Procurement Agent. Unless MCC agrees otherwise in writing, the Government will engage one or more procurement agents (collectively, the “Procurement Agent”) to carry out and certify specified procurement activities in furtherance of this Compact. The roles and responsibilities of the Procurement Agent will be set forth in the Program Implementation Agreement or such agreement as the Government enters into with the Procurement Agent, which agreement will be in form and substance satisfactory to MCC. The Procurement Agent will adhere to the procurement standards set forth in the MCC Program Procurement Guidelines and ensure procurements are consistent with the procurement plan adopted by the Government pursuant to the Program Implementation Agreement, unless MCC agrees otherwise in writing. This Annex II summarizes the Multi-Year Financial Plan for the Program.
Procurement Agent. The employee of APS authorized to act on behalf of the Owner in this Contract. The Procurement Agent may designate in writing others to act on his behalf, and such designation shall state any limitations on the authority of such designee. Contractor shall not rely upon and Owner shall not be bound by any statement or representation made on behalf of APS by any person not designated to the Contractor in writing as authorized to so act on behalf of the Procurement Agent. It shall be the responsibility of the Bidder, and thereafter the Contractor, to establish the authority to act regarding any communication or action by any person other than the Procurement Agent. Use of the term Procurement Agent in the Contract Documents shall be deemed to include such properly authorized designee within the scope of that designee’s authorization.
Procurement Agent. Unless MCC otherwise agrees in writing, the Government, directly or through MCA-Philippines, will engage one or more procurement agents (each, a “Procurement Agent”) to carry out and certify specified procurement activities in furtherance of this Compact. The roles and responsibilities of each Procurement Agent will be set forth in the Program Implementation Agreement or such agreement as the Government, directly or through MCA-Philippines, enters into with each Procurement Agent, which agreement will be in form and substance satisfactory to MCC. Each Procurement Agent will adhere to the procurement standards set forth in the MCC Program Procurement Guidelines and ensure procurements are consistent with the procurement plan adopted by MCA-Philippines pursuant to the Program Implementation Agreement, unless MCC otherwise agrees in writing. This Xxxxx XX summarizes the multi-year financial plan for the Program.
Procurement Agent. If requested by MCC, the Government shall ensure that MCA-Georgia engages one or more procurement agents (each, a “Procurement Agent”) to carry out and/or certify specified procurement activities in furtherance of this Compact on behalf of the Government, MCA-Georgia, any Outside Project Manager or Implementing Entity. The role and responsibilities of such Procurement Agent and the criteria for selection of a Procurement Agent shall be as set forth in the applicable Implementation Letter or Supplemental Agreement. The Government shall ensure that MCA-Georgia enters into an agreement with the Procurement Agent, in form and substance satisfactory to MCC, that sets forth the roles and responsibilities of the Procurement Agent with respect to the conduct, monitoring and review of procurements and other appropriate terms and conditions, such as payment of the Procurement Agent (the “Procurement Agent Agreement”). Any Procurement Agent shall adhere to the procurement standards set forth in the Procurement Agreement and Procurement Guidelines and ensure procurements are consistent with the procurement plan (the “Procurement Plan”) adopted by MCA-Georgia, which plan shall forecast the upcoming six month procurement activities and be updated every six months.
Procurement Agent. MCA-Benin II has engaged a Procurement Agent to carry out and/or certify specified procurement activities in furtherance of the Compact and this Agreement. MCA-Benin II has entered into an agreement with the Procurement Agent dated as of September 1, 2015, in form and substance satisfactory to MCC, that sets forth the roles and responsibilities of the Procurement Agent with respect to the conduct, monitoring and review of procurements and other appropriate terms and conditions (such agreement, and any subsequent agreement with a Procurement Agent as may be entered into by MCA-Benin II, the “Procurement Agent Agreement”). Unless MCC agrees otherwise in writing, the Procurement Agent will be a third party, independent of the Government. Publicity and Transparency.
(a) Subject to Section 2.12, MCA-Benin II will give appropriate publicity to the Compact as a program to which the United States, through MCC, has contributed, including by identifying Program Activity sites, and marking Program Assets, all in accordance with MCC’s Standards for Global Marking. Upon the termination or expiration of the Compact, the Government, upon MCC’s request, will cause the removal of any such references and markings on the MCA-Benin II Website or in any Government or MCA-Benin II publicity materials.
