ACADEMIC DISTRESS COMMISSION. A. ORC 3302.10 will have no effect on any provision of this contract unless the district would meet requirements of state law for the Superintendent of Public Instruction to establish an Academic Distress Commission for the district and until the Superintendent of Public Instruction notifies the district that the district is subject to the provision of ORC 3302.10. Should the district enter into academic distress, the intent of the parties is to emerge from said distress with this Agreement intact.
ACADEMIC DISTRESS COMMISSION. As required by ORC 3302.10(P), the parties agree to incorporate the provision of this statute into the collective bargaining agreement.
ACADEMIC DISTRESS COMMISSION. As required by Section 3302.10(P) of the Ohio Revised Code, the provisions of Section 3302.10 are incorporated by reference as part of this Agreement.

The Association and its member reserve the right to challenge any action or failure to act by the Board, any academic distress commission, any Chief Executive Officer, or any other person or entity, with respect to the provisions of R.C. 3302.10.

Furthermore, the Association and its members reserve all rights to challenge the constitutionality of 3302.10, either on its face or as applied. The Association and its members also reserve the right to challenge the construction or implementation of ORC 3302.10 or its provisions by the Board, any academic distress commission, any chief executive officer, or any other person or entity and/or respect to the provisions of ORC 3302.10. Memorandum of Understanding Re: Elementary Plan Time This MOU is entered into between the Tecumseh Local Board of Education (“Board”) and the Tecumseh Education Association (“TEA”) and shall be effective upon the signature of each party. The parties agree to the following: On two-hour delay inservice days, elementary teacher meeting will be concluded no later than 9:50. This will allow for teacher prep time prior to the start of the student day. Middle school and High school teacher meetings will end at a time that will allow for teacher prep time prior to the start of the start of the student day. The parties agree as follows: Teachers will receive compensation for packing/unpacking classroom materials for the purpose of moving from one building to another (Donnelsville to Park Layne and Park Layne to Donnelsville.) Teachers will have the option to take two comp days (to be used during the 2014-15 school year) or one comp day (to be used during the 2014-15 school year) and one additional paid day (at the approved summer rate.)
