Maintenance Department. (a) The Employer will consult with the Union not less than two weeks before posting a new job classification. The Employer will entertain any suggestions from the Union, made before the job is posted.
(b) Where a job vacancy occurs or a new job is created, notice shall be posted within seven (7) working days at appropriate locations, including all bulletin boards, for a minimum period of ten (10) working days and a copy of the notice shall be sent to the Union. The notice shall set out the qualifications required by the job, classification and wage rate.
(c) In filling job vacancies, employees shall be selected on the basis of their skill, competency, efficiency, merit, and ability. Where these factors are, in the opinion of the Employer, relatively equal amongst the employees considered, seniority shall govern providing the successful applicant, if any, is qualified to perform the available work.
(d) New employees shall not be hired where there are employees on lay-off able to perform the job.
(e) If a qualified employee is required to work in a higher paying classification for a period of two (2) consecutive hours or more, he will be paid the rate of the higher paying classification for hours worked in the higher paying classification. An employee will be deemed to be qualified if the Employer requests him/her to perform the work.
(f) Employees may be hired for a specified term, not to exceed 6 months, to replace an employee on leave or to perform a special non-recurring task. This term may be exceeded a further 3 months on mutual agreement of the Union, employee, and the Nordic Gaming Corporation. The period of employment of such person will not exceed the absentee's leave. The release or discharge of such persons shall not be the subject of a grievance or arbitration. This clause would not preclude such employees from using the job posting provisions under the Collective Agreement and any successful applicant who has completed his probation period will be credited with the appropriate seniority. In filling such temporary positions, the initial opportunity will be posted for 3 working days and will be filled by the most qualified applicant. Subsequent temporary positions shall be filled at the discretion of the Employer. Notwithstanding the foregoing, temporary positions for licensed tradesmen classifications in Schedule “A” do not require posting and the Employer may hire such temporary replacements directly from outside the bargaining unit.
Maintenance Department. The parties recognize that there are different situations in the Maintenance Department in Trade and Craft classifications which create the need for overtime opportunities, these are:
i) finish assigned task,
ii) perform additional work,
iii) fill shift vacancies.
a) Where the employee is performing an assigned task which may necessitate the working of hours beyond the normal quitting time, such employee will be offered the opportunity to finish the task.
b) If such employee refuses the opportunity, a volunteer will be sought from those employees on shift, who are within that job classification, in accordance with the overtime equitability list of the applicable comparator group.
c) Should there be more than one opportunity, employees who are within that job classification will be afforded such opportunities in accordance with the overtime equitability list of the applicable comparator group.
d) Where it is anticipated that a particular job may generate overtime, employees in the same comparator group with the lower overtime hours offered shall be assigned to that job.
e) Additional work opportunities that may arise, such as down shift, will be offered to employees, in accordance with the overtime equitability list of the applicable comparator group, within the job classification required.
f) Where an absence occurs on shift jobs, the employee who would have been relieved by the absentee, will be afforded the first opportunity to work overtime to the extent possible. All remaining vacant hours shall be filled in accordance with the overtime equitability list of the applicable comparator group.
g) If the employee refuses, the off-going shift person from the other department will be afforded the same opportunity as above.
h) If these employees refuse the opportunity, the Company will fill the vacancy from those employees who are within that job group and classification, in accordance with the overtime equitability list of the applicable comparator group.
Maintenance Department. The Union agrees to the Company supplementing its workforce from outside sources to assist in carrying out plant requirements in the following manner: (i) Boilermakers Union Hall - (provided they are paid our agreement rates and the Company is not required to sign the Boilermakers Agreement).
Maintenance Department. (a) A full-time employee will be on probation until he has completed sixty (60) working days in a twelve (12) month period. A part-time employee will be on probation until he has completed four hundred and eighty (480) hours. Upon completion of such probationary period, the employee's name shall be placed on such Seniority List and, in the case of a full-time employee, credited with seniority back to date of hire, and, in the case of a part-time employee, credited with 480 hours of seniority. A revised copy of each Seniority List shall be posted on the appropriate bulletin board and sent to the Union in January and July of each year.
