Formal Level II. If the Association is not satisfied with the disposition of the grievance at Level I or if no disposition has been made within ten (10) days of receipt of the grievance, the grievance shall be transmitted to the superintendent or designee. Within ten (10) days after the grievance has been submitted to the superintendent, the superintendent or designee shall meet with the Association on the grievance. The superintendent or designee, within ten (10) days after the conclusion of the meeting, shall render his/her written decision thereon with copies to the Association and the grievant(s).

Formal Level II. 1. If the grievance is not settled at Level One, it may be appealed to the Superintendent by filing a written notice within five (5) working days after receipt of the principal’s written answer. If the grievance is not appealed within five (5) working days after receipt of such answer, it shall be deemed resolved.
Formal Level II. In the event CSEA Chapter 420 is not satisfied with the decision at Formal Level I, CSEA Chapter 420 may appeal the decision in writing to the office of the Vice Chancellor, Human Resources, or designee within ten (10) days after the receipt of the Formal Level 1 decision.

Copies of the Board’s written decision shall be transmitted to the Association and the grievant(s).

The Employer’s designated representative shall indicate the disposition of the grievance in writing within ten (10) days of such meeting and shall furnish a copy thereof to the Association.

This statement shall include a copy of the original grievance and appeal, the decisions rendered, and reasons for the appeal. The Vice President of Human Resources shall communicate their decision to the grievant and the Superintendent/President, within ten (10) days after receiving the appeal. If the Vice President of Human Resources does not respond within the time limits, the grievant may appeal to the next level.

The Superintendent /President or designee shall provide a written response within (15) days from receipt of a written grievance. Within those fifteen (15) days, the Superintendent/President or designee, the grievant, or the CSEA Representative, may request a conference to discuss a possible resolution to the grievance. If a conference is held, the written response shall be due within fifteen (15) days of the conference.
