Suitable Personnel. Partner will only involve personnel that are competent to perform Partner’s obligation to Yahoo. Partner will use the results of competently performed and reasonably inclusive background checks, along with any other pertinent information, in making this determination.

Suitable Personnel. The Contractor must use the Contractor’s best endeavours to ensure that each Contractor Person engaged in the performance of the Maintenance Work is only a person who: (a) is properly qualified for the task that person is to perform; and (b) will act, in all the circumstances, in a fit and proper manner.
Suitable Personnel. HortonWorks will only involve personnel that are competent to perform HortonWorks’ obligation to Yahoo. HortonWorks will use the results of competently performed and reasonably inclusive background checks, as required under Section 11.3 (Background Checks) of the Agreement, along with any other pertinent information, in making this determination.

If any of the Key Subcontractor personnel are unavailable to continue full- time work called for herein, and if substitute individuals approved by BearingPoint are not available to continue the work within ten (10) business days from such unavailability, BearingPoint shall have the right to replace such unavailable Subcontractor personnel with personnel of BearingPoint or another subcontractor. All Subcontractor’s personnel shall be subject to the prior approval of BearingPoint, and BearingPoint shall have the right, at any time, to request removal of any Subcontractor personnel whom BearingPoint deems, in its reasonable discretion, to be unsatisfactory. Upon such request, Subcontractor shall use all reasonable efforts to replace within ten (10) business days such removed individual with a substitute employee(s) of Subcontractor acceptable to BearingPoint, having skills and training suitable to perform the Services. (b) BearingPoint shall, at its expense, have the right, but not the obligation, to conduct a background check, as permitted by law, on all Subcontractor personnel granted access to the premises or Systems of the Client. The background check with respect to each of the Subcontractor personnel includes, at a minimum, items with respect to an individual’s civil, criminal, litigation, credit, and educational background. Subcontractor shall reasonably cooperate with BearingPoint in performing such background checks, and shall promptly
Suitable Personnel. (a) The Services will be performed for Subcontractor by the persons satisfying the labor category requirements listed on Exhibit B, attached hereto. Subcontractor’s personnel who are designated as essential to performance (“Key Personnel”) also are identified in Exhibit B. Subcontractor shall not remove or replace Key Personnel without BearingPoint’s prior written approval. If any of the Key Personnel are unavailable to continue full-time work called for herein, and if substitute individuals approved by BearingPoint are not available to continue the work within five (5) days (or a longer period of time if mutually agreed upon by both parties) from such unavailability, BearingPoint shall have the right to replace such unavailable Subcontractor Key Personnel with personnel of BearingPoint or another subcontractor. Any Client Key Personnel requirements in addition to the foregoing are set forth in Exhibit C. (b) Subcontractor shall, at its expense, conduct a background check, as permitted by law, on all Subcontractor personnel granted access to the premises or systems of the Client or BearingPoint. The background check with respect to each of the Subcontractor personnel shall include, at a minimum, verification of educational background and professional licensing, a check of any criminal convictions for at least the past seven years, and a credit check including information for at least the past five years. Subcontractor shall not assign any individual for whom there has been an adverse finding or result. Any Client security or background check requirements in addition to the foregoing are set forth in Exhibit C.

If the offending conduct is repeated, and Contractor is not restricted by a collective agreement from doing so, MMSM may require that such person be removed from all performance of Services for MMSM. If the offending conduct is repeated, and Contractor is not restricted by a collective agreement from doing so, Recycle BC may require that such person be removed from all performance of additional work for Recycle BC. Removal of such person will be addressed by Contractor immediately.
Suitable Personnel. 16.7.1 The Service Provider's provision of qualified, capable and experienced personnel is essential to the performance of its contractual obligation as described herein. As such, failure to provide suitable personnel consistent with CMTA's contractual expectations as set forth herein shall be deemed a material breach of contract and subjects the Contract to immediate termination at CMTA's option. The Service Provider shall ensure that its employees are qualified, capable and suitable to perform the requirements of this Contract and CMTA reserves the right to provide input to the Service Provider in determining the suitability of any employee to continue performing the work pursuant to this Contract. The Service Provider shall provide all pertinent employee records regarding incidents/accidents, passenger complaints, etc., to CMTA as soon as possible upon request. 16.7.2 Employees assigned by the Contractor to work on CMTA’s contract shall be deemed ineligible for rehire by another contract service provider of CMTA if their employment is involuntarily separated as a result of a drug and alcohol policy violation, safety or customer service violation, or significant accident history, including those resulting in major property damage or personal injuries. See Attachment # 6, Reference Check Form-Safety Sensitive Positions. The Contractor shall be responsible for making a reasonable attempt to verify eligibility for rehire with the other CMTA contract service providers. Contractor shall meet Department of Transportation (DOT) requirements when requesting employment history information from any former employer. The requirements of the DOT Title 49: Transportation, Part 40 – Procedures for Transportation workplace drug and alcohol testing which states that an employer must maintain a copy of the written request for information sent to the former employer including the signature of the potential employee authorizing the release of this information to Contractor. The Contractor must comply with the reasonable attempts by other CMTA contract service providers to verify that former employees are not ineligible for re-hire as a result of a drug and alcohol policy violation or significant accident history, including those resulting in major property damage or personal injuries 16.7.3 All employees shall receive regular training that develops skills and increases understanding of people with varying disabilities and of varying ages, regardless of ethnic/national origi...
