Early Termination of Leave. An employee on extended Board approved leave may apply for an early return to Board employment prior to expiration of such leave. The approval for said request shall be at the discretion of the Superintendent.

Termination of a leave of absence (except those listed below) before its expiration date will be considered when the member submits a written request for such early termination to the Executive Director – Human Resources. If there are no vacancies at the time of the request, early termination of the leave shall be at the discretion of the Superintendent and in accordance with the needs and interests of the schools. The Board’s responsibility for the placement of a member returning from leave is to place the teacher in the same assignment held at the time said leave commenced or an equivalent position. The following procedures operate to accomplish this: With respect to members returning from leave, the following practices shall apply:
1. Returning for the beginning of a school year:
a. Members returning from leaves which have been taken for an entire year or years may submit their requests for reinstatement before March 15. They shall then submit a transfer request form before April 1. Their assignments for the year of return shall be based on their seniority in the same manner as member-initiated transfer requests except they have a right to return to the building in which they served just prior to the leave provided the building is listed as the first choice and there is a vacancy in that building among the grade level and/or subject area requests indicated on the transfer form.
b. Members returning from leaves which began during the school year and continued through the end of the school year may submit their request for reinstatement before March 15. They shall then be treated for purposes of staffing as if they had remained in their buildings.
c. In the event a member fails to request reinstatement prior to May 15 but does so prior to the start of the following school year, the member shall be assigned at the discretion of the Department of Human Resources after all transfers based on seniority are complete except that he shall be returned to the building and position held just prior to the leave provided there is a vacancy after the seniority based transfers are completed. a. When a member begins a school year on a leave or begins a leave prior to November 1 and when, at the time of requesting the leave, the member indicates an intent to seek the termination of the leave prior to the beginning of the second semester, the member’s position shall be held open for the member’s return. Not less than ten (10) days before the termination of the leave, the employee shall submit a written statement from the attending physician, certifying that the employee has been medically examined and that he/she is or will be able to resume his/her duties with the Employer when the leave of absence expires. The Employer may require, at the Employer’s expense, an examination by a physician designated by the Employer before the employee is reassigned.
Early Termination of Leave. DECE may terminate a pregnancy or parental leave and return to work upon providing the Board with two (2) week’s written notice to their supervisor.

An employee on pregnancy leave may file a written request with the Human Resources office that she be notified of any position with less strenuous duties than her former position, and for which she is qualified under district standards, that become vacant during the period of the leave. The employee may submit a timely written request for early termination of leave and temporary transfer to such position under district- established procedures.
b. In lieu of leave, an employee subject to this provision may request temporary transfer to any vacant and less strenuous position for which she is qualified under district standards. The District may require medical certification of the need for transfer.
c. The decision whether to grant a request for early return from leave or a request for temporary transfer under this Article will be exclusively left to the District. An arbitrator will have no authority to rule on or consider any dispute regarding requests for early return from leave or temporary transfer. In the event of a dispute regarding such requests, the employee’s recourse will be to appeal the decision through the Board policy grievance procedure. The School Board’s decision will be final and binding on the parties.
Early Termination of Leave. The Company may request in writing that a Flight Crew Member on leave without pay for a definite period of time return to work earlier than expected. Such request may be accepted by the Flight Crew Member.

An employee on pregnancy leave may submit an electronic and/or written request with the Human Resources Office that she be notified of any teaching positions, with less strenuous duties than her former position and for which she is licensed and qualified, that become vacant during the period of the leave. The employee may submit a timely electronic and/or written request for early termination of leave and temporary transfer to such position under District-established procedures.
