Health and Safety Procedures. The Employer shall provide a safe and healthful place of employment for each employee, and comply with all local, state, and federal health and safety laws and regulations. In accordance with such laws and regulations, no retaliatory or discriminatory actions shall be taken against any employees who, in good faith, refuse to work because of dangerous or unhealthful conditions at their place of employment that are abnormal to their duties or place of employment. Further, no retaliatory or discriminatory action shall be taken against any employee(s) who report abnormally dangerous or unhealthful conditions at their place of employment to their supervisors, agency officials, or other proper authority, including their Union.
Health and Safety Procedures. SECTION 1. The appointing authority shall comply with any and every applicable statute, federal and state, and with any such rules and regulations as may be promulgated there under, that govern the conditions of health and safety in the place of work of its employees. The appointing authority may promulgate and enforce any such rules and regulations as it may deem appropriate from time to time to provide for the safety of its employees and to ensure compliance with any such statute or with the rules and regulations promulgated thereunder. SECTION 2. The appointing authority agrees to provide a safe, clean, and wholesome surrounding in all places of employment. In order to promote such an environment, the appointing authority agrees that no person shall smoke in any university building except as permitted by the University Smoke Free Campus Policy. SECTION 3. In locations where valves or other control devices may be located, the person in charge shall ascertain that no obnoxious or poisonous gases are present therein before permitting any employee to enter. When such gases are present, no employee shall be permitted to enter the area until the situation is corrected. Protective devices must be used where any danger is present. Department heads shall make reasonable effort to avoid making work assignments which expose inadequately equipped employees to the harmful effects of hazardous substances (e.g. asbestos. PCB’s, arsenic, etc.). SECTION 4. Eye xxxxxxx, ear guards, or other protective face guards shall be furnished without cost to all employees, where required, for their work in the units represented by the Association. If an employee loses these eye xxxxxxx, then the employee shall assume all costs of replacement. SECTION 5. Department heads shall at all times be concerned with the safety and health of employees of their respective departments. SECTION 6. The appointing authority shall issue instructions to all supervisory personnel to carry out the provisions of this Article. SECTION 7. If a tool, machine, or piece of equipment is dangerous to operate because of its condition, the supervisor shall not permit its use until authorized by their department head or designee. SECTION 8. Health and Safety Procedures. 16.1 The Supplier shall, and shall procure that its Designated Employees, subcontractors and agents shall: 16.1.1 comply with all the CSIR’s policies, including in particular the safety, health and security policies from time to time; 16.1.2 comply with all Applicable Laws pertaining to health and safety in respect of the Works; and 16.1.3 use Commercially Reasonable Efforts to ensure that the provision of the Works at the Site does not cause any unnecessary obstruction or hazard to the CSIR, its Designated Employees, agents and any third parties. 16.2 The Supplier shall consider itself “Customer” for the purposes of any Applicable Laws and shall not consider itself under the supervision or management of the CSIR with regard to compliance therewith. 16.3 The Supplier shall ensure that all statutory appointments are made and that all appointees fully understand their responsibilities and are trained and competent to execute their duties. 16.4 The CSIR shall have the right to: (i) suspend the provision of the Works whenever safety violations or conditions are observed which could jeopardise the well-being of personnel and/or the safety of equipment at the CSIR’s premises; and/or (ii) request that the Supplier immediately attends to the rectification of such safety violation(s). The expense of any suspension of the Works shall be for the Supplier’s account. 16.5 The CSIR shall be entitled to terminate this Agreement on 10 (ten) Business Daysprior written notice if the Supplier fails to correct the observed violation or condition as requested by the CSIR in terms of Clause 16.4.

Health and Safety Procedures. In response to the COVID-19 pandemic, Xxxxxxx X. Xxxxxx State University (“University”) has modified its normal campus operating procedures to protect the health and safety of the University community. In accordance with Student’s agreement to abide by all applicable law and all University policies and procedures, Student shall comply with the following requirements, as implemented and directed by University, when residing in any University Housing facility.
Health and Safety Procedures. 13.1 The Contractor shall comply with all health and safety requirements at set forth in the Contract Documents, including, inter alia, Volume 5/5 (Health and Safety Plan) and in accordance with the Contractor's Health and Safety Plan as shall be approved by NI, and any applicable Law, including the Work Safety Ordinance [New Version] 5730 - 1970 and the regulations there under. 13.2 The health and safety of the Site, the persons employed on Site, and of any third party surrounding or adjacent to the boundaries of the Site shall be of top priority at any stage of the execution of the Project. 13.3 It is hereby emphasized that the Contractor shall be deemed as the Primary Contractor at the Site, for the purpose of any health and Safety requirement set out under Law. The Contractor shall comply with all requirements applicable to the Primary Contractor, including, inter alia, the appointment of safety officers and the issuance of all required notices, all as set out under any applicable Law. Notwithstanding the foregoing, NI may, at its sole discretion, inform the Contractor that a third party contractor shall act a Primary Contractor with respect to specific parts of the Site, and the Contractor shall comply with all safety instructions provided by such Primary Contractor regarding such specific parts of the Site. 13.4 The Contractor hereby undertakes to immediately remedy and/or repair any damage and/or defect and/or event related to safety, and in no event later than two (2) hours after the Contractor became aware and/or was notified of the defect and/or damage and/or event. Without derogating from NI’s other rights and/or remedies pursuant to this Contract and/or the Law, NI will be entitled to collect Liquidated Damages in the amounts and terms specified in Volume 6/1 (Safety Appendices) to the Contract Documents. 13.5 Without derogating from any other contractual provisions, the Contractor undertakes to provide, protection, fencing and safety measures at the Site, including at the Work Base, as required by the Project Manager and in accordance with any Law, practice or obligatory instruction of relevant Authorities. 13.6 The Contractor undertakes to erect fences and warning signs at the Worksite and Work Base at its own expense.