(b) MCA-Benin II will make information concerning implementation of the Compact publicly available, including by posting the following documents in English and French (unless MCC agrees otherwise in writing), on the website operated by MCA-Benin II (the “MCA-Benin II Website”), all to the extent contemplated by and in accordance with the Governance Guidelines:
(i) Compact, (ii) this Agreement, (iii) minutes of the meetings of the Board, and minutes of the meetings of the Stakeholders Committees as they relate to MCA-Benin II; (iv) the M&E Plan, along with periodic reports and final evaluations on Program performance; (v) all environmental and social impact assessments and resettlement action plans for the Projects and supporting documents; (vi) all social and gender assessments and the Social and Gender Integration Plan; (vii) all audit reports by an Auditor and any periodic reports or evaluations by a Reviewer; (viii) all Disbursement Requests; (ix) all reports required to be submitted to MCC under the terms of this Agreement (including the reports required under Section 2.8(a)); (x) all procurement policies and procedures (including standard bidding documents, procurement plans...
Procurement Agent. If requested by MCC, the Government shall ensure that MCA-Vanuatu engages one or more procurement agents (each, a “Procurement Agent”) to carry out and/or certify specified procurement activities in furtherance of this Compact on behalf of the Government, MCA-Vanuatu, the Project Manager or Implementing Entity. The role and responsibilities of such Procurement Agent and the criteria for selection of a Procurement Agent shall be as set forth in the applicable Implementation Letter or Supplemental Agreement. The Government shall ensure that MCA-Vanuatu enters into an agreement with the Procurement Agent, in form and substance satisfactory to MCC, that sets forth the roles and responsibilities of the Procurement Agent with respect to the conduct, monitoring and review of procurements and other appropriate terms and conditions, such as payment of the Procurement Agent (the “Procurement Agent Agreement”). Any Procurement Agent shall adhere to the procurement standards set forth in the Procurement Agreement and Procurement Guidelines and ensure procurements are consistent with the procurement plan adopted by MCA-Vanuatu pursuant to the Procurement Agreement (the “Procurement Plan”).
Procurement Agent. The Procurement Agent has been engaged and the Accountable Entity has delivered to MCC a copy of the related Procurement Agent Agreement.
Procurement Agent. Except as MCC otherwise agrees, any reference in this Agreement to the “Procurement Agent” shall be deemed a reference to (i) any interim service provider approved by MCC to provide procurement agent services to MMD until such time as MMD delivers to MCC a true and complete copy of a duly-executed procurement agent agreement or other instrument in form and substance satisfactory to MCC (the “Procurement Agent Agreement”), and the party named as procurement agent therein has mobilized or (ii) thereafter, the Service Provider named in the Procurement Agent Agreement. For the avoidance of doubt, MCC in its sole discretion may permit the Procurement Agent to be a procurement management unit within a Permitted Designee until such time as MCA-Malawi is created, and thereafter within MCA-Malawi.
Procurement Agent. Customer hereby notifies NT that Customer’s Procurement Agent is authorized to place Order Forms, receive invoices and make payments to NT on Customer’s behalf. NT is entitled to rely and act upon any Order Form submitted by the Procurement Agent and Customer shall remain liable for any invoices that remain unpaid by its Procurement Agent or which are paid late. If any refunds are required to be provided to Customer under this Agreement, NT will refund amounts paid by the Procurement Agent to the Procurement Agent, and the Procurement Agent will be responsible for refunding the corresponding amount to Customer. Customer acknowledges and agrees that it is granted permission to use its Procurement Agent under this Agreement solely as a matter of convenience in connection with Customer’s order management process. NT shall have no liability or obligation to the Procurement Agent and the Procurement Agent obtains no rights under or in connection with this Agreement, including, without limitation, any license or other right to use the Software.
Procurement Agent. MCA-Indonesia will engage a Procurement Agent to carry out and/or certify specified procurement activities in furtherance of the Compact and this Agreement. MCA-Indonesia will enter into an agreement with the Procurement Agent, in form and substance satisfactory to MCC, that sets forth the roles and responsibilities of the Procurement Agent with respect to the conduct, monitoring and review of procurements and other appropriate terms and conditions (the “Procurement Agent Agreement”). Unless MCC agrees otherwise in writing, the Procurement Agent will be a third party, independent of the Government.
