SECONDEE’S EMPLOYMENT. 4.1 The Employment Contract shall remain in force during the Secondment Period.
4.2 The Secondee shall comply with the Host’s policies and procedures, copies of which will be made available on request.
4.3 The Host shall not, and shall not require the Secondee to do anything that shall, breach the Employment Contract and shall have no authority to vary the terms of the Employment Contract or make any representations to the Secondee in relation to the terms of the Employment Contract.
4.4 The Host shall provide the Employer with such information and assistance as it may reasonably require to carry out its obligations as the Secondee’s employer.
4.5 Any change in the Employment Contract during the Secondment Period shall be notified to the Host.
4.6 If the Secondee is held to be employed by the Host at any time during or on termination of the Secondment Period then the Host may dismiss the Secondee and the Employer shall offer the Secondee employment on the terms that applied immediately before that dismissal.

SECONDEE’S EMPLOYMENT. 4.1 For the avoidance of doubt, the Secondee shall remain an employee of the Lead Partner during the Secondment Period and the Employment Contract shall remain in force during that time.
4.2 The Secondee’s line manager for day-to-day purposes during the period of secondment whilst working for the Partners will be as nominated by the Lead Partner, and the Employee agrees to accept such control.
4.3 The Partners shall provide the Lead Partner with such information and assistance as it may reasonably require carrying out its obligations as the Secondee's employer.
4.4 The Secondee shall continue to undertake work for the Lead Partner in accordance with the Employment Contract, during the Secondment Period.
SECONDEE’S EMPLOYMENT. 4.1 The Secondees shall remain employed by the Trust and the Employment Contracts shall remain in force during and for the duration of the Secondment Period.
4.2 The parties acknowledge that some adjustments may be required to the Secondees’ Employment Contracts to amend:
(a) lines of accountability;
(b) relevant operational management issues;
(c) location; and
(d) other day to day management procedures. Similar changes may also be required to aspects of the Secondees’ job descriptions, job plan and job purpose.
4.3 The Trust shall remain responsible for:
(a) consulting with the Secondees regarding any of the changes referred to in clause 4.2; and
(b) making all of the necessary changes to the terms of the Employment Contract so that it can second the Secondees to the Council to provide the Services in accordance with the terms of this Agreement.
4.4 The Trust warrants to the Council that it can second the Secondees to the Council to provide the Services in accordance with the terms of this Agreement.
4.5 The Trust shall provide to the Council true, complete and accurate copies of each of the Secondees’ Employment Contracts prior to the Commencement Date or the date of Secondment for any new starters. The Trust shall obtain permission from the Secondees to share their Employment Contracts (and any associated documents) with the Council.
4.6 The Trust shall comply with the terms of the Employment Contracts during the Secondment Period.
4.7 Other than as provided for in this Agreement, in the Employment Contracts and/or in the Individual Secondment Agreements, the Trust shall not make any further changes to the Employment Contracts during the Secondment Period, without the prior written consent of the Council.
4.8 The Council shall not, and shall not require a Secondee to, do anything which would put the relevant Secondee in breach of its Employment Contract and shall have no authority to vary the terms of the Employment Contracts or make any representations to the Secondees in relation to the terms of their Employment Contracts during the Secondment Period.
4.9 The Council shall provide the Trust with such reasonable information and assistance as the Trust may reasonably require to carry out its obligations as the Secondees’ employer.
4.10 The Secondees shall not be required, unless detailed in this Agreement or otherwise agreed between the Trust and the Council, to undertake any work for the Trust during the Secondment Period.

4.3 The Employer has amended the Employment Contract to require the Secondee to comply with the Host's procedures in place from time to time.
4.4 The Employer shall comply with the terms of the Employment Contract during the Secondment Period.
4.5 The Host shall not, and shall not require the Secondee to do anything that shall, breach the Employment Contract and shall have no authority to vary the terms of the Employment Contract or make any representations to the Secondee in relation to the terms of the Employment Contract.

