenance, shall be in accordance with the ISO OATT. Developer will not be eligible to receive compensation, if during the twelve (12) months prior to the date of the scheduled maintenance, the Developer had modified its schedule of maintenance activities other than at the direction of the NYISO or request of the Connecting Transmission Owner.
