INCLEMENT WEATHER PRACTICE. 17.1 Regular or probationary employees who are unable to work in the field because of inclement weather or other similar causes will receive pay for the full day, provided they have reported for duty. During such day they may be held pending emergency calls, may be given first aid, safety or other instruction, or they may be assigned to perform miscellaneous duties in sheltered locations. 17.2 Temporary employees who are unable to work in the field because of inclement weather or other similar causes will be paid only for the time they work or are held by the Agency, except however, that they will be paid for not less than two (2) hours. 17.3 Agency supervisors will be responsible for determining whether weather conditions warrant cessation of outside work. In arriving at a decision with respect to weather conditions, the Supervisor shall taken into account such factors as: (a) Employee health and safety. (b) Undue hazards. (c) Operating requirements. (d) Service to the public. (e) Job site working conditions. (f) Anticipated duration of time required to leave unfinished job in a safe condition. (g) Anticipated duration of inclement weather. (h) Distance from job site to operating headquarters. 17.4 If employees are required to work during inclement weather, Agency shall provide rain gear for such work.

INCLEMENT WEATHER PRACTICE. 22.1 Regular and probationary Employees who are unable to work in the field because of inclement weather shall receive pay for the full day, provided they have reported for such duty. However, they may be held pending emergency calls and may be given first aid, safety or other instructions required to perform work assigned by supervisor which can be reasonably performed under existing weather conditions, in line with criteria set forth in 22.2 below. 22.2 The Employer’s authorized representative in charge of the crew shall be responsible for determining whether weather conditions warrant cessation of outside work. In arriving at a decision with respect to weather conditions, the Superintendent and Xxxxxxx shall take into account such factors as, but not limited to: Employee’s safety, operating requirements, undue hazards, service to the members, job site working conditions, anticipated duration of time required to leave unfinished job in a safe condition, anticipated duration of inclement weather, distance from job site to operating headquarters, or any other pertinent factors which, in their opinion, should be taken into account in reaching a decision relative to stopping or continuing work.

However, they may be held pending emergency calls, and may be given first aid, safety or other instructions, or they may be required to perform miscellaneous work in the warehouses or other sheltered locations. Temporary employees under the same conditions shall receive pay for time they worked or are held on Company property or ordered to stand-by. They shall not be paid in any event for less than four (4) hours.

INCLEMENT WEATHER PRACTICE. 4.1 Employees who report for work on a workday or for prearranged work on a non-workday and are unable to work in the field because of inclement weather or other similar causes, shall be paid for actual time worked, if any, but not less than two (2) hours at the appropriate rate of pay. Employees receiving subsistence as provided for in Section 5.2 shall continue to receive such subsistence in addition to the amount provided for under this section. (a) The determination for not working on an inclement day shall not be at the discretion of a recipient of inclement pay. The employees shall work on such days, unless specifically notified otherwise by Company supervision. 4.2 Time lost due to inclement weather, equipment breakdown or other excused absences may, at the discretion of the Employer, be made up on Friday or Saturday, not to exceed ten (10) hours at the straight time rate of pay. If the employee has a conflict, the Company will consider reasonable requests for the employee to be excused from make up time. If the Supervisor decides to relieve the employee because of inclement weather, the employee will be allowed to use accrued vacation to compensate for lost time.
