Rest Periods and Meal Breaks. (a) All employees shall have two (2) fifteen (15) minute rest periods in each work period in excess of six (6) hours, one (1) rest period to be granted before and one (1) after the meal period, provided the staff to child ratio can be maintained. It is understood that meal breaks and rest periods may be combined subject to operational requirements.
(b) Employees working a shift of four (4) hours, but not more than six (6) hours, shall receive one (1) rest period during such a shift provided the staff to child ratio can be maintained.
(c) Rest periods shall be taken without loss of pay to the employee.
Rest Periods and Meal Breaks a) A rest period of 15 minutes without deduction of pay shall be allowed each morning at a time determined by the company. The rest period may be staggered to suit the operational requirements of the site.
b) Except in the case of shift work an employee shall be entitled to an unpaid meal break not exceeding 30 minutes duration on each day Monday to Friday inclusive the employee works.
c) Unless agreed otherwise between the company and employee, the meal break shall be taken no later than six hours after commencement of ordinary hours of work on any day Monday to Friday or in the case of weekend overtime no later than six hours after the commencement of work.
d) The company may stagger the meal break to meet operational requirements but may not, without first obtaining agreement of an employee, postpone the meal break beyond the normal scheduled commencement time. If the meal break is delayed by more than one hour, the employee shall be paid at overtime rates for all time worked after the one-hour delay until the break is taken.
e) Where an employee is rostered to work or works more than six hours on a Saturday, Sunday or public holiday, they shall be entitled to a rest period of 20 minutes in duration, which shall be paid at ordinary rates and be in lieu of any entitlement pursuant to Subclause 4.13 (k) hereof.

Breaks may not be combined or taken at the beginning or end of a shift. Rest Periods and Meal Breaks. Correctional Officers assigned to a twelve-hour workday schedule shall generally be entitled to three rest periods and a meal break. Rest periods and meal breaks will generally be fifteen minutes and forty minutes, respectively. Rest periods and meal breaks do not begin until the designated Relief Officer releases the Correctional Officer. Rest periods and meal breaks are County-paid time; during periods of heavy workload and/or abnormal staffing shortages, rest breaks may not be possible. (c) An employee shall be entitled to take their rest periods and meal breaks away from the worksite. Where the Employer determines that the meal period cannot be taken away from the worksite, the meal period shall be considered as time worked at straight-time, including the accrual of all benefits of the collective agreement.

All employees working shifts of more than five (5) to eight (8) hours are entitled to an unpaid meal break of thirty (30) minutes between the third (3rd) and fifth (5th) hour of work. Such meal breaks shall be on the employee’s time or as mutually agreed between the Manager and the employee. All employees are entitled to paid rest period in accordance to the following schedule in addition to their meal break:
(a) four (4) hours one (1) fifteen (15) minute rest period;
(b) five (5) hours one (1) fifteen (15) minute rest period;
(c) six (6) hours one (1) fifteen (15) minute rest period;
(d) seven (7) hours two (2) fifteen (15) minute rest periods;
(e) eight (8) hours two (2) fifteen (15) minute rest periods.

(b) All employees shall have two (2) fifteen (15) minute rest periods in each work period in excess of six (6) hours, one (1) rest period to be granted before and one (1) after the meal break. Employees working a shift of three and one-half (3.5) hours, but not more than six (6) hours, shall receive one (1) rest period during such a shift. Rest periods shall not begin until one (1) hour after the commencement of work or not later than one (1) hour before either the meal break or the end of the shift. Rest periods shall be taken without loss of regular pay to the employee.
(c) For employees working on ten (10) hour vessels, rest periods may be taken two (2) hours after commencing a shift and at subsequent two (2) hour intervals during the work day.

2. The rest period will be scheduled by their supervisor as near the midpoint of their work period as practicable.
3. Rest periods may not be scheduled so as to extend the meal break or alter the employee’s scheduled start or end time.
4. No wage deduction shall be made for such rest periods.
B. Meal Breaks
1. Employees assigned five (5) hours or more shall receive an unpaid meal break of not less than thirty (30) minutes per day.
2. The meal break shall be scheduled by the supervisor as near the midpoint of their work period as practicable.
