Formal Level II Clause Samples
The 'Formal Level II' clause establishes a specific escalation stage within a dispute resolution or grievance process. At this level, issues that were not resolved informally or at a lower level are formally documented and reviewed by higher management or a designated committee. This process typically involves written submissions, scheduled meetings, and a structured timeline for response. The core function of this clause is to ensure that unresolved matters receive a more formal and thorough review, providing a clear pathway for addressing disputes and promoting fair resolution.
Formal Level II. 1. If the grievance is not settled at Level One, it may be appealed to the Superintendent by filing a written notice within five (5) working days after receipt of the principal’s written answer. If the grievance is not appealed within five (5) working days after receipt of such answer, it shall be deemed resolved.
2. A discussion with the Superintendent or the designee with the intent of satisfactorily resolving the grievance shall be held within fifteen (15) days following receipt of such notice. The Superintendent will notify the grievant and the Association of the date, the time, and the place where such discussion shall be held. The written decision shall be transmitted to the grievant and the Association within ten (10) days after said discussion.
Formal Level II. In the event the grievant is not satisfied with the decision at Formal Level I, they may appeal the decision in writing to the Vice President of Human Resources, who will work in consultation with the area Vice President, within ten (10) days. This statement shall include a copy of the original grievance and appeal, the decisions rendered, and reasons for the appeal. The Vice President of Human Resources shall communicate their decision to the grievant and the Superintendent/President, within ten (10) days after receiving the appeal. If the Vice President of Human Resources does not respond within the time limits, the grievant may appeal to the next level.
Formal Level II. If the Association is not satisfied with the disposition of the grievance at Level I or if no disposition has been made within (5) days of receipt of the grievance, the grievance shall be transmitted to the Senior Executive Director of Human Resources or designee. Within seven (7) days after the grievance has been submitted, a representative of the Human Resources Department shall meet with the Association on the grievance. Within five (5) days after the conclusion of the meeting, the Senior Executive Director of Human Resources or his/her designee shall render his/her written decision thereon with copies to the Association and the grievant(s).
Formal Level II. If the Association is not satisfied with the disposition of Level I, the grievance shall be submitted by the Association to the Superintendent, or his/her designee, within five (5) days. The Superintendent, or his/her designee, shall meet with the Association and/or the grievant within five (5) days after receipt of the grievance and shall indicate his/her disposition, in writing, to the Association within five (5) days after such meeting.
Formal Level II. In the event CSEA Chapter 420 is not satisfied with the decision at Formal Level I, CSEA Chapter 420 may appeal the decision in writing to the office of the Vice Chancellor, Human Resources, or designee within ten (10) days after the receipt of the Formal Level 1 decision.
23.3.5.1 This appeal shall include a copy of the original grievance statement, the decision rendered at Formal Level I, and a clear, concise statement of the reason(s) for the appeal.
23.3.5.2 Upon request of CSEA Chapter 420 or the Vice Chancellor, Human Resources, or designee, a Formal Level II conference shall be held.
23.3.5.3 The Vice Chancellor, Human Resources, or designee shall issue a written decision to CSEA Chapter 420 within ten (10) days of receipt of the written statement (grievance), OR within fifteen (15) days of receipt of the written statement (grievance) if a Level II conference is held.
23.3.5.4 Failure of CSEA Chapter 420 to meet the time limits in this article shall invalidate the grievance.
23.3.5.5 Failure of the District to meet the time limits in this article shall move the grievance to the next level.
23.3.5.6 Time limits may be extended, shortened or held in abeyance by mutual written agreement between CSEA Chapter 420 and the District.
Formal Level II. If the Association is not satisfied with the disposition of the grievance on Level I, or if no disposition has been made within five days (5) of such meeting (or ten days (10) from the date of filing, whichever shall be later), the grievance shall be transmitted to the superintendent. Such transmittal shall be within five days (5) following completion of Level I. Within seven days (7) of receipt of the transmittal, the superintendent or his/her designee shall meet with the Association on the grievance and shall indicate his/her disposition of the grievance in writing within five days (5) of such meeting and shall furnish a copy thereof to the Association.
Formal Level II. A statement of appeal Level I, including a copy of the original grievance, the decision/resolution rendered (if any), and a clear, concise statement of the reasons for the appeal will be presented to the Associate Superintendent of the department regarding the grievance.
Formal Level II. 20.5.1 If the grievant is not satisfied with the decision at Level I, he/she may, within ten (10) days of the date of the response or its due date, appeal the decision by submitting a clear, concise statement of the reasons for the appeal, and the specific remedy sought. The statement of appeal shall be given to the appropriate ▇▇▇▇. The ▇▇▇▇ shall provide a copy to SRJC CFT and the Human Resources Department.
20.5.2 The ▇▇▇▇ or his/her designee shall communicate the decision to the grievant, SRJC CFT and the Human Resources Department within ten (10) days. If the ▇▇▇▇ or designee does not respond within the time limits provided, the grievant may appeal to the next level.
Formal Level II. If the Association is not satisfied with the disposition of the grievance at Level I or if no disposition has been made within five (5) days of the immediate supervisor’s receipt of the grievance, the grievance may be appealed to the Board. Any appeal to the Board must be made within five (5) days of receipt of the immediate supervisor’s written decision or within five (5) days of the date the immediate supervisor’s written decision was due. Within seven (7) days after the grievance has been appealed to the Board, the Board shall meet with the Association to discuss the grievance. At the next regularly scheduled Board meeting occurring at least five (5) days after the conclusion of the Formal Level II meeting, the Board shall render a written decision on the grievance. Copies of the Board’s written decision shall be transmitted to the Association and the grievant(s).
Formal Level II. 1. If the grievance is not settled at Formal Level I, the grievance may be appealed within five (5) working days after receipt of the non-Union supervisors (or designee's) written answer to the Superintendent (or designee) who shall address the grievance at a time mutually agreeable to the Superintendent and the Union representative.
2. The Superintendent (or designee) shall give his/her written answer to the grievance within five (5) working days of above meeting.
