Safe and Sick Leave. 1. Hourly Paid ASWs Pursuant to the New York City and New York State Paid Safe and Sick Leave Laws, ASWs who are paid at an hourly rate and meet the eligibility criteria under the New York City Earned Safe and Sick Leave Act (ESSLA) will be entitled to accrue and take up to a maximum of 56 hours of Safe and Sick Leave per fiscal year (July 1-June 30). 2. All Other ASWs a. Upon ratification of this Agreement, each semester, ASWs who receive a stipend based assignment or a semester-long, course-based assignment(s) can elect to either (1) accrue and take paid safe and sick leave during the semester (provided they meet the eligibility criteria under ESSLA), or (2) take one day of emergency instance leave per semester. b. ASWs who elect to accrue and take Safe and Sick Leave in a given semester shall accrue safe and sick leave at a rate of one hour for each 30 hours of service (up to a maximum of 56 hours). c. ASWs who elect to take emergency instance leave shall receive one (1) emergency absence per semester. d. The University’s Human Resources Information System (HRIS) will provide ASWs with stipend based and semester-long, course-based assignments with an estimate of the number of safe and sick leave hours they would accrue during the semester based on the number of hours assigned to them for the semester, which ASWs can consult prior to making their elections. All elections shall be noted by a process to be developed and disseminated by University Human Resources. Once an ASW with a stipend based or semester-long, course-based assignment elects to take safe and sick leave or an emergency instance absence for the semester, they may not amend their elections until the following semester. ASWs with stipend based or semester-long, course-based assignments who 1) do not use either their accrued safe and sick leave or any emergency instance, or 2) elect to use their safe and sick leave in a given semester, shall have any accrued and unused safe and sick leave carry over to the following semester up to a maximum of fifty-six (56) hours. No ASW shall use more than fifty-six (56) hours of safe and sick leave in any one (1) fiscal year (which shall be equal to one (1) academic year). 3. Safe and Sick Leave. ‌ A. Employees shall accrue 120 hours of sick leave annually, or 4.62 hours per biweekly period. Employees in regular part-time positions shall accrue sick leave benefits pro-rated in accordance with the number of hours normally worked. B. Employee requests to use sick leave must be made in accordance with Department and City policies, as may be amended from time to time. Notwithstanding the foregoing, employees must call in with at least ninety (90) minutes notice when the use of sick leave is unforeseeable. Generally, the City will not require supporting medical documentation for an absence of three (3) consecutive workdays or less. C. Both Parties to this Agreement believe that abuse of sick leave is detrimental to the sick leave system. When the City suspects that an employee is engaging in sick leave abuse or an improper use of sick leave, the City will provide the employee with written notice thereof and the basis of the City’s concerns. The employee will have an opportunity to explain or justify their absences. If the City continues to suspect sick leave abuse or misuse, the employee may be required to provide written medical documentation to support future sick leave absences.

  • Vacations and Sick Leave The Executive shall be entitled to paid annual vacation leave in accordance with the policies as established from time to time by the Board of Directors, which shall in no event be less than four weeks per annum. The Executive shall also be entitled to an annual sick leave benefit as established by the Board for senior management employees of the Bank. Days of accrued sick leave may be used to assist in the health care of persons who live in the employee's household, or to care for a parent, spouse, or a child regardless of their residence or for other relatives requested in writing and approved by the Superintendent/Designee prior to the leave. The Board may require proof of illness under the same requirements as the employee’s illness. 5. The absences in excess of available sick leave, deductions from salary shall be at the rate of 1/182 for Food Services Employees and 1/189 for Food Services Managers in excess of the number provided. 6. Employees hired prior to July 1, 1997: Employee will be paid for unused sick days in the following manner: a. Payment for unused sick days will be made to the employee upon that employee’s early or full service retirement or, upon the employee’s death, to the employee’s estate. Employees eligible for early or full service retirement who resign from employment and do not receive a retirement benefit, shall forfeit all rights to payment for unused sick days. b. Employees, who have a balance of less than 250 unused sick days as of June 30, 2002, will receive payment for 50% of the employee’s accumulated unused sick days up to a maximum of 250 unused days at their average daily rate*. c. Employees who have a balance of unused sick days greater then 250 days as of June 30, 2002, will receive payment for 50% of the employee’s accumulated unused sick days up to their June 30, 2002, unused sick leave balance, at their average daily rate*. d. Payments for unused sick days in amounts greater than $5,000 will be paid in equal amounts over five consecutive years beginning with the year of retirement. e. Payments for unused sick days in the amount at $5,000 or less or for the death of an employee will be paid in a lump sum to the employee or the employee’s estate in the year of retirement or death.

  • Sick Leave Use An employee shall be granted sick leave with pay to the extent of the employee's accumulation for absences necessitated by the following conditions:
