Special Seniority Provisions. A. An employee cannot exercise the seniority rights set forth in Sections 5, 6, 7, 8, 15 and 17 of this Article in the following circumstances: (1) Against apprentices and trainees as provided for in Article XIX, or employees in training for supervisory, sales or service positions. (The Company shall furnish to the Union the names of these employees.) (2) Against employees assigned to temporary assignments (as defined in the Wage Article). Should there be an employee reduced from the seniority classification to which the employee is temporarily assigned to fill requirements for additional workforce (not to replace an absent employee, etc.) then in such case the temporary assignment referred to in this paragraph will be limited to five (5) consecutive working days. (3) During the annual inventory and vacation shutdown period the total period of time involved shall not exceed a total of two (2) weeks. (4) During temporary unscheduled layoffs which do not extend beyond one (1) week. (5) During a reduction or layoff which results from a work stoppage in violation of Article X, Strikes and Lockouts; or during a reduction or layoff of ten (10) working days or less because of an unforeseen event such as a power failure, curtailment of operations due to any directive from a governmental environment control agency, a machine or mechanical breakdown, a disruption of shipping facilities, unavailability of material at the factory beyond the control of the Company, or any other unforeseen event such as a flood, fire, or explosion, or the threat of a flood, fire or explosion. B. An employee who has received fewer than eight (8) available and/or compensated hours in any regular workday because of a temporary unscheduled layoff, as set out in this Section 4-A-(4), will be paid the difference, if any, between their available and/or compensated hours for that day and eight (8) hours for such regular workday, provided, however, that this provision does not apply to temporary layoffs as set out in this Section 4-A-(3) and (5). Such payment will be at the rate of the last operation performed prior to the temporary layoff. C. An employee with seniority who is subject to layoff but is retained in the bargaining unit due to qualifications will be considered as having been laid off at the time the employee was retained out of line of seniority in the application of the provisions of Sections 5, 7, and 8 of Article XIV. Special Seniority Provisions. A. An employee may not exercise authority to work in any of the following classifications unless, at the time he or she would so exercise his or her seniority, he or she holds the classification, or he or she has held the classification, or he or she has the qualifications shown below for the classification and has present ability to perform the work of the classification. B. Forge Press Operator: Completion of the training program hereinafter set forth for this classification. C. Reliefman: Must be at least a forge press operator trainee with at least 80 hours towards being qualified as a press operator and be a qualified Roller Operator. Training and qualification requirements will be modified to provide a pool of qualified Reliefrnen without further populating the Reliefinan classification. D. Heat Treat Operator: Prior experience at operating heat treat and/or has completed a training course for heat treat operator. X. Xxxxxxxxx Operator: Must have taken the training and passed the test to be a level one operator. The Company will make the training available for active employees once a year from the pool of employees in the Secondary Processing and Quality Departments. If the class is not filled from these employees, training will be offered on a plant-wide seniority basis. X. Xxxxxxxxx: Must be able to read and write legibly. He or she must be able to order and receive stock readily. He or she must have received five days worked or on-the- job training or equivalent on the day shift. He or she must be willing to operate the MP2 ordering system. G. Skilled Trades: Completion of the apprenticeship or training program hereinafter set forth for this classification, or hold a UAW journeyman's card.

