Leaves of Absence General Leave. Upon one (1) month’s notice, employees may request a leave of absence without pay for up to one (1) year. The employee will indicate the length of the request. The Employer is limited to only operational considerations when deciding whether or not to grant such leave. Leaves of absence shall not be unreasonably withheld. Notwithstanding the above, at least one employee at a time shall be entitled to be off on a General Leave in each store. If such a leave is granted, the employee must disclose to the Employer any new employment relationship for the purpose of determining if a conflict of interest arises.

Leaves of Absence General Leave. 42. To the extent any leave of absence is granted under this section, all such leaves of absence (and any extensions thereof) must be applied for and granted or denied, in writing, on forms to be provided by the City. An employee may, upon request, return to work prior to the expiration of any leave of absence if such early return is agreed to by the City. When an employee returns to work after a leave of absence, he will be assigned to the position which he formerly occupied or to a similar position if his former position is not vacant or no longer exists. If the job to which he is assigned pays a higher rate of pay, he shall receive this rate under Article LI Wages.
