Employees Returning to the Bargaining Unit. Employees appointed to a temporary out of scope position will maintain their membership in the union and will continue to pay dues based on their in-scope wage.

Employees Returning to the Bargaining Unit. A. Any member of the bargaining unit who is promoted into a position which directly supervises Maintenance & Operations employees or is transferred out of the bargaining unit within the College, may elect to return to the bargaining unit or be returned to the bargaining unit by management within one (1) year from the date of the promotion/transfer out of the bargaining unit. B. During this one (1) year period, the promoted/transferred employee may return or be returned to his/her former position with a loss of seniority (for the period of time transferred out of the bargaining unit) and at the rate of pay which would have been in effect had the employee not been promoted/transferred. C. All rights and benefits under the Maintenance & Operations contract cease for the promoted/transferred employee after this one (1) year period, except in the case of lay- off the employee may return to the bargaining unit by exercising his/her seniority accumulated prior to the promotion/transfer. D. Thirty (30) calendar days notice will be given to all parties by the party requesting the return (inclusive of layoff) unless otherwise agreed by union and the College.
Employees Returning to the Bargaining Unit a) Employees who accept an Employer’s appointment outside of the Bargaining Unit on a temporary basis and who return to a Bargaining Unit position within six (6) months shall not lose any seniority and shall continue to accumulate seniority. b) Employees who return to the Bargaining Unit after more than six (6) months shall return with only their seniority earned while employed as a Bargaining Unit member.

Thirty (30) calendar days notice will be given to all parties by the party requesting the return (inclusive of layoff) unless otherwise agreed by Union and the College. Return to the unit under this section may result in the displacement/lay off of a less senior unit member.

  • Performance of Bargaining Unit Work No person whose regular job is not in the bargaining unit will work on any job for which rates are established by this Agreement, except for the purposes of instruction, experimentation, or management training, in which case trainees shall not displace or replace any employee in the aforesaid classifications except in cases of emergency when regular employees are not available.

  • Work of the Bargaining Unit (a) In order to protect the standard of nursing care, the Employer shall not contract out the work normally performed by members of this bargaining unit except: i) For purposes of instruction, ii) In the event of an emergency situation, iii) When performing developmental or experimental work, or iv) When employees are not available due to an employee not reporting for work as scheduled or not being available for work. (b) Reassignment to other employees of work normally performed by members of the bargaining unit shall not result in the termination, layoff or reduction in hours of any member of the bargaining unit. (c) When it is decided to not fill a position following an employee’s resignation, the Home will provide the rationale in writing for this decision to the Union. The Union may request a meeting to make representations on this matter.

  • Bargaining Unit The term "bargaining unit" as used in this Agreement refers to the bargaining unit defined in Article 1, Recognition.

  • Bargaining Unit Work The City agrees that it will not assign work currently performed by employees under this Agreement to City employees in other bargaining units.
