Step 2: Superintendent. 31 If the grievant is not satisfied with the disposition of his/her grievance at Step 1, or if no 32 decision has been rendered within six (6) work-days after presentation of the grievance, 33 the grievance may be referred within five (5) work-days to the Superintendent or his/her 34 official designee. The Superintendent or his/her official designee shall arrange for a 35 hearing with the grievant and/or Association, to take place within five (5) work-days of 36 his/her receipt of the appeal. The parties in interest shall have the right to include in the 37 representation such witnesses and counselors as they deem necessary to develop facts 38 pertinent to the grievance. Upon conclusion of the hearing, the Superintendent or his/her 39 official designee will have four (4) work-days to provide a written decision, together with 40 the reasons for the decision to the Association.
Step 2: Superintendent. Within five (5) days of receipt of a written grievance, the Superintendent shall hold a formal meeting with the Grievant/Association. Prior to this meeting, the Superintendent shall make a thorough investigation of the allegations contained in the grievance. Within five (5) days after the meeting, the Superintendent, or his designated representative shall provide the Grievant/Association with his written response. Grievances which are a result of action(s) or inaction(s) of the Superintendent and/or Board, may be initiated at Step 2 of the grievance procedure. If the Grievant/Association is not satisfied with the written response received from Superintendent or his designee, the Grievant/Association may, within five (5) days of the date of the Superintendent/designee's response, pursue the grievance to Step 3 of this grievance procedure. Any Grievant/Association may have an Association Representative accompany him at all levels of this grievance procedure.
Step 2: Superintendent. If the grievant is not satisfied with the disposition of the grievance or if no disposition has been made within ten (10) school days of such meeting or fifteen (15) school days from date of filing, whichever be later, the grievance shall be transmitted to the Superintendent. Within five (5) school days the Superintendent or designee shall meet with the grievant on the grievance and shall indicate his/her disposition of the grievance in writing within five (5) school days of such meeting, and shall furnish a copy thereof to the Association and grievant.
Step 2: Superintendent. If a satisfactory solution is not effected, the grievant shall present his/her written grievance to the Superintendent within ten (10) working days of the receipt of the Step 1 response. The Superintendent shall within ten (10) working days of the receipt of the grievance hold a Step 2 meeting to hear the grievance. Within ten (10) working days of the Step 2 meeting the Superintendent shall issue his response in writing and copies shall be sent to the grievant.
Step 2: Superintendent. If the employee or Union is not satisfied with the disposition of the grievance at Step I, it shall file the grievance with the Superintendent of Schools within ten (10) working days after receipt of the supervisor's answer. The Superintendent shall meet with the employee and a Union Representative within fourteen (14) working days of receipt of the grievance.
Step 2: Superintendent. If the grievant is not satisfied with the disposition of the grievance at Step 1, or if no decision has been rendered within the time line, the grievance may be appealed to the Superintendent. The Superintendent shall arrange for a hearing with him/herself, the grievant, the first level supervisor, and any designated representative, to take place within five days of his/her receipt of the appeal. The grievant shall have the right to include in the representation such witnesses they deem necessary to develop the facts pertinent to the grievance. Upon conclusion of the hearing, the Superintendent will have five days to provide his/her written decision, together with the reasons for the decision to the grievant.
Step 2: Superintendent. 1. If a complaint is not resolved in a conference between the affected bargaining unit member and his/her Service Area administrator, the grievant may invoke the formal grievance procedure, within ten (10) calendar days of the Step 1 meeting between the Service Area administrator and the affected bargaining unit member, by putting the grievance into written form (See Grievance Form) and delivering copies of the same to the Superintendent. The grievant may, at his/her option, deliver the written grievance to the Association for forwarding to the Superintendent. The written grievance shall contain the following: (1) It shall cite the section or subsections of this contract alleged to have been violated; (2) It shall contain a synopsis of the facts giving rise to the alleged violation; (3) It shall contain the date(s) of the alleged violation; (4) It shall specify the relief requested; (5) It shall be signed by the grievant. No Grievance Form may contain more than one grievance.
Step 2: Superintendent. 35 If the matter cannot be resolved at Step 1, or if the immediate supervisor does not respond within the 36 five (5) working days referred to in Section 13.1, the grievance will be reduced to writing specifying 37 the precise section of the Agreement allegedly violated, and the facts giving rise to the grievance. A 38 representative of the Association shall meet with the Superintendent or his designee within ten (10) 39 working days, or at a mutually agreeable time, after receiving the response at Step 1. The 40 Superintendent or his designee will respond in writing within ten (10) working days of the meeting 41 with the Association representative. 42
Step 2: Superintendent a. If the teacher initiating the grievance is not satisfied with the disposition of the grievance at Step 1, the teacher may present the grievance to the Association.
