As part of the Proposal, the Developer submitted a conceptual site plan for the Project, including elevations and renderings of the proposed look of the development (collectively, the “Project Concept”). Developer has stated its intention to construct the Project substantially as presented in the Project Concept and the renderings attached as Exhibit “D.” 2. The Agency has reviewed the Project Concept and by approving and executing this Agreement does approve the Project Concept. (a) If after the Effective Date Developer desires to make any material changes in the Project Concept, Developer shall submit such proposed changes to the Agency for its review and approval or rejection. Within thirty (30) calendar days after receipt of said proposed changes, the Agency shall either approve the proposed changes or notify Developer in writing that such changes are not approved and shall state the specific reasons(s)

Parking with the minimum spaces described below will be provided. As may be necessary, retail/commercial parking to be managed by a professional parking company. 3. The Hotel Component will comprise of an Upscale or higher quality boutique hotel as defined by the August 2022 Xxxxx Travel Research Hotel Classification list, with a minimum of 60 and a maximum of 80 rooms, located on the NW corner of the property lot at Xxxxxx and Acacia. The hotel will have a lobby with restaurant, which shall not be a fast-food chain, providing a full assortment of food and drinks which is normal and customary of a restaurant and bar services, a pool, and a roof-top bar with views of the San Xxxxxxx Mountains and the Metro.
