An employee who refuses the opportunity, or is not available, will be charged as if the employee had worked the assignment. Hours Not Extending from Normal Workday. In the event there is an opportunity in a given job title to work additional hours and the hours are not a continuation ofwork in progress”, the overtime work shall be assigned based on a seniority rotation basis, provided that, in an emergency situation, the Department Head, or designee, shall have discretion to assign overtime work out of the seniority rotation. An emergency situation shall include water main breaks, downed trees and electrical lines, street cave-ins, flooding conditions and other extraordinary events. For the purposes of this exclusion, snow removal shall not be considered an emergency situation. In an emergency situation, the assignment of overtime shall not be subject to the grievance procedure set forth in this collective bargaining agreement. In a non-emergency situation, the Department Head, for good cause, can assign overtime outside of the seniority rotation system because a particular job requires employees with special skills. The assignment of overtime in a non-emergency situation must be reasonable, and is subject to the grievance procedure set forth in this collective bargaining agreement. If an employee refuses overtime work, the employee shall be passed over on the rotation list, but will not skip a turn. The parties recognize that a reasonable amount of overtime is necessary to perform the jobs in the unit, that employees are expected to work a reasonable amount of overtime, and employees shall not unreasonably refuse overtime. The Employer shall have a right to implement rules governing the duty to accept overtime, including disciplinary action for an employee's refusal to work overtime.

Notwithstanding the above: if the assignment of additional hours would put a part-time employee into overtime premium pay, then the opportunity will be offered on a rotational basis to full-time employees who are regularly scheduled to work 36-hour shifts; however, if a sufficient number of 36-hour full-time employees do not volunteer, the opportunity will be offered to the part-time employees.

  • Returning to Work After a Period of Parental Leave (a) An employee will notify of their intention to return to work after a period of parental leave at least four weeks prior to the expiration of the leave.

  • Overtime-Eligible Unpaid Meal Periods ‌ The Employer and the Union agree to unpaid meal periods that vary from and supersede the unpaid meal period requirements of WAC 000-000-000. Unpaid meal periods for employees working more than five (5) consecutive hours, if entitled, will be a minimum of thirty (30) minutes and will be scheduled as close to the middle of the work shift as possible. Employees working three (3) or more hours longer than a normal workday will be allowed an additional thirty (30) minute unpaid meal period. When an employee’s unpaid meal period is interrupted by work duties, the employee will be allowed to resume their unpaid meal period following the interruption, if possible, to complete the unpaid meal period. In the event an employee is unable to complete the unpaid meal period due to operational necessity, the employee will be entitled to compensation, which will be computed based on the actual number of minutes worked within the unpaid meal period. Meal periods may not be used for late arrival or early departure from work and meal and rest periods will not be combined.

  • Leave of Absence for Full-Time Union or Public Duties An employee who is elected or selected for a full-time position with the Union or anybody with which the Union is affiliated, or who is elected to public office, shall be granted leave of absence without pay and without loss of seniority.

  • Rest Periods and Meal Breaks (a) All employees shall have two (2) fifteen (15) minute rest periods in each work period in excess of six (6) hours, one (1) rest period to be granted before and one (1) after the meal period, provided the staff to child ratio can be maintained. It is understood that meal breaks and rest periods may be combined subject to operational requirements.

  • Employees Not Eligible for Holiday Compensation 366. Persons employed for holiday work only, or persons employed on a part-time work schedule which is less than twenty (20) hours in a bi-weekly pay period, or persons employed on an intermittent part-time work schedule (not regularly scheduled), or persons employed on as-needed, seasonal or project basis for less than six (6) months continuous service, or persons on leave without pay status immediately preceding or immediately following the legal holiday shall not receive holiday pay.

Employees will be allowed rest periods of fifteen (15) minutes for each one-half (1/2) shift of four (4) or more hours worked at or near the middle of each one-half (1/2) shift of four (4) or more hours. Rest periods do not require relief from duty. Rest periods may not be used for late arrival or early departure from work and rest and meal periods will not be combined.

  • HOURS AND WORKING CONDITIONS Section 1.

  • Overtime or Callout Which Does Not Abut the Succeeding Shift (1) When overtime is worked there shall be an elapsed time of eight hours between the end of overtime and the time the employee reports for duty on the next regular shift, with no shortfall out of their regular shift.

  • SHORT-TERM ILLNESS AND INJURY AND LONG-TERM DISABILITY Employees shall be entitled to coverage for short term illness and injury and long term disability in accordance with agreed upon regulations which will be subject to review and revision during the period of this Agreement by negotiations between the Parties and included as Appendix A to this Agreement.
