The Agency’s Responsibilities. A. The Agency shall serve as the lead organization for providing the Youth Mentoring Program to children at Great Oaks Village. B. The Agency shall staff the Program with “Youth Mentors” that are qualified to provide Program Services to GOV residents in accordance with the terms and conditions of this Agreement. C. The Agency shall provide its Youth Mentors with an appropriate Program curriculum and ensure that its Youth Mentors provide Program Services to children at GOV in accordance with said Program curriculum. D. The Agency shall provide Program Services to children at GOV on days and times agreed to by both parties and coordinated by the parties’ respective Liaisons. In the event that the Agency cannot provide the Program on a scheduled day or time, the Agency will timely notify the County.
The Agency’s Responsibilities a. The AGENCY agrees to allow students and faculty, at their own expense, to use the cafeteria facilities provided for personnel. b. The AGENCY will consult with faculty members concerning policies which will affect or are related to the educational programs. c. The AGENCY shall not be responsible for student’s personal property. d. The AGENCY will provide students and faculty with first aid only in case of illness or injury incurred while on AGENCY premises. e. While the AGENCY agrees to assist in the guidance and supervision of students and to cooperate in evaluating student performance, the responsibility for student performance remains with the School Board. f. The AGENCY’s Registered Nurse (RN) and Certified Nursing Assistant (CNA) trainer, Patient Care Assistant (PCA) trainer, or Home Health Assistant (HHA) trainer, whichever trainer is appropriate for each student, shall complete a written evaluation for the student to be given to the classroom instructor to be utilized as part of the overall grading process. The RN and appropriate trainer shall not be required to complete an evaluation for any student leaving early or failing to complete the required training.
The Agency’s Responsibilities. 1.1 The AGENCY assumes all risk and liability associated with access to and physical presence of AGENCY personnel on the NCDP. 1.2 The AGENCY agrees to ensure that all AGENCY personnel abide by all rules, policies, and conditions, as established by the CITY, that may be in effect or as may be changed from time to time. 1.3 The AGENCY shall schedule and coordinate with the CITY prior to all training exercises at the NCDP. 1.4 The AGENCY shall have an on-site supervisor at all times during the training exercises who shall be responsible for the oversight and operation of each and every training exercise. 1.5 The AGENCY shall conduct a physical inspection of the NCDP for any hazards or dangerous conditions on the premises or equipment prior to each use. If any such hazards or dangerous conditions exist, the AGENCY shall notify the CITY immediately and cease all training exercises. 1.6 The AGENCY shall ensure that all training exercises are conducted using standard firearms safety protocols and/or other emergency team protocols as applicable. The AGENCY shall ensure that all weapons brought on CITY property are secured at all times when not in use. 1.7 The AGENCY shall at all times conduct its training exercises so as not to interfere with, obstruct, or endanger the CITY’S operations, facilities, and/or members of the public. 1.8 The AGENCY agrees that during any training exercises, no unauthorized personnel or spectators shall be allowed at the NCDP without the CITY’S prior written approval. All authorized visitors not directly under the control of the CITY shall execute a Hold Harmless Agreement with the CITY addressing all liability for claims, costs, judgments, or awards in a form approved by the CITY prior to entering the NCDP. 1.9 The AGENCY shall be responsible for determining participant eligibility and shall ensure that only qualified participants use the NCDP. 1.10 The AGENCY shall be responsible for providing all material and supplies, including, but not limited to, weapons and ammunition. 1.11 The AGENCY agrees that failure of the AGENCY and/or any of its personnel to comply with the terms of this AGREEMENT may result in suspension of the use of the CITY’S NCDP and/or termination of this AGREEMENT.