  • SAFETY PROVISIONS It is the essence of this Order that all Services to be performed by Seller shall be done in a safe and good workmanlike manner, free of any accidents. Accordingly, Seller shall promulgate, maintain, and enforce appropriate safety and health rules and procedures (including training) with respect to its personnel and the Work to be performed hereunder, which rules and procedures at a minimum shall be the equivalent of or exceed applicable Buyer safety and health rules. All Services performed hereunder shall fully comply with all lawful governmental safety and health requirements, including the rules and standards established by the Occupational Safety and Health Act of 1970 ("OSHA"), as amended, and any other applicable federal, state and/or local safety or health laws, rules or regulations. Any equipment provided by Buyer to Seller for the benefit of Seller's employees or those of its subcontractors shall be at the sole risk and liability of Seller to make sure that such equipment is fit for the use intended and is in proper working order. XXXXXX AGREES TO INDEMNIFY (INCLUDING ATTORNEYS' FEES) DEFEND, AND TO SAVE HARMLESS BUYER FROM ANY AND ALL CLAIMS OF SELLER, SELLER’S SUBCONTRACTORS, AND THEIR EMPLOYEES ARISING OUT OF THE USE OF ANY EQUIPMENT FURNISHED BY BUYER OR ADVICE GIVEN BY BUYER RELATING TO SUCH EQUIPMENT, TO THE FULLEST EXTENT ALLOWED BY LAW, IT BEING UNDERSTOOD THAT BUYER SHALL NOT BE LIABLE UNDER LAW, CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE. Seller shall maintain a drug and alcohol-free workforce at all times while on Xxxxx's premises/location. Upon Xxxxx's request, Seller shall provide Buyer with a copy of all accident reports prepared by or submitted to Seller, including all OSHA illness and injury reports.

  • Other Pertinent Provisions Landlord and Tenant agree that, effective as of the date of this Amendment (unless different effective date(s) is/are specifically referenced in this Section), the Lease shall be amended in the following additional respects:

  • Administrative Provisions (a) Replies to grievances at Step 2 of the grievance procedure and notification to arbitrate shall be by certified mail, courier or by facsimile. (b) Grievances, replies, and notification shall be deemed to have been presented on the date on which they were verifiably transmitted, and received on the date they were delivered to the appropriate office of the Employer or the Union.

  • Additional Provisions Respecting Insurance (a) All insurance required by this Tenant Agency Compliance Agreement shall be procured and maintained in financially sound and generally recognized responsible insurance companies authorized to write such insurance in the State and selected by the entity required to procure the same. The company issuing the policies required by Section 2.1(a) hereof shall be rated “A” or better by A.M. Best Co., Inc. in Best’s Key Rating Guide. Such insurance may be written with deductible amounts comparable to those on similar policies carried by other companies engaged in businesses similar in size, character and other respects to those in which the procuring entity is engaged. All policies of insurance required by Section 2.1 hereof shall provide for at least thirty (30) days prior written notice to the Agency of the restriction, cancellation or modification thereof. The policy evidencing the insurance required by Section 2.1(c) hereof shall name the Agency as an additional insured. All policies evidencing the insurance required by Section 2.1 (d)(ii) and (iv) shall name the Agency and the Tenant as additional insureds. (b) The certificate of insurance required by Section 2.1(c) hereof shall be delivered to the Agency on or before the date hereof. A copy of the certificates of insurance required by Section 2.1(d)(ii) and (iv) hereof shall be delivered to the Agency on or before the commencement of any construction or renovation of the Demised Premises. The Tenant shall deliver to the Agency before the first Business Day of each calendar year thereafter a certificate dated not earlier than the immediately preceding month reciting that there is in full force and effect, with a term covering the current year of the Tenant’s insurance policy, insurance of the types and in the amounts required by Section 2.1 hereof and complying with the additional requirements of Section 2.2(a) hereof. Prior to the expiration of each such policy or policies, the Tenant shall furnish to the Agency and any other appropriate Person a new policy or policies of insurance or evidence that such policy or policies have been renewed or replaced or are no longer required by this Tenant Agency Compliance Agreement. The Tenant shall provide such further information with respect to the insurance coverage required by this Tenant Agency Compliance Agreement as the Agency may from time to time reasonably require.

  • Penalty Provisions Failure to comply with the regulatory requirements is a violation of state law that may result in penalties up to ten thousand nine hundred ten dollars ($10,910.00 USD) for strict liability violations for each day in which the violation occurs. (Cal. Code Regs., tit.17, § 94507 et seq.; Health & Saf. Code §§ 39674, 39675, 42400 et seq., 42402 et seq., and 42410.)

