Holdovers. In the event that the Lessee shall remain in the Demised Premises after the expiration of the term of the Lease without having executed a new written Lease with the Lessor, such holding over shall not constitute a renewal or extension of this Lease. The Lessor may, at its option, elect to treat the Lessee as one who has not removed at the end of its term, and thereupon be entitled to all the remedies against Lessee provided by law in that situation, or the Lessor may elect to construe such holding over as a tenancy from month to month, subject to all the terms and conditions of this Lease, except as to duration.
Holdovers. If the Licensee fails to immediately remove the vessel from the Marina upon any expiration or termination of this License, the Licensee shall pay to Bosport on demand a holdover charge at the daily transient rate specified by Bosport from time to time, together with all other amounts due to Bosport. Furthermore, if the Licensee fails to immediately remove the Vessel from the Marina upon the expiration or termination of the License, Bosport shall have the right to remove the Vessel from the Marina, forcibly if necessary, and to store the Vessel at the Licensee’s expense. If the Licensee fails to remove the Vessel from storage within 30 days, Bosport shall have the right to deem the Vessel abandoned and to dispose of it by any customary methods without accounting to the Licensee or the Vessel’s owner.
Holdovers. In the event Lessee maintains occupancy of the premises past the term of this Lease, Lessee shall be a tenant at will, and in no event shall Lessor and Lessee be deemed to have renewed this Lease for an additional term. Lessee may sublease areas of the premises to other “Marketing Related Businesses”. Lessee shall not assign, mortgage, pledge, or encumber this Lease or the demised premises in whole, nor permit the premises to be used or occupied by others, nor shall this Lease be assigned or transferred by operation of law, without the prior consent in writing of Lessor in such instance, which will not be unreasonably withheld. Collection of rent from any assignee, transferee, subtenant, or occupant, and/or application of the net amount collected to the rent reserved herein, shall not be deemed a waiver of any agreement or condition hereof, and such action shall constitute the acceptance of the assignee, transferee, subtenant or occupant.
Holdovers. The Work Group will offer (holdover) overtime to employees who are already working on the job according to the following procedure: The personnel already working on the job will be offered the work first, regardless of their normal overtime group. In the event the assignment involves work in process, and continuity of the work is required, Company may assign the employees already working the job. If a group consists of both central and resident personnel, the resident personnel on the job will be offered the work first. If additional personnel are needed, the work will be offered to the central personnel on the job prior to offering it to the resident personnel who are not working the job at the time the overtime occurs. If the job has not been started, the first employee held over shall be the lowest qualified mechanic from the group involved, and all succeeding personnel required for the job shall be obtained by beginning with the lowest qualified employee in the group (ML4, 3rd year mechanic, 2nd year mechanic, 1st year mechanic, or utility person), until the job is manned. In the event that additional help outside the group is needed, the Work Group will contact the lowest qualified employee (ML4, 3rd year mechanic, 2nd year mechanic, 1st year mechanic, and utility person) from the central maintenance group until the job is filled. If for some reason the job still cannot be manned, the Work Group shall call the other resident group in the same order until all are called. All holdovers should be notified as early as possible before quitting time. In the event sufficient volunteers are not obtained, employees may then be mandatory assigned. The Work Group will start to fill hold-over requirements as well in advance of 2:00 p.m. as practicable. If by 2:30 p.m. the required hold-over personnel have not been obtained, the Company will notify the junior qualified employee that they may be required to stay over. The Work Group will continue to try to obtain the personnel requirements through the established overtime procedure until 2:30 p.m. At this time, personnel requirements not already fulfilled will be obtained by assigning the junior qualified employee in the maintenance department to stay over.
Holdovers. If Tenant holds over on termination of this lease and Property Owner accepts Tenant's tender of the rent provided by this lease, this lease shall continue to be binding on the parties as a rental period to rental period agreement.
Holdovers. In the event Lessee maintains occupancy of the office space past the term of this Lease, Lessee shall be a tenant at will, and in no event shall Lessor and Lessee be deemed to have renewed this Lease for an additional term, except as agreed to in writing by the parties.
Holdovers. In the event of a holdover, the Employer shall advise the Union not less than one week prior to the original closing date of the production. Employees affected will exercise their option to continue working the production or be replaced. This option must be exercised within twenty-hour (24) hours of notice being given. Early Closure of a Show
Holdovers. In the event Tenant does not surrender the Leased Premises at the expiration or termination of this Lease, but holds over without the prior written consent of Landlord, Tenant shall be obliged to perform all of the obligations of the Tenant as are stated herein, except that the Base Rent shall be twice the amount called for.
Holdovers. No employee shall be relieved from duty at the change of shift if his or her respective relief has not reported. The employee shall be required to holdover and shall be paid at their regular overtime rate and will stay on duty until the relief employee has reported for duty. When an overtime is required, the holdover employee shall be offered the opportunity first. The holdover employee may accept or decline without receiving a refusal for said overtime. If the holdover employee declines, the overtime assignment shall be hired according to the Urgent Hiring Practice contained in the Overtime Hiring Practices Book.
Holdovers. A Holdover is defined as an occurrence where one employee holds over for another employee three (3) hours or more at the normal beginning of a work shift. Any employee, assigned to a shift as strength, may engage in a holdover provided:
1) Such holdover is between two (2) Firefighters; Firefighter-Paramedics; Lieutenants.
2) The Chief of Department, or designee, must approve the holdover request and such request is received and posted not less than one (1) hour prior to its becoming effective except for a sudden and unexpected emergency in which case a request may be received and posted in under one (1) hour.
3) Such holdover does not impose any additional cost to the Town. The employee requesting the hold over is entitled to an exemption from overtime for the shift preceding the holdover. The employee doing the holding over is only entitled to exemption from overtime for an overtime that would encroach upon the holdover timespan.