4.10 All documents, manuals, hardware and software provided for the Secondee's use by the Host, and any data or documents (including copies) produced, maintained or stored on the Host's computer systems or other electronic equipment (including mobile phones), remain the property of the Host.
SECONDEE’S EMPLOYMENT. 4.1 For the avoidance of doubt, the Secondee shall remain an employee of LBH during the Secondment Period and the Employment Contract shall remain in force during that time.
4.2 The Secondee’s line manager for day-to-day purposes during the period of secondment whilst working at LBWF will be as nominated by LBWF, and the Employee agrees to accept such control.
4.3 LBWF shall provide LBH with such information and assistance as it may reasonably require to carry out its obligations as the Secondee's employer.
4.4 The Secondee shall continue to undertake work for LBH in accordance with the Employment Contract, during the Secondment Period.
SECONDEE’S EMPLOYMENT. During the Secondment, the Substantive Employer remains the Secondee’s employer and their Employment Contract shall remain in force. Nothing in this Agreement is intended to be construed or to have effect as creating any relationship of employer and employee between NHS England and the Secondee. The Secondee will cooperate with the Substantive Employer to make the necessary changes to the terms of the Employment Contract and their job plan so that it can second the Secondee to NHS England to provide the Services and meet the Secondee’s obligations in accordance with the terms of this agreement and the Secondee agrees and accepts those changes. At the end of the Secondment, the Secondee will remain employed by the Substantive Employer. Any consequential adjustments needed to the Secondee’s Employment Contract and/or job plan would remain the responsibility of the Substantive Employer and the Secondee. NHS England shall have day-to-day control of the Secondee’s activities to the extent required to ensure delivery of the Services under this Agreement. However, the Secondee shall continue to report to the Substantive Employer for all matters relating to their employment. During the Secondment Period, the Secondee will remain subject to the Substantive Employer’s policies and procedures including but not limited to disciplinary, grievance, capability and absence. The Substantive Employer will remain responsible for the management of sickness absence and the Secondee will be responsible for reporting sickness absence to the Substantive Employer and informing the Supervisor. The Substantive Employer will remain responsible for the management of annual leave. Annual leave dates are subject to the approval of NHS England and the Substantive Employer. The Secondee agrees to adhere to NHS England’s policies and procedures and standards in relation to business conduct as are drawn to the Secondee’s attention during the Secondment Period and the Secondee agrees to do so. 4.2 As required, the Employer shall make the necessary changes to the terms of the Employment Relationships so that it can second the Secondees to the Host to provide the Services in accordance with the terms of this agreement.
4.3 As required, the Employer shall amend the Employment Relationships to require the Secondees to comply with any such of the Host's policies and procedures as agreed by the Parties from time to time.
4.4 The Employer shall comply with the terms and conditions of the Employment Relationships during the Secondment Period.
4.5 The Host shall not, and shall not require the Secondees to do anything that shall, breach the Employment Relationships and shall have no authority to vary the terms of the Employment Relationships or make any representations to the Secondees in relation to the terms of the Employment Relationships.
4.6 The Host shall provide the Employer with such information and assistance as it may reasonably require to carry out its obligations as the Secondees' employer.
4.7 The Secondees shall be required to undertake such work for the Employer at such times as agreed by the Parties during the Secondment Period.
4.8 If any Secondee is held to be employed by the Host at any time during the Secondment Period then the Host may dismiss the Secondee and the Employer shall offer the Secondee employment on the terms that applied immediately before that dismissal.
4.9 All documents, manuals, hardware and software provided for the Secondees' use by the Host, and any data or documents (including copies) produced, maintained or stored on the Host's computer systems or other electronic equipment (including mobile phones), remain the property of the Host.
4.10 Unless otherwise agreed, during the Secondment Period and for a period of twelve months beginning with the final day therof, the Host will not solicit or entice or endeavour to solicit or entice any Secondee or former Secondee away from the Employer or employ or offer to employ any Secondee or former Secondee whether or not they would commit any breach of their Employment Relationship by leaving the service of the Employer and the Host will procure that each of its fellow group companies will observe and comply with an equivalent restriction.
