RE-EMPLOYMENT OF RETIRED TEACHERS. A. On occasion, the Board may find it desirable to employ a retired teacher. A retired teacher is any teacher already receiving a retirement benefit from any retirement system, in-state or out-of-state. The Board reserves the right to offer or not to offer such employment selectively, based on the needs of the district and the qualifications of the candidate, and no reason will be given for declining to offer such employment to anyone pursuant to this provision. The following procedure shall govern such employment of such retired teachers (hereafter “Retirees”): 1. Except as expressly modified herein, Retirees shall be members of the bargaining unit represented by the ALEA and shall be entitled to all terms, conditions, rights and benefits of the collective bargaining Agreement between the Association and the Board. 2. A Retiree shall be placed at Step 0 on the teachers’ salary schedule and at his/her education column of the teachers’ salary schedule. 3. The District will provide health insurance coverage for the Retiree only if STRS rules so require. 4. Retirees shall not be eligible to receive severance pay or any retirement incentive upon leaving the district. 5. For purposes of sick leave, retirees shall be considered a beginning employee and start with 0 says of sick leave accumulation. 6. Retirees shall be provided one-year limited regular teaching contracts that are automatically non-renewed each year without any action by the Board and without any evaluations or notice to the teacher/Retiree. Failure to evaluate or to follow negotiated or statutory procedures and failure to provide statutory notice of nonrenewal shall not be a basis for automatic reemployment of a Retiree. The employment relationship shall end upon the expiration of the contract in the same manner as a supplemental contract. Retirees shall not be eligible for a continuing contract, regardless of their years of service or license held. Retirees have no rights or seniority if a reduction in force occurs. 7. The parties agree that the provisions of this Article and any Retiree’s salary and nonrenewal of his/her individual contract will not be grieveable under the grievance procedures of this contract, nor through any claim or action filed before the State Employment Relations Board (SERB) or any court of law. 8. RE-EMPLOYMENT OF RETIRED TEACHERS. I. A teacher may elect to apply for a one year contract immediately following retirement under the State Teachers’ Retirement System provided: A. Such retirement follows the last scheduled work day of the school year. The teacher must complete the school year. B. The teacher who returns to duty begins on the first scheduled work day of the next school year. C. No accumulated sick leave shall be carried forward when the teacher returns to duty. II. A teacher returning to duty shall start at Step 10 of the salary schedule and remain at Step 10 except that the teacher shall receive any percent increases that might apply to that step. III. Teachers who are hired by the Board after retiring from another school system shall be placed at Step 8 during the entire term of their employment at Bellbrook-Sugarcreek. IV. Retired teachers who return to duty are nevertheless subject to a reduction in force and for purposes of a reduction in force their seniority shall date from their return to duty after retirement. V. All contracts issued to teachers who have retired under the State Teachers’ Retirement System shall automatically expire at the end of the term stated and no affirmative action required under RC 3319.11 or 3319.111, such as “non-renewal” and notice thereof, need to be taken by the Board or the Administration. VI. A Bellbrook-Sugarcreek teacher wishing to be rehired following retirement shall notify the Superintendent in writing by March 1 of the year of retirement. VII. A retired Teaching Staff Member who is rehired will begin employment with one (1) day of accumulated sick leave, and will accrue and accumulate sick leave in accordance with the provision of Article 8.01. VIII. Except to the extent addressed in this Article all provisions of the Agreement apply to retired Teaching Staff Members who are rehired including retirement contributions, insurance, personal leave and all other fringe benefits. 7. 00 INSURANCE

RE-EMPLOYMENT OF RETIRED TEACHERS retired from the teaching profession and/or a public sector retirement system ("Re-employed Teacher") may be re-employed under the following conditions:
RE-EMPLOYMENT OF RETIRED TEACHERS. 37.01 Scope of Article - This article governs the terms and conditions of employment of any retired teacher who is reemployed in a position that falls within the description of the bargaining unit appearing in Article 1 of this agreement. Any such employee will become a bargaining unit member. This article in no way obligates the Board to re-employ a retired teacher, nor does it create any expectancy or implication that a retired teacher will be offered reemployment.

RE-EMPLOYMENT OF RETIRED TEACHERS. A teacher retired under Ohio STRS, or any other retirement system (re-employed teacher) may be reemployed under the following conditions: A. The determination to recommend re-employment of any individual will be at the sole discretion of the Superintendent, and such determination will not be subject to the Grievance process of the Collective Bargaining agreement. B. Any contract for re-employment shall be for a duration of one (1) school year. The Superintendent may, at his sole discretion, recommend the re-employment of another employment contract. C. Re-employed teachers will be evaluated annually. D. The re-employed teacher will not resume and is not eligible for continuing contract status during any period of the re-employment with the district. E. The re-employed teacher will start with salary placement experience of zero (0) years and at the applicable level of education credit. The re-employed teacher will be advanced one (1) year on salary schedule above step zero (0) for each of the years of continuous re- employment service in the district. This provision and such salary and individual contract with a re-employed teacher supersedes ORC Section §3317.13 and all applicable laws. F. The re-employed teacher will be eligible for Board paid health/medical/life and other insurances offered by the Board. There will be NO lapse of current individual insurances. X. Xx-xxxxxxxx teachers will be subject to RIF prior to any non-retired teacher. H. Re-employed teachers will commence their employment with zero (0) days of accumulated sick leave and will earn one and one-quarter (1 1/4) days of sick leave per month. The district may advance a re-employed teacher up to five (5) days of sick leave, but he/she may NOT participate in the Sick Leave Donation Program. I. Re-employed teachers are not eligible to participate in any retirement incentive program, nor are they eligible for severance pay. J. Re-employed teachers are part of the bargaining unit and are covered by all terms and conditions of the negotiated agreement, except those specifically altered herein.
