Involuntary Assignments. An employee involuntarily assigned for one year or less to a position outside the scope of the employee's certification shall not be required to obtain additional training related to the assigned position nor shall evaluation reflect the absence of such training.
Involuntary Assignments. (1) In the event that the Executive shall be divested of title to his shares of capital stock by involuntary sale, assignment or transfer, (as, for example, but without limiting the generality thereof, by sale under levy of attachment or execution, or sale in connection with bankruptcy or other court process) or transfer to a spouse in satisfaction of marital rights in connection with a separation or divorce, the person, firm or corporation acquiring such stock (hereinafter called the “Judicial Assignee"), shall take and hold such shares of capital stock subject to all the restrictions, obligations and disabilities as was the Executive.
(2) Within thirty (30) days after such stock is transferred to the Judicial Assignee on the books of the Company, if such transfer be deemed proper by the Company, the Company may (but shall not be obligated to), by written notice given to the Judicial Assignee, elect to purchase from the Judicial Assignee the stock so acquired by him or her for:
(i) The same amount as the Judicial Assignee shall have paid for such stock, or
(ii) The book value of each share as determined in accordance with this Agreement, whichever amount is smaller, i.e., either the amount paid or book value. If the Company elects to purchase such stock from the Judicial Assignee, the Company may pay for such stock in ten (10) annual installments, the first of which shall be due and payable within thirty (30) days after the Company gives notice to the Judicial Assignee, as aforesaid. The Judicial Assignee, upon the making of the first payment by the Company, shall simultaneously therewith deliver his shares of stock to the Company’s attorney who shall thereupon certify, in writing, that he is holding said stock in escrow pending the full payment of the purchase price. The Judicial Assignee shall have no voice in the management of the Company at any time after the payment of the first installment.
Involuntary Assignments. Involuntary assignments shall be avoided whenever reasonably possible and made only for good reason.
Involuntary Assignments a. The Company may require a Flight Attendant to work on Scheduled Day(s) Off. A Flight Attendant who is involuntarily assigned to work shall be compensated in accordance with Section 3 (Compensation).
b. The following involuntary assignment procedures shall apply:
i. The Company may hold over a Flight Attendant on her/his Scheduled Day(s) Off following a duty day.
ii. If no holdover Flight Attendant is available, the Company may involuntarily assign a Flight Attendant. Selection of the Flight Attendant for duty on her/his Scheduled Day(s) Off shall be based on legality, economics and operational efficiency. Where all other factors are equal selection shall be in inverse order of seniority.

(2) Within thirty (30) days after such stock is transferred to the Judicial Assignee on the books of the Company, if such transfer be deemed proper by the Company, the Company may (but shall not be obligated to), by written notice given to the Judicial Assignee, elect to purchase from the Judicial Assignee the subject stock for the same amount as the Judicial Assignee paid for the stock, or an otherwise mutually agreed upon price.
Involuntary Assignments. Should it be necessary for the chief (or designee) to order an employee to cover a shift or special event, the least senior employee in the appropriate unit will be assigned to that shift. The chief (or designee) shall then select the next least senior employee for each subsequent involuntary assignment.
Involuntary Assignments. 1. The parties recognize that under certain circumstances it may be necessary for the Board to involuntarily assign a teacher to a position.
2. When it becomes necessary to make an involuntary assignment, the affected teacher(s) and the Association shall be given reasonable notice, to the extent possible, specifying the reason for the action, the duration of the assignment, and the specific position to which the teacher will be transferred.
3. A non-teaching professional staff employee who has been involuntarily transferred from his/her position, shall have the first right to return to his/her position should the appropriate vacancy occur, provided that he/she is appropriately credentialed. This "right to home" becomes void if the non-teaching professional staff employee rejects this opportunity to return to his/her position.
Involuntary Assignments. A Teacher involuntarily reassigned shall be notified as promptly as circumstances permit and afforded an opportunity to discuss such assignment with the Superintendent. Any Teacher involuntarily reassigned shall receive prompt consideration in any requested assignment to future vacancies. Such Teacher may resign his/her position. The resignation shall be accepted by the Board, providing the resignation is in accordance with state law and a suitable replacement is available. KENILWORTH SCHOOL DISTRICT NO. 38
Involuntary Assignments. A Teacher involuntarily reassigned shall be notified as promptly as circumstances permit and afforded an opportunity to discuss such assignment with the Superintendent. Teachers may be reassigned to new subject areas or grade levels after the first day of the school year only after conferring with the Teacher and the ASSOCIATION. Except in cases of emergency Teachers will have a minimum of five (5) days to prepare. Any Teacher involuntarily reassigned shall receive prompt consideration of future vacancies in which they have previously requested assignment in writing within the prior twelve months. Such Teacher may resign their position. The resignation shall be accepted by the Board, providing the resignation is in accordance with state law and a suitable replacement is available. Teachers are not required to accept assignments to positions they are not legally licensed to hold unless the Teacher agrees to become provisionally licensed to hold the position.
Involuntary Assignments. An employee who has been assigned involuntarily to a teaching assignment outside of such employee's certification or majors and minors may be observed but shall not be formally evaluated in the performance of such assignment.
