Formal Step Two. If the Association is not satisfied with the disposition of the grievance at Level One and if no disposition has been made within five (5) working days of receipt of the grievance, the grievance shall be transmitted to the Superintendent of Schools. Within five (5) working days after the grievance has been submitted, the Superintendent shall meet with the Association on the grievance. The Superintendent, within seven (7) working days after the conclusion of the meeting, shall render a written decision thereon with copies to the Association and the grievant(s). If the Superintendent is the immediate supervisor, the Association may forego Step Two and proceed to Step Three.

Formal Step Two. If the grievant is not satisfied with the disposition of the grievance in Step One, he/she 42 may schedule a meeting to submit it on the adopted form to the Superintendent or his/her designee no later 43 than ten working days after the written response was received in Step One. The Superintendent or his/her 44 designee shall submit a written response no later than ten working days after the Step Two meeting. Should 45 the response be a rejection of the grievance, the Superintendent or his/her designee will summarize his/her 46 reasons for so ruling.
Formal Step Two. If the grievant believes that the grievance has not been resolved satisfactorily, the grievant may, within five (5) days after receipt of the written answer as required in Formal Step One, refer it in writing to the Superintendent. The Superintendent shall, within five (5) days after receipt of the grievance, meet with the grievant to discuss the grievance. Within five (5) days after such meeting, the Superintendent shall give to the grievant, the Principal or immediate supervisor and the ASSOCIATION President, a written answer.

If the aggrieved person is not satisfied with the disposition of the grievance at Step One or if no decision has been rendered within five (5) working days after the grievance was delivered, he/she may, within five (5) working days request in writing that the grievance be advanced to Step Three.
Formal Step Two. If the Grievant and the Faculty Senate are not satisfied with the disposition by the Chief Academic Officer, or if no disposition has been made within five (5) working days after the date of receipt, the grievance may be submitted to the President or their designee. If a disposition has been made by the Chief Academic Officer within five (5) working days after the date of receipt, the grievance must be submitted to the President or their designee within five (5) working days after receipt of the disposition by the Chief Academic Officer, or such disposition will be deemed satisfactory. If no disposition has been made by the Chief Academic Officer within five (5) working days after the date of receipt, then the grievance must be submitted to the President within five (5) working days after the deadline for disposition by the Chief Academic Officer, or the grievance will be deemed to have been waived. The President or their designee will have ten (10) working days after the date of receipt within which to schedule and hold a meeting with the Grievant and the Faculty Senate, at such date, time, and place as is mutually agreeable, in an effort to resolve the grievance. The President or their designee will then have five (5) working days after the date of such meeting to render their disposition of the grievance.
Formal Step Two. If a mutually satisfactory agreement is not reached at Step One, the grievant may refer the grievance in writing to the Superintendent or his designated representative within ten (10) days after receiving the written decision at Formal Step One or within ten (10) days of the date the decision at Formal Step One should have been rendered. The statement shall include the steps taken to resolve the grievance and the decisions reached to that date. The Superintendent or his designated representative shall confer with the grievant and shall render a written statement giving the basis for the decision within ten (10) days of filing of the grievance at Formal Step Two.

The statement shall include the steps taken to resolve the grievance and the decisions reached to that date. The Building Principal shall be provided with a copy of this communication by the grievant. The Superintendent or designee or his/her designated representative shall meet with the grievant and shall render a written statement giving the basis for decision within ten (10) days of the meeting or fifteen (15) days of the filing of the grievance at Formal Step Two, whichever is later. Formal Step Three. If a mutually satisfactory agreement is not reached in Formal Steps One or Two, the grievant may refer the original grievance, in writing, to the Board of Education within ten (10) days after receiving the written decision in Formal Step Two. The grievant shall provide the Superintendent or designee with a copy of all communications to the Board of Education. The Board of Education shall hear and consider the grievance within twenty (20) days after receipt of the referral of the grievance to the Board. The Board of Education shall render a written statement giving the basis for its decision within ten (10) days after hearing the grievance and shall communicate this decision through the Superintendent’s office to the parties concerned. Formal Step Four. If the grievance is not resolved satisfactory at Step Three, the grievant and the Association may submit the grievance to final and binding arbitration by an arbitrator from the American Arbitration Association who shall act as the administrator of the proceedings. If a demand for arbitration is not filed with the American Arbitration Association within twenty (20) days of the date that the Step Three answer is received by the Association, unless the parties mutually agree to select a private arbitrator within such time limits, then the grievance shall be deemed withdrawn. Neither party to the grievance will be permitted to assert grounds not previously asserted before the Board. Each party shall be entitled to representation and witnesses. The cost of the arbitrator shall be borne equally between the aggrieved party and the School District.
