Formal Level I. An aggrieved person shall first file the grievance in writing with his/her principal or immediate supervisor. (See Grievance forms on Aberdeen School District website) The principal or supervisor shall arrange a meeting with the aggrieved person and his/her representative(s), if any, to take place within five (5) school days after the grievance has been filed. Within five (5) school days after the meeting, the principal shall render a decision in writing to the aggrieved party and to his/her representative(s), if any. (See Grievance forms on Aberdeen School District website) Level II: If the aggrieved person is not satisfied with the disposition of his/her grievance at Level I or if no written decision has been rendered within five (5) school days after the meeting at which the grievance is heard, he/she may file the grievance in writing with the Superintendent within seven (7) days after the decision at Level I or twelve (12) days after the grievance was presented at Level I, whichever is sooner. The Superintendent shall arrange a meeting with the aggrieved person and his/her representative(s), if any, within five (5) days and within five (5) days after said meeting the Superintendent shall render his/her decision in writing to the aggrieved party and to the representative(s), if any. (See Grievance forms on Aberdeen School District website) Level III If the aggrieved person is not satisfied with the disposition of the grievance at Level II or if no written decision has been rendered within five (5) school days after the hearing on the grievance at Level II, the grievance may be filed in writing with the Board within seven (7) days after the decision at Level II or twelve (12) days after the grievance at Level II was presented, whichever is sooner. The Board shall hold a hearing except that when multiple grievances are pending before the Board, a hearing panel consisting of not less than three (3) Board members may be appointed by the Board to conduct the grievance immediately following the Board’s next regular meeting unless the date is changed by mutual consent of the Board and the grievant. When multiple grievances are pending, the Board may, in its discretion, extend the time for a hearing to a time that is more convenient under all the circumstances then existing. Formal Level I a. Within five days after an informal conference that fails to satisfy the grievant, the grievant must present his/her grievance in writing.
b. This statement shall be a clear, concise statement of the grievance, the specific section of the collective bargaining agreement allegedly violated, the circumstances involved, the decision rendered at the informal conference, and the specific remedy sought.
c. The building principal shall communicate his/her decision in writing to the employee and the Association within five days after receiving the grievance. Failure to do so shall be deemed a negative final decision.
d. Failure by a grievant to file a grievance in writing within the specified time limit shall constitute a waiver of the grievance and no further action under this procedure shall be taken.
Formal Level I. If the grievance is not resolved in the meeting between the affected Bargaining Unit Member and his/ her immediate supervisor, the complaint may be formalized as a grievance. A formalized grievance must be submitted, in writing, to the immediate supervisor within ten (10) days of the meeting between the supervisor and the affected Bargaining Unit Member. The affected Bargaining Unit Member shall also send a copy of the grievance to the Association within said ten (10) day period. The immediate supervisor shall, within five (5) days of the receipt of the grievance, render a written decision. A copy of the decision shall be forwarded to the grievant(s) and the Association.
Formal Level I. If, as a result of the informal discussion with the immediate supervisor the complaint is not resolved, a formalized grievance shall be submitted in writing to the Human Resources office within fifteen (15) days following the date of the alleged grievance. The written grievance to the Human Resources office shall include:
a. Identification of the grievant(s).
b. The specific facts upon which the grievance is based.
c. Identification of the applicable portion of the Agreement allegedly violated, misinterpreted, or misapplied.
d. The specific relief requested.
e. The date on which the alleged grievance occurred.
f. The date on which the grievance is being filed.
g. A signature attesting to the facts as presented.
Formal Level I. If a complaint is not resolved at the informal level, the complaint may be formalized as a grievance, in writing, within five (5) days. A copy of the grievance shall be sent to the Association and the immediate supervisor. The immediate supervisor shall, within five (5) days of the receipt of the grievance, render a written decision. A copy of this decision shall be forwarded to the grievant(s) and to the Association Representative.
Formal Level I. 20.4.1 If the issue is not resolved at the informal level, the grievant must present the grievance in writing on the SRJC Older Adults Program Unit B Grievance form to the immediate supervisor no later than ten (10) days after the informal discussion. The immediate supervisor shall forward a copy to SRJC CFT. The grievance form is available at the Human Resources Department. The completed form shall be a clear, concise statement of the grievance; the grievant’ s designated representative, if any, the circumstances involved, the decision rendered at the informal conference, and the specific remedy sought.
20.4.2 The immediate supervisor shall communicate his/her decision to the faculty member and SRJC CFT in writing within ten (10) days after receiving the grievance form. If the immediate supervisor does not respond within the time limits, the grievant may appeal to the next level.
20.4.3 Within the above time limits, either party may request a personal conference.
Formal Level I. 1. If, as a result of the informal discussion with the immediate supervisor, the alleged grievance still exists, the employee or Union representative may invoke the formal grievance procedure on a form signed by the grievant and/or Union representative, which form shall be available from the local Union representative. A copy of the completed and signed grievance form shall be delivered to the employee's non-Union immediate supervisor (or designee) within three (3) working days after oral discussion.
2. The written grievance shall include (as a minimum):
a. Identification of the grievant(s)
b. The specific facts upon which the grievance is based
c. Identification of the specific portion of the Agreement allegedly violated
d. The specific relief requested e. The date on which the alleged grievance occurred
Formal Level I. In the event the grievant or CSEA Chapter 420 is not satisfied with the decision at the informal level they may choose to advance the grievance to the formal levels. CSEA Chapter 420 shall present a formal written statement (grievance) to the immediate management supervisor and the next level supervisor within twenty (20) days of the informal conference as described in Article 19.2.
Formal Level I. Department Head or Designee
1. In the event the grievance is not resolved at the informal meeting, within ten (10) days of the informal meeting the grievant may submit the grievance as a formal written grievance to the department head or his/her designee. If the grievant has not submitted a written grievance within this time period, the grievance will be deemed to have been resolved.
2. Within ten (10) days after receipt of the written grievance by the department head, a personal conference with the other party shall take place upon the request of either the grievant or the department head. Within fifteen (15) days after receipt of the grievance or ten (10) days after the date of the Level I meeting, whichever is later, the department head or his/her designee shall render a written decision to the grievant and shall transmit a copy to the Union.
3. In those cases where a “grievance” regards a disciplinary proceeding which is both subject to the grievance procedure and which constitutes a proposed deprivation of property giving rise to a pre-disciplinary proceeding in accord with Xxxxxx vs. State Personnel Board, the subject employee shall commence his/her grievance at this Level I. The proceeding before the department head or designee shall constitute both an exhaustion of the Level I grievance and provision of any due process- mandated pre-deprivation proceeding.
Formal Level I. Where a satisfactory resolution has not been reached at the Informal Level, the grievance shall be forwarded on the appropriate form to the appropriate District Vice President or designee within fifteen (15) days after the informal response.
