Protection of Persons, Work and Property. A. The risk of loss or damage to the Work prior to full completion of all Work hereunder and final acceptance thereof by Con Edison shall be borne by Contractor. B. In the course of performing the Contract, Contractor shall at all times exercise every reasonable precaution to protect persons and property and items of Work. Contractor shall at its own expense design, furnish, and erect such barricades, fences and railings, give such warnings, display such lights, signals and signs, exercise such precautions against fire, adopt and enforce such rules and regulations, and take such other precautions as may be necessary, desirable or proper, or as may be directed by Con Edison. Contractor shall provide and maintain in good working order at all times an adequate, approved system for promptly extinguishing fires. Fire alarms, extinguishing equipment and water lines shall be continually inspected by Contractor and shall at all times be accessible and ready for immediate use. C. Contractor shall, while on or about the site of Work, observe and comply with all fire, safety, hazard, "No Smoking", and all other rules and regulations heretofore or hereafter prescribed by Con Xxxxxx. Safety hats shall be worn at all times in the Work area by Contractor's employees. Whenever the Contractor or any permitted subcontractor performs Work hereunder, its employees and consultants are required to have available for review by Con Edison a Contractor (or a subcontractor) or government-issued name and photo identification. D. Contractor shall, at no additional cost to Con Edison, comply with all reasonable requests of Con Edison to enclose or specially protect Work, property or persons. If Con Edison determines that Work, property or persons are not adequately protected after any such requests, then it may, without prejudice to any other rights it may have hereunder or under applicable law, order an immediate suspension of the Work or take such steps as it deems necessary to protect Work, property or persons. The cost of such steps shall be charged to Contractor and may be deducted from any payments due Contractor, and Contractor shall not be entitled to be compensated for any costs of its own arising from such suspension. E. Contractor shall promptly report in writing to Con Edison all accidents whatsoever arising out of or in connection with the performance of the Contract, whether on or adjacent to the construction site, which result in death, injury or property damage, giving...

Protection of Persons, Work and Property. In the course of performing the Agreement, Developer shall, or shall cause the Subcontractors to, at all times exercise reasonable precautions to protect persons and property and items of Work from physical injury or harm. Developer shall or shall cause the Subcontractors to, at its/their own expense design, furnish, and erect such barricades, fences and railings, give such warnings, display such lights, signals and signs, exercise such precautions against fire, adopt and enforce such rules and regulations, and take such other precautions as may be necessary, desirable or proper, or as may be reasonably directed by CTO. Developer shall, or shall cause the Subcontractors to, provide and maintain in good working order at all times an adequate, approved system for promptly extinguishing fires. Protection of Persons, Work and Property. 2.2.6.1 Design/Builder shall have overall responsibility for safety precautions and programs in the performance of the Work. Design/Builder shall designate an individual at the Site in the employ of Design/Builder who shall act as Design/Builder’s designated safety representative with a duty to prevent accidents and to make daily inspections of the Site. Unless otherwise identified by Design/Builder in writing, the designated safety representative shall be Design/Builder’s Project superintendent. Design/Builder shall immediately notify Owner of accidents and injuries occurring at the Site. When Design/Builder is required to file an accident report with a public authority, Design/Builder shall furnish a copy of the report to Owner. 2.2.6.2 During the course of performing Work on the Project, Design/Builder shall keep all required building exits free and unimpeded. Such exits shall not be closed at any time for any reason while the building is occupied or at any time when the building is unoccupied, except after written approval is given by Owner and proper warning and directional signs are posted. Barricades shall be erected so that traffic is separated and protected from the Work. 2.2.6.3 Design/Builder shall take all necessary precautions to ensure the safety of all of its employees, Subcontractors and other persons on the Project or who may be affected by the Work thereon. Design/Builder shall also take all necessary precautions to protect the Work and all materials and equipment incorporated therein or to be incorporated therein from damage or destruction, whether in storage on or off the Project Site and whether in the custody or control of Design/Builder or any of its Subcontractors. Design/Builder shall also take all necessary precautions to protect all property at the Project Site and adjacent thereto not designated for removal, relocation or replacement, including trees, shrubs, lawns, walks, pavements, roadways, structures, and utilities. 2.2.6.4 Design/Builder shall comply with all applicable provisions of the Occupational Safety and Health Administration (OSHA) and all laws, ordinances, rules, regulations and orders of all governmental agencies or authorities having jurisdiction to protect the safety of employees and/or other persons who may be affected by the Work.   • PROTECTION OF WORK AND PROPERTY Contractor shall erect and properly maintain at all times, as required by conditions and progress of the Work, all necessary safeguards, signs, barriers, lights, and security persons for protection of workers and the public, and shall post danger signs warning against hazards created by the Work. In an emergency affecting life and safety of life or of Work or of adjoining property, Contractor, without special instruction or authorization from District, is permitted to act at his discretion to prevent such threatened loss or injury.

  • Protection of Personal Information Party agrees to comply with all applicable state and federal statutes to assure protection and security of personal information, or of any personally identifiable information (PII), including the Security Breach Notice Act, 9 V.S.A. § 2435, the Social Security Number Protection Act, 9 V.S.A. § 2440, the Document Safe Destruction Act, 9 V.S.A. § 2445 and 45 CFR 155.260.