The Agency’s Responsibilities. The Agency will: a) provide its Project Executive and Project Manager; b) provide all necessary staff, resources, accommodation, skills, supervision and assistance in order to comply with its obligations under this Agreement, including officers to attend at Council meetings if requested to do so; c) project manage the Project in accordance with Schedule 1 and be responsible for all financial, administrative and reporting aspects of the Project including the Project Account; d) provide its deliverables due under this Agreement ("Deliverables") as set out in Schedule 1; e) invoice the Council for the Contributions to be made by the Council as calculated in accordance with Schedule 2, on 30 day payment terms; f) maintain the Project Account together with related documentation; g) ensure that it has appropriate financial and auditing procedures in place to manage its involvement in the Project; h) ensure that it has complied with all its tax requirements in connection with the Project and its Contributions i) be responsible for compliance with all applicable legislation in respect of health and safety with regard to approved Schemes; j) ensure that sustainable development (which includes environmental, social and economic factors) is taken into account in all stages of the Project and in any relevant contracts with third parties; k) be the employer or contracting body in respect of any goods, service or employment contracts entered into for the purpose of the Project (save in respect of the Council’s own employees, or where otherwise expressly agreed) and be responsible for all resulting liabilities arising from such contracts in respect of inter alia health and safety, training, pay and conditions, pension and redundancy except where such liabilities arise due to the Council’s cause; and l) if it has not already done so by the date of this Agreement, the Agency shall procure from any contractor which it engages to carry out the Schemes comprised in the Project a collateral warranty substantially in the form of the Agency’s WEM framework collateral warranty in favour of the Council; and. m) retain Project Records for not less than 6 years after the Term ends.
The Agency’s Responsibilities. 5.1 The Agency will pay the OAIC the Funds specified in Schedule 2 in consideration for the OAIC performing the Activities in in accordance with the Milestones set out in S3 of Schedule 2.‌ 5.2 In furtherance of the Activity objectives, the Agency will: (a) provide appropriately qualified and experienced Agency Personnel in order to perform its obligations under this MOU; and (b) take all reasonable endeavours to provide assistance and information as the OAIC requests where this is necessary to enable the OAIC to perform the Activities.‌ 5.3 The Agency will not represent the OAIC as endorsing or approving any proposal in connection with the Activities, unless the OAIC has specifically done so in writing. If 5.4 The Agency will consult with the OAIC prior to releasing any public document or press release in connection with the Activities which attributes a regulatory or policy position to the OAIC.‌

The Agency’s Responsibilities. 3.1 The Agency’s responsibilities in relation to the operation of SLIP are the following. a) Ensure it has sufficient ownership, authority, approval or control of its Agency’s Data to publish to SLIP. b) Ensure it’s Agency’s Data is accurate and fit for use via SLIP and publishing to SLIP. c) Provide SLIP with the latest and most accurate Agency’s Data which it has available at the time of publication including all relevant metadata. d) Provide a suitable arrangement or system, for the continual supply of its Agency’s Data via interfaces made available to the Agency or other service, to SLIP. e) Make every reasonable effort to publish up-to-date Agency Data in the update frequency notified to Landgate and End Users. f) Select the appropriate Access Level and appropriate licence regime for all the Agency’s Data published to SLIP, as specified in item 5 of the Schedule. This is entirely the Agency’s decision and the Agency accepts sole responsibility for it. g) Provide during normal business hours, support for Users regarding the Agency’s Data and make every reasonable effort to analyse any incidents regarding the Agency’s Data within 14 days of the incident being identified by Landgate, a User or the Agency. h) Follow any terms and conditions if specified in item 6 of the Schedule that may include terms and conditions in relation to the hosting, management and removal of the Agency’s Data, SLIP infrastructure and/or software at the Agency’s location. i) Comply with any relevant WALIS policies and procedures outlined in the WALIS Charter.
The Agency’s Responsibilities. 7.1 The Agency will perform the Activities as agreed in the Schedules as in place from time to time. 7.2 The Agency will not represent the OAIC as endorsing or approving any proposal in connection with the Activities unless the OAIC has specifically done so in writing unless in the particular circumstances it is impracticable to await or provide a proposal in writing. 7.3 The Agency will act in good faith and use its best endeavours to cooperate with the OAIC’s accountability requirements for the funds, including the provision of funding as agreed in the Schedule. 7.4 In furtherance of the specific Activity objectives, the Agency will: (a) provide appropriately qualified and experienced Agency Personnel in order to perform its obligations under this MOU; and (b) be responsible for the performance and conduct of all Agency Personnel involved with the Activities, including taking all reasonable endeavours to ensure that, in the course of carrying out the Activities, Agency Personnel comply with Australian Public Service Values, the Australian Public Service Code of Conduct and the Public Service Act 1999 to the extent they are required to do so.
