DISTRICT MANAGEMENT RIGHTS. 1. The District and the Union agree that (1) all rights and responsibilities of the District not specifically modified by this Agreement shall remain the function of the District.
DISTRICT MANAGEMENT RIGHTS. ‌ All management rights shall remain vested exclusively with the District except those, which are clearly and expressly limited or explicitly eliminated by this Agreement. It is recognized merely by way of illustration that such management rights include, but are not limited to: (A) The right to determine the mission of the District, its advisory boards and commissions and work units. (B) The right of full and exclusive control of the management of the District; supervision of all operations; determination of the methods, means and personnel required to perform any and all work; and composition, assignment, direction, location, and determination of the size and mission of the workforce. (C) The right to determine the work to be performed by the employees, including establishment of levels of service and staffing patterns. (D) The right to change or introduce new or improved operations, methods, means, equipment or facilities. (E) The right to prescribe qualifications for employment and determine whether they are met; to hire, set and enforce performance standards and promote employees; to establish, revise and enforce work rules; to schedule work time; to transfer, reassign or lay off employees; to determine the content of job classifications; to suspend, reduce in step, demote, discharge or otherwise discipline employees for cause; and to otherwise maintain orderly, effective and efficient operations.
DISTRICT MANAGEMENT RIGHTS. (1) The District, on its own behalf and on behalf of the electors of the District, hereby retains and reserves all powers, rights, authority, duties and responsibilities conferred upon and vested in it by the laws of the State of North Dakota, including but not limited to the following: A. To the executive management and administrative control of the school system, and its properties and facilities, and the activities of its employees. B. To hire all employees and, subject to the provision of law, to determine their qualification, and the conditions of their continued employment, dismissal, or demotion: and to promote and transfer such employees. C. To establish grades and courses of instruction, including special programs, and to provide for athletic, recreational and social events for students, all as deemed necessary or advisable by District. D. To decide upon the means and methods of instruction, the selection of textbooks and other teaching materials and the use of teaching aids of every kind and nature. E. To determine class schedules, the hours of instruction and the duties, responsibilities and assignments of teachers and other employees with respect thereto, and non- teaching activities, and the terms and conditions of employment. (2) The exercise of the foregoing powers, rights, authority, duties and responsibilities by the District, the adoption of policies, rules, regulations and practices in furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms hereof, and by applicable laws and regulations. (3) Nothing contained herein shall be considered to deny or restrict the District in its rights, responsibilities, and authority under any national, state, county, district, or local laws or regulations as they pertain to education.

DISTRICT MANAGEMENT RIGHTS. A. MCC affirms and supports shared governance which is the formal process of collaborating, delegating, recommending, and informing decisions related to the issues affecting MCC. However, it is understood and agreed that in accordance with state law and Board Policies and Procedures, the District retains all of its powers and authority to direct and manage the District; except as modified or limited by this Agreement. B. Except as specifically provided otherwise in this Agreement, management rights, powers, authority, and functions, whether heretofore or hereafter exercised, shall remain vested exclusively in the District, including management rights, powers, authority, or functions, or as delegating to others the authority conferred by law upon the District, or in any way abridging or reducing such authority. All such matters, unless otherwise provided for in this Agreement, are excluded from the grievance procedure. C. In cases of extreme emergency necessitating closure of the college and or suspension of classes, any provisions of this Agreement conflicting with the necessary emergency procedures may be suspended for the duration of the emergency. The District shall, within one Day or as soon as practicable, meet with the MCC-NEA representatives and attempt to reach an agreement on which sections of this Agreement are affected and for what duration. An extreme emergency shall mean sudden and unexpected calamities such as earthquake, fire, flood and other occurrences which interfere with normal operations of the District. D. In the case of unique or extraordinary economic issues, defined as a significant decrease in revenue in the district operating budget or specific to a grant-funded program where the District cannot meet the current operating financial obligations, the District will immediately notify MCC-NEA to reopen negotiations on any provisions and terms of the Agreement affected by the decrease in funding.

  • MANAGEMENT RIGHTS AND RESPONSIBILITIES The Employer through its designated management personnel or agents has the right and responsibility, except as expressly modified by this Agreement, to control, change, and supervise all operations and to direct and assign work to all working forces. Such rights and responsibilities shall include by way of illustration but shall not be limited to: the selection and hiring, training, discipline and discharge, classification, reclassification, layoff, promotion and demotion or transfer of employees; the establishment of work schedules; the allocation of all financial and other resources; the control and regulation of the use of all equipment and other property of the Employer. The Employer shall determine the methods, technological means and qualifications of personnel by and for which operations are to be carried out. The Employer shall take whatever action as may be necessary to carry out its rights in any emergency situation. Application of this Article shall not preclude the use of the grievance procedure as established in this Agreement.

  • Configuration Management The Contractor shall maintain a configuration management program, which shall provide for the administrative and functional systems necessary for configuration identification, control, status accounting and reporting, to ensure configuration identity with the UCEU and associated cables produced by the Contractor. The Contractor shall maintain a Contractor approved Configuration Management Plan that complies with ANSI/EIA-649 2011. Notwithstanding ANSI/EIA-649 2011, the Contractor’s configuration management program shall comply with the VLS Configuration Management Plans, TL130-AD-PLN-010-VLS, and shall comply with the following:

  • Contract Management To ensure full performance of the Contract and compliance with applicable law, the System Agency may take actions including: a. Suspending all or part of the Contract; b. Requiring the Grantee to take specific corrective actions in order to remain in compliance with term of the Contract; c. Recouping payments made to the Grantee found to be in error; d. Suspending, limiting, or placing conditions on the continued performance of the Project; e. Imposing any other remedies authorized under this Contract; and f. Imposing any other remedies, sanctions or penalties permitted by federal or state statute, law, regulation, or rule.

  • MANAGEMENT RIGHTS 3.01 The Union acknowledges that all management rights and prerogatives are vested exclusively with the Employer and without limiting the generality of the foregoing; it is the exclusive function of the Employer: (a) To determine and establish standards and procedures for the care, welfare, safety and comfort of the residents in the facility. This includes the right to introduce new and improved methods, facilities, equipment and to control the amount of supervision necessary, work schedules, the combining or splitting up of departments, and the increases or reduction of personnel in a particular area or on the whole. 3.02 The Employer will exercise these rights in a manner consistent with the Collective Agreement and apply the provisions of the Collective Agreement in a reasonable manner.
