Legal Proceedings Leave. 3-1 Teachers shall be granted leave time necessary to make appearances in any legal proceedings connected with the teacher’s employment. The teacher shall be required to present the subpoena or summons to verify the teacher’s need for absence.
Legal Proceedings Leave. A teacher of the Bargaining Unit shall be granted on a day-to-day basis an absence, with pay, for any court appearances and legal proceedings to which he/she is summoned. The provisions of this item exclude any legal action initiated by the teacher or any action resulting from a criminal charge filed against the teacher. The District shall grant a teacher leave for jury service or as a witness subpoenaed in a criminal, civil or juvenile proceeding and shall pay the teacher during such service the full, current contract salary. If a teacher is required to attend legal proceedings related to his/her role as a BPS employee outside of the contractual work day/hours the district will consider compensation on a case-by-case basis to be approved or denied by the Superintendent. All documentation requested must be submitted along with the request including but not limited to a copy of the summons received requiring his/her court appearance as well as a copy of any check(s) received in order to allow the district to accurately account for the court service.
Legal Proceedings Leave. 10.11.1 Employees called for jury duty, or subpoenaed to appear in court, in any case other than one in which the employee is a litigant, shall be granted a leave of absence with pay. During this period, the employee shall be paid the amount of the difference between his/her earnings and the amount received as a jury fee. A statement of the amount paid the employee as a jury fee shall be submitted as a basis for determining the District's financial responsibility.
10.11.2 Not more than two percent (2%) of the staff shall be granted such leave with pay at any one time.
10.11.3 As soon as the unit member is called for jury duty he/she shall report it to his/her immediate supervisor. Upon direction of the supervisor, the unit member shall seek a postponement of jury duty to a time most convenient to the District. The request for postponement shall not be made solely for the purpose of rescheduling jury duty to a non-duty day.
10.11.3.1 Unit members shall be credited up to two (2) sick days as an incentive to postpone jury duty to summer months. One (1) sick day shall be earned for each day of jury service up to the maximum of two (2) sick days provided for in this Article. Unit members shall have the option to be paid the regular sub rate in lieu of being credited a sick day. Evidence of postponement and completion must be submitted to the payroll department for verification.

The District shall grant a Member leave for jury service or as a witness subpoenaed in a criminal, civil or juvenile proceeding and shall pay the Member during such service the full, current contract salary. If a member is required to attend legal proceedings related to his/her role as an MPS employee outside of the contractual work day/hours the district will consider compensation on a case-by-case basis to be approved or denied by the Assistant Superintendent/Personnel. All documentation requested must be submitted along with the request.
Legal Proceedings Leave. 15.6.1 A leave of absence without loss of salary and benefits shall be granted:
a) for jury duty or any summons related thereto, or
b) to answer a subpoena or summons to attend as a witness in any proceeding authorized by law to compel the attendance of witness.
15.6.2 The teacher shall remit any witness fee or jury stipend (excluding allowances and/or expenses) set by the Court or other body.

Legal Proceedings Leave. The necessary time will be granted for appearances in any legal proceeding connected with the teacher’s employment or with the school system on behalf of the School Committee.
Legal Proceedings Leave. 11.12.1 A unit member shall be entitled to as many days of leave as are necessary for appearances in legal proceeding(s) including: litigation where the unit member is a subpoenaed witness (and not the subpoenaing party); litigation where the unit member is a respondent to charges applying to duties performed within the scope of his/her employment in the District; and/or litigation where the unit member is a respondent with the District. The leave shall be paid if taken while in paid status.
11.12.2 Any fees, honorarium or cost (other than mileage) paid to the unit member as a result of legal proceedings leave must be remitted to the District.

The leave shall be paid if taken while in paid status. If the unit member is required to appear in legal proceeding(s) during school recess periods, she or he shall be paid at the hourly rate established in Article 7.
Legal Proceedings Leave. 1. Time necessary for appearance in any legal proceeding when the School Unit requires the employee to appear shall be provided without loss of pay.
2. Time necessary for jury duty shall be provided. The employee shall be paid the full rate of pay, less the amount paid for jury duty. Employees shall suffer no interruption of pay because of jury duty.
