Right to Have Shop Xxxxxxx Present. Notwithstanding the rights of a supervisor to supervise, evaluate and discipline employees, employees may, at their discretion, request the attendance of their shop xxxxxxx at any discussion between an employee and a supervisor which the employee believes may result in an adverse report or discipline recommendation. Employees may request at any time during such discussions that further discussion be postponed until they can arrange for their shop xxxxxxx to be present.

Right to Have Shop Xxxxxxx Present. (a) An employee shall have the right to have his/her xxxxxxx, or Union Representative of his/her choice present at any discussion where supervisory personnel intend it to be the basis of formal disciplinary action. Where a supervisor intends to interview an employee for disciplinary purposes which will become part of his/her employment record, the supervisor shall so notify the employee in advance of the purpose of the interview in order that the employee may contact his/her xxxxxxx to be present at the interview.
Right to Have Shop Xxxxxxx Present. 11.01 Whenever the Director of Facilities and Operations officially reprimands or officially disciplines an Employee and where that reprimand or discipline forms part of that Employee’s personnel file, that Employee shall have the right to have a Shop Xxxxxxx present when the reprimand is issued or the disciplinary action is taken.

Unless mutually agreed, 24 hours notice is required for any interview for disciplinary purposes. (b) Whenever possible, the discussion or interview shall be scheduled during the working hours of the affected employee. The employee shall receive compensatory time off equal to the time s/he leaves his/her home to report for the discussion or interview until the time s/he arrives back upon proceeding directly to and from the discussion or interview that takes place outside of his/ her working hours. (c) The Company shall endeavour to schedule discussions or interviews under this clause, at a time when the employee’s shop xxxxxxx is at work, provided such discussion would not be unreasonably delayed by so doing. (d) A shop xxxxxxx shall have the right to consult with a staff representative of the Union and to have a local Union representative present at any discussion which might be the basis of disciplinary action against the shop xxxxxxx.

The employee shall be notified at least 24 hours in advance of the purpose of such meeting. It shall be the responsibility of the employee to contact the xxxxxxx. A Union Shop Xxxxxxx, who could be subject to verbal warnings, or disciplinary action which is to be recorded in the employee's Personnel File, shall have the right to the presence of a Union Representative or another Union Shop Xxxxxxx. This provision shall not apply to those discussions that are of an operational nature and do not involve imposition of disciplinary action.
Right to Have Shop Xxxxxxx Present. An Employee may choose to have their Shop Xxxxxxx present at any discussion with supervisory personnel, which involves discipline or where the supervisor reasonably anticipates that discipline could result from the discussion. Where a supervisor intends to interview an Employee for disciplinary purposes, the supervisor shall make every effort to notify the Employee, in advance, of the purpose of the interview in order that the Employee may contact their Shop Xxxxxxx, providing that this does not result in an undue delay of the appropriate action being taken. Where there is no Shop Xxxxxxx on duty at the time of the meeting and an undue delay of the appropriate action being taken would result, the Employer will attempt to notify a Shop Xxxxxxx or Union Representative to arrange for representation. If representation is not available the Employer will take steps as it deems necessary in the absence of representation which may include suspending the Employee until representation is available. This Section shall not apply to those discussions that are of an operational or investigative nature and do not involve disciplinary action.

Where the School intends to interview an employee for disciplinary purposes, the School shall ensure that the employee is notified in advance of the purpose of the interview in order that the employee may contact their shop xxxxxxx unless the safety or welfare of students is at risk.

This provision shall not apply to those discussions that are of an operational nature and do not involve imposition of disciplinary action.
Right to Have Shop Xxxxxxx Present. (a) No employee shall be dismissed, suspended or reprimanded without a representative of the Union being present. (b) A Shop Xxxxxxx or Local Officer shall have the right to consult with a CUPE staff representative and to have him/her present at any discussion with supervisory personnel which might be the basis for disciplinary action.