(b) During the probationary period, the employee shall be entitled to all rights and benefits of this Agreement except as otherwise provided herein.
(c) It is expressly understood and agreed that, notwithstanding anything else contained in this agreement, the Employer shall have the right to discharge or discipline any probationary employee at any time prior to his having been placed on the Seniority List and such discharged or disciplined employee shall not have the right of recourse to the grievance procedure.
(d) Part-time employees shall accrue seniority on the basis of hours worked.
(e) Part-time employee means a bargaining unit employee who is regularly employed for not more than twenty- four (24) hours per week or a student employed during the school vacation period.
(f) It shall be the duty of the employee to notify the Employer promptly of any change in address. If an employee fails to do this, the Employer will not be responsible for failure of a notice sent by registered mail to reach such employee.
Maintenance Department. (a) Employees, other than probationary employees, shall accumulate sick leave credits at the rate of three-quarters (¾) of a day per month. Probationary employees shall, upon completion of the probationary period, be credited with one (1) days sick credit. Effective May 1, 1999 sick leave credits accrue on the basis of time worked.
(b) Pay for sick leave is for the sole and only purpose of protecting employees against loss of income when they are legitimately ill.
(c) Accumulated sick leave credits may be utilized from day one of the accident or illness until the number of days accumulated has been exhausted. Such available sick leave credits will be applied unless the employee advises the Department otherwise at the commencement of the sick leave.
(d) Employees will receive notification of their accumulated sick days in writing in January and July annually. There will be no carry over of sick day credits from year to year. At each year end or at seasonal layoff, whichever occurs first, there will be a pay out at the rate of fifty (50) percent for every unused sick day credit accrued in that calendar year. Such payments will be included on the last paycheque prior to layoff.
(e) In order to qualify for payment of sick credits, the employee must give prior notification to the Department Head or designate of any absence from work.
(f) Employees absent due to illness shall co-operate in keeping the Department Head informed of the progress of the employee's condition and estimated return to work date as requested by the Department Head including providing physician's certificates not more frequently than monthly for absences in excess of 30 calendar days.
(g) Existing accrued sick day credits, up to and including April 30, 1999, which will not be eligible for pay out, may be utilized for medically verifiable non- occupational illness or long-term disability defined as a disability in excess of one week. These accrued sick day credits may be used only as described in this clause of Article 43 and may be carried over until used.
Maintenance Department. (a) Every employee shall receive vacation pay as follows:
Maintenance Department. (a) The Employer will supply each employee with uniforms in each calendar year. A uniform consists of four (4) shirts and three (3) pairs of pants.
(b) If requested, the Employer will also supply each employee with three (3) coveralls for every calendar year. Employees who work the winter months (November 15 to March 15) and are required to work outdoors, if requested, will be supplied with one (1) set of insulated coveralls in place of the regular coverall.
(c) The Employer will supply one (1) windbreaker and one (1) rainsuit to each employee which will be replaced yearly if required, provided the old windbreaker or rainsuit is returned first.
(d) The clothing to be supplied under this Article 40 will be provided by April 1st of each year or whenever the employee is recalled from layoff, whichever date is later.
(e) The Employer will contribute eighty dollars ($80.00) per year towards the cost of safety footwear for each employee. This contribution will be paid within ten (10) days of provision of proof of purchase. All employees are required to wear safety footwear at all times.
Maintenance Department. A premium of two dollars and ninety cents ($2.90) per hour will be paid to the drivers who perform the duties of maintaining thoroughbred racing strips and begin their work shifts between 9:30 pm and 6:00 am.
Maintenance Department. The Employer and the Union agree the following days shall be recognized as holidays with pay: New Year’s Day, Good Friday, Victoria Day, Dominion Day, Labour Day, Thanksgiving Day, Christmas Day and Boxing Day. In order to qualify for holiday pay on the above mentioned holidays, an employee must meet the qualifying requirements set out in the Employment Standards Act.
