DATA MANAGEMENT SERVICES. The parties acknowledge and agree that Ricoh shall have no obligation to remove, delete, preserve, maintain or otherwise safeguard any information, images or content retained by or resident in any Equipment serviced and maintained by Ricoh, whether through a digital storage device, hard drive or other electronic medium (“Data Management Services”). If desired, Customer may engage Ricoh to perform Data Management Services at then-prevailing Contract rates. Customer acknowledges that Customer is responsible for ensuring its own compliance with legal requirements in connection with data retention and protection and that Ricoh does not provide legal advice or represent that the Equipment and Services will guarantee compliance with such requirements. The selection, use and design of any Data Management Services, and any decisions arising with respect to the deletion or storage of data, as well as the loss of any data resulting therefrom, shall be the sole and exclusive responsibility of Customer. If desired, Customer may engage Ricoh to perform the following Data Management Services, and the parties shall enter into a written work order setting the details of any such engagement:

DATA MANAGEMENT SERVICES. Architecturally speaking, the Data Management Services of the gLite middleware stack consist of three major components: Data Storage, Metadata and Catalog Services and Data Scheduling.

DATA MANAGEMENT SERVICES. 2.1. Incremental backups are made nightly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. 2.2. The Supplier shall not be obliged to provide any of the following as part of the services, unless contracted for separately: 2.2.1. Any services in respect of the maintenance and operation of the information technology systems on which a Veeam Backup service is installed and operated. 2.2.2. Any services relating to the information technology systems, communications, hardware or any other software or firmware of any kind not covered in this Product Annexure. 2.3. The Customer acknowledges that it has been made aware that backups will be performed any time that a virtual machine, workstation and/or server is connected to the internet, regardless of the network or access medium to which that virtual machine, workstation and/or server is connected. Accordingly, the Supplier is not responsible for any data charges incurred or degradation of the network speed as a result of backups being performed. 2.4. The Supplier’s target availability for access to backup files is 99.99%. For purposes of this clause, the following shall not be regarded as downtime: the Customer’s inability to reach the Veeam Backup service due to downtime of the Customer’s access circuits or connectivity services. Insufficient storage based on the Customer’s storage lease. Unavailability as a consequence of exceeded storage quotas. Failed backups during scheduled or emergency maintenance windows. As soon as the maintenance window is complete, the backup will complete successfully. 2.5. The Supplier response times will be within the time stated on the selected service level agreement. The Supplier Backup Support Process and Checklist and Hosted Backup is hosted on the Supplier’s Infrastructure and therefore the responsibility of The Supplier to keep the infrastructure up and running. If the fault lies with the Supplier core infrastructure, then the Supplier takes responsibility for fixing these issues within the given SLA timelines. As the products are self-managed products, the customer will be responsible for all other issues. This process will assist our support engineers to understand if the issue is the responsibility of the Supplier or the Customer. 2.6. DATA MANAGEMENT SERVICES. 5.1. According to Covance Clinical’s licensing agreements, Covance Clinical is prohibited from sharing dictionary terminology or data with any non-subscribing client. In offering Covance Clinical’s coding services for a particular Study, the Sponsor undertakes that it has or shall obtain a current subscription for using such coding with the applicable licensor (including, Northrop Grumman/MSSO for MedDRA and Uppsala Monitoring Center for WHODRUG). Covance shall assist Sponsor in obtaining such subscription(s) 5.2. Covance Clinical is required to verify the Sponsor’s subscription to such dictionary and data services before the start of a particular Study. If it is determined that the Sponsor does not have an appropriate subscription, Covance Clinical shall have the right to: (a) inform the applicable licensor; (b) cease provision of any of the terminology or data; and (c) be reimbursed all costs, expenses and damages associated with Sponsor’s failure to be properly licensed to use such dictionary and data services.

Notwithstanding anything in this Agreement to the contrary: (a) Customer is responsible for ensuring its own compliance with legal requirements pertaining to data retention and protection; (b) it is Customer’s sole responsibility to obtain advice of competent legal counsel as to the identification and interpretation of any relevant laws and regulatory requirements that may affect Customer’s business or data retention, and any actions required to comply with such laws; (c) Ricoh does not provide legal advice or represent or warrant that its services or products will guarantee or ensure compliance with any law, regulation or requirement; and (d) the selection, use and design of any Data Management Services, and any and all decisions arising with respect to the deletion or storage of any data, as well as any loss of data resulting therefrom, shall be the sole responsibility of Customer.

DATA MANAGEMENT SERVICES. 1.7.1 Patient Registration System, Monitor Express and Client Portal Theradex Oncology will: A. Set up and maintain Theradex Oncology’s proprietary automated interactive web registration system (IWRS) for patient enrollment. B. Test, validate, and QC the system prior to implementation. Work Order #3: Phase 2 IPdR Glioblastoma study 30 July 2024 C. Provide user training and user name and password information for each user for the IWRS. Access to the IWRS will be through a secure https connection. Access to the IWRS at the site level will be determined at the start of the study. All IWRS screens will be displayed in English. D. Provide a user manual for the IWRS with step-by-step instructions for enrolling a patient as well as user management. The IWRS will collect the site ID and username. Actual enrollment will proceed by collecting a local patient ID (for audit tracking), the patient’s gender and any other necessary information that may be required for either registration or randomization. When appropriate, Sxxxxxx and Theradex Oncology will agree upon the stratification factors in the protocol. Following each entry into the IWRS a fax and/or email confirmation will be sent to the user, the site, Shuttle and Theradex Oncology clinical staff. E. Provide support and technical assistance 8:00 am to 8:00 pm U.S. Eastern Time to answer routine questions. Theradex Oncology will provide a caller ID to the central site, which will allow enrollment at any sub-site. F. Configure, prepare, and manage Monitor Express for CRA centralized access to all study related databases and as a tool for Shuttle to have real time access to monitor findings.