  • General Provisions Regarding Accounts (a) So long as no Default or Event of Default shall have occurred and be continuing, all or a portion of the funds in the Trust Accounts shall be invested by the Indenture Trustee at the written direction of the Servicer in Permitted Investments as provided in Sections 4.1 and 4.7 of the Sale and Servicing Agreement. All income or other gain (net of losses and investment expenses) from investments of monies deposited in the Trust Accounts shall be withdrawn by the Indenture Trustee from such accounts and distributed (but only under the circumstances set forth in the Sale and Servicing Agreement) as provided in Sections 4.1 and 4.7 of the Sale and Servicing Agreement. The Servicer shall not direct the Indenture Trustee to make any investment of any funds or to sell any investment held in any of the Trust Accounts unless the security interest granted and perfected in such account will continue to be perfected in such investment or the proceeds of such sale, in either case without any further action by any Person, and, in connection with any direction to the Indenture Trustee to make any such investment or sale, if requested by the Indenture Trustee, the Issuer shall deliver to the Indenture Trustee an Opinion of Counsel, acceptable to the Indenture Trustee, to such effect. (b) Subject to Section 6.1(c), the Indenture Trustee shall not in any way be held liable by reason of any insufficiency in any of the Trust Accounts resulting from any loss on any Permitted Investment included therein, except for losses attributable to the Indenture Trustee’s failure to make payments on such Permitted Investments issued by the Indenture Trustee, in its commercial capacity as principal obligor and not as trustee, in accordance with their terms. (c) If (i) the Servicer shall have failed to give written investment directions for any funds on deposit in the Trust Accounts to the Indenture Trustee by 11:00 A.M. (New York City time) (or such other time as may be agreed upon by the Issuer and Indenture Trustee), on the Business Day preceding each Distribution Date, (ii) a Default or Event of Default shall have occurred and be continuing with respect to the Notes but the Notes shall not have been declared immediately due and payable pursuant to Section 5.2 or (iii) the Notes shall have been declared immediately due and payable following an Event of Default, amounts collected or receivable from the Trust Estate are being applied in accordance with Section 5.4 as if there had not been such a declaration, then the Indenture Trustee shall, to the fullest extent practicable, invest and reinvest funds in the Trust Accounts in one or more Permitted Investments.

  • SAVINGS PROVISIONS If any provisions of this Agreement are held to be contrary to law by a court of competent jurisdiction, such provisions will not be deemed valid and subsisting except to the extent permitted by law, but all other provisions will continue in full force and effect.

  • Sick Leave Provisions ‌ The Employer will provide sick leave credits for the sole and exclusive purpose of protecting employees against loss of income during periods of legitimate illness. At the beginning of each fiscal year (April 1) full-time employees who have successfully completed their probationary or trial period are credited with ninety (90) hours of sick time credits to be paid at one-hundred percent (100%) of their normal earnings. New full-time employees will be allocated sick time credits pro-rated to the date they successfully complete their probationary or trial period. Sick leave credits have no value upon termination of employment and cannot be carried over from one fiscal year to the next. Any employee absenting herself on account of illness, regardless of whether she qualifies for sick leave pay under this Article, subject to extenuating circumstances, shall be required to speak directly with her supervisor or designate prior to the commencement of her shift, and in any event no later than two (2) hours prior to the normal commencement of her shift. An employee may be required to submit a medical certificate with respect to any period of time the employee is absent due to illness for more than three (3) consecutive days. It is understood that the Employer may request a medical certificate from employees to cover any absence due to illness, where a pattern of absence so warrants. In the case of longer absences, the employee must keep his/her supervisor informed at two (2) week intervals of his/her progress and expected date of return to work. Employees are expected to notify their supervisor as early as possible of their expected date of return to work. All employees returning to work after any absence due to illness or injury may be requested to present proof of fitness to return to work in the form of medical documentation from a physician or nurse practitioner. The cost of any medical certificate required will be paid by the employee. Employees are expected to participate in the Employer’s return to work program. A statutory or other declared holiday falling within the sick leave period shall not be charged against the sick leave credits. When and employee’s illness continues beyond their sick leave credits, the sequence shall be as follows: (a) The employee uses up all sick time credits; (b) The employee is placed on a Leave of Absence without pay. The employee is issued a Record of Employment and may apply for Employment Insurance Sick Benefits. While on EI, Community Living will supplement these benefits to eighty percent (80%) of the employee’s regular wages. (c) The employee makes application for long term disability coverage through the benefit plan of the Employer.
