MANDATORY REST PERIOD. Unless an employee agrees otherwise, employees will not be required to work more than sixteen (16) hours in a twenty-four (24) hour period without being allowed an eight (8) hour rest period. Should an employee reasonably believe that he or she can work more than sixteen (16) hours in a twenty-four (24) hour period, he or she will be permitted to do so. The Employer may require an employee to work more than sixteen (16) hours in a twenty-four (24) hour period only in the case of emergency or natural disaster. If an employee is required to work more than sixteen (16) hours in a twenty-four (24) period because of emergency or natural disaster, the employee shall be allowed an eight (8) hour rest period at the end of the work period.

MANDATORY REST PERIOD. To minimize the safety concerns that may result from employees working extended shifts, the District agrees to provide a paid mandatory rest period of four and one-half (4.5) hours to employees who work eight (8) hours or more of overtime, or at the supervisor’s discretion. Any rest period, deemed as mandatory, shall be compensated at the employee’s regular hourly rate for up to four and one-half (4.5) hours. Any time taken for a rest period in excess of four and one-half (4.5) hours shall, at the employee’s discretion, be deducted from the employee’s accumulated vacation, holiday, or compensatory time or taken without pay or taken without pay.

It is understood and agreed to by the Parties that this provision is inapplicable in the event of emergency or other similar unanticipated or unavoidable conditions. In the event an employee notifies management that he believes working in excess of sixteen (16) hours in a twenty four (24) hour period will present an imminent threat to the health or safety of the employee or another, the employee must seek permission to be relieved of duty without discipline; such permission will not be unreasonably denied.
MANDATORY REST PERIOD. An employee who has worked more than 16 consecutive hours, or more than eight hours overtime in a 16-hour period immediately preceding their workday shall, upon release, be provided a rest period before they return to work, contingent on operational needs. If a rest period extends into a basic workday, the employee will not be required to use accrued time to offset that rest. The Director of Public Works, at their discretion, may elect to hold over employees for longer than 16 hours if emergent events necessitated staffing. Likewise, the Director may release the employee after 16 hours if they feel the employee is not able to safely perform their duties. Time worked in excess of 16 consecutive hours shall be paid at double the employee’s hourly rate. The Director also reserves the right to shift employee start times should a continued, emergent event required around-the- clock coverage over a prolonged period. Rest hours will still be in effect under this circumstance.
MANDATORY REST PERIOD. Public Works employees are not required to work more than sixteen (16) hours straight without having at least a minimum of eight (8) hours rest. The only exception to this rule is in an emergency. An emergency is described as snow and ice removal and control, water main breaks, and any other situation that adversely impacts the health, safety and welfare of the general public. An employee may be permitted to work beyond a sixteen (16) hour period as previously described with superintendent permission if in the superintendent’s reasonable opinion the employee is mentally alert and shows no visible signs of exhaustion or fatigue.
