Sick Leave 9. 3.1 On commencement of employment and in each subsequent year of service theemployee will be entitled to ten days sick leave, in accordance with the Holidays Act 2003 and its amendments. 9.3.2 Sick leave shall be cumulative up to 30 days only. If no sick leave is taken, the entitlement will remain at 30 days. However, if sick leave is taken the appropriate deduction will be made. Explanatory tables are attached as Appendix Two. 9.3.3 All permanent employees who have exhausted their sick leave entitlement may apply for special leave under certain circumstances. For example, in the event of a norovirus outbreak that affects a number of residents and employees at that facility. Approval for special leave will be at the employer’s discretion and would take into account factors such as sick leave patterns of usage. This would be considered additional leave for that year. 9.3.4 Sick leave may be used in the event of the employee’s personal sickness or injury or their partner, or a person who is dependent on the employee for their care. 9.3.5 Sick leave will be paid in accordance with the Holidays Act 2003 and its amendments. 9.3.6 The employer may require the employee to produce a medical certificate for any period of absence of three consecutive days or more and further certificates (at not more frequent intervals than fortnightly) in the case of extended illness. 9.3.7 In the case of extended illness, the employee may be required to attend a medical practitioner of Summerset’s choosing to assess suitability for continued employment. This will be done at the employer’s expense. 9.3.8 The employee shall advise the employer as soon as practicable of inability to work because of illness. Only in exceptional circumstances shall notice be given after the time for the commencement of duty. 9.3.9 This leave is not in addition to the leave prescribed in the Holidays Act 2003. 9.3.10 The intention of this clause is that sick leave be paid for in cases of genuine illness. 9.3.11 Notwithstanding clause 9.3.6, the employer may require a medical certificate for any sick leave, including single days. In this event the employer will inform the employee as early as possible that the proof is required and will meet reasonable costs of the employee in obtaining the medical certificate.

Sick Leave 9. 1.1 Each twelve (12) month classified employee is entitled to twelve (12) days of sick leave annually, with pay, accumulative without limit. The proration is one day per month of service, or major portion thereof, for all employees including those whose service is less than twelve (12) months annually. New employees may not take over six (6) days of sick leave until they have completed six (6) months of service. Employees who have been paid for sick leave in excess of their accrued sick leave entitlement shall have their sick leave reduced to reflect such excess payout for use of sick leave. Also, all unaccrued leave taken by an employee under this rule shall be deducted from a final paycheck. 9.2

Sick Leave 9. 10] The normal sick leave accrual for each employee participating in the prior year annual wellness blood draw shall be 16 days and the normal sick leave accrual for each employee not participating in the prior year annual wellness blood draw shall be 15 days. Sick leave shall accumulate to a maximum of 340 days per employee. Sick leave shall be interpreted to mean personal illness, including pregnancy-related disability or illness, or death in the immediate family or household. The immediate family for purposes of this section shall include: spouse, parent (stepparent, parent-in-law), child (stepchild, son-in-law, daughter-in-law), grandparent, grandchild, sister (stepsister, sister-in-law), brother (stepbrother, brother-in-law), legal guardian and any other relative living in the household of the employee. Each employee shall receive an annual accounting of his/her total unused sick leave no later than the first pay period in each school year.   • Sick Leave The employee is eligible for long term disability benefits if provided for in the Collective Agreement. An employee will not receive pay for the first two (2) weeks of any period of absence due to a legitimate illness. The employee may utilize the paid holiday bank as income replacement for absences due to illness, as described in Article (c) above. An employee who is eligible may apply for Employment Insurance for weeks three (3) through seventeen (17) for any absence due to a legitimate illness. The Home will provide the employee with Disability Income Protection as per Article 14.01 (c) for weeks eighteen (18) through thirty (30) for any absence due to a legitimate illness. Employees may be required to provide medical proof of illness for any absence of a scheduled shift, which is neither vacation nor an approved leave of absence.

  • Sick Leave Abuse ‌ When the Employer suspects sick leave abuse, the employee will be provided the opportunity to explain the circumstances surrounding their sick leave use prior to disciplining the employee, or making reference to sick leave use in the employee’s performance evaluation. The Employer may not adopt or enforce any policy that counts the use of paid sick leave time as an absence that may lead to or result in disciplinary action for an authorized purpose. The Employer may not discriminate or retaliate against an employee for the use of paid sick leave for an authorized purpose.
