User Submissions. This Agreement does not obligate You to provide EdiFabric with materials, information, comments, suggestions, or other communications regarding the Materials. However, You agree that any material, information, comments, suggestions, or other communications You transmit or post to an EdiFabric website (including but not limited to, submissions to the Priority Support and/or other customer support websites or online portals) or provide to EdiFabric under this Agreement are not controlled by the International Traffic in Arms Regulations (ITAR) or the Export Administration Regulation (EAR), and if related to the features, functions, performance, or use of the Materials are deemed non-confidential and non-proprietary ("Communications"). EdiFabric will have no obligations with respect to the Communications. You hereby grant to EdiFabric a non-exclusive, perpetual, irrevocable, royalty-free, copyright license to copy, modify, create Derivative Works, publicly display, disclose, distribute, license, and sublicense through multiple tiers of distribution and licensees, incorporate, and otherwise use the Communications and all data, images, sounds, text, and other things embodied therein, including Derivative Works thereto, for any and all commercial or non-commercial purposes. You are prohibited from posting or transmitting to or from an EdiFabric website or providing to EdiFabric any unlawful, threatening, libelous, defamatory, obscene, pornographic, or other material that would violate any law. If You wish to provide EdiFabric with information that You intend to be treated as confidential information, EdiFabric requires that such confidential information be provided pursuant to a non-disclosure agreement (“NDA”); please contact Your EdiFabric representative to ensure the proper NDA is in place. Nothing in this Agreement will be construed as preventing EdiFabric from reviewing Your Communications and errors or defects in EdiFabric products discovered while reviewing Your Communications. Furthermore, nothing in this Agreement will be construed as preventing EdiFabric from implementing independently-developed enhancements to EdiFabric’s own error diagnosis methodology to detect errors or defects in EdiFabric products discovered while reviewing Your Communications or to implement bug fixes or enhancements in EdiFabric products. The foregoing may include the right to include Your Communications in regression test suites.

User Submissions. 9.1. The App may permit the hosting, sharing, posting, and publishing of content by you and other users ("User Submissions"). Your User Submissions may be posted to the App, or otherwise be made publicly available. You understand that whether or not such User Submissions are published, we do not guarantee any confidentiality with respect to any User Submissions. You shall be solely responsible for your User Submissions and the consequences of posting or publishing them. We have complete discretion whether to publish your User Submissions and we reserve the right without further notice to you, to monitor, censor, edit, remove, delete, and/or remove any and all User Submissions at any time and for any reason.
User Submissions. You agree that you will not upload or transmit any communications or content of any type that infringes or violates any rights of any party. You agree that such submission is non- confidential for all purposes. If you make such submission, you are warranting that the owner of such content has expressly granted the Program a royalty-free, perpetual, irrevocable, worldwide non-exclusive right to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform and display the communication or content in any media or medium, or any form or format now known or hereafter developed.

By posting User Submissions on or through the Services or otherwise providing feedback to us (e.g., in responding to surveys or questionnaires), whether solicited or unsolicited by us, including without limitation any individually identifiable health or personal information you submit to us, you hereby irrevocably and unconditionally assign to us all right, title, and interest in and to any such User Submissions (including, without limitation, any modifications, reproductions, or derivative works thereof), and all User Submissions, you supply to us through the Mobile App or the Services shall be deemed and shall remain our property, subject to 180’s compliance with these Terms, the Privacy Policy, and all applicable federal and state privacy laws in creating, using and disclosing such User Submissions. Except as provided in the Privacy Policy, none of the User Submissions shall be subject to any obligation of confidence on our part, and you agree to waive any and all claims arising from or relating to the exercise by 180 of the rights granted herein. You understand that 180 shall have the right to de-identify all User Submissions in accordance with 45 CFR section 164.514 and use such de-identified data for its own business purposes, as well as reformat, excerpt, or translate any materials, content or information submitted by you, including all User Submissions. By providing you with the ability to distribute User Submissions through the Services, 180 is not undertaking any obligation or liability relating to any User Submissions or activity related thereto, nor does 180 endorse any such User Submissions or activities. 1...

Anyone using this Website expressly consents to such monitoring, tracking and recording If you make any such submission, you agree that you will not send or transmit to Our company any Content that infringes or violates any rights of any party. If you make any submission to the Site, you automatically grant—or warrant that the owner of such Content or intellectual property has expressly granted—Our company royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and/or display the communication or Content in any form, and in any forum. Our company may sublicense its rights through multiple tiers of sublicenses. You agree that (i) you will not engage in any activities related to this Website that are contrary to applicable law, regulation or the terms of any agreements you have with us, and (ii) in circumstances where locations of this Website require identification for access, you will establish commercially reasonable security procedures and controls to limit access to your password or other identifying information to authorized individuals. You will also promptly respond to any reasonable questions provided by DigiLocker. You acknowledge and agree that all information provided in accordance with this section shall be considered User Submissions You agree and undertake not to circumvent any restrictions placed by DigiLocker on access to the Services. You further permit DigiLocker to monitor your use of the Site to ensure compliance with the terms.

User Submissions are the sole responsibility of the party from whom such User Submissions originated. You grant us a non-exclusive, fully-paid, world-wide, transferable, perpetual, irrevocable, royalty-free license, with the right to grant sublicenses, to display, publicly perform, distribute, store, transcode, broadcast, transmit, reproduce, edit, modify, create derivative works, and otherwise use your User Submissions in any manner, in any medium, for any purpose in connection with Kidcaboo, the Site or the Services. You acknowledge and agree that you have no expectation of compensation, privacy, or confidentiality with respect to any User Submission. User Submissions may be available to other Users (such as Driving Nannies and Arrangers). We may refuse or remove User Submissions at any time. You represent and warrant that you own all rights in your User Submissions or you have acquired all necessary rights in your User Submissions to enable you to grant Kidcaboo the rights in your User Submissions described above. We have no obligation to pre-screen User Submissions or any other content on the Site or Services, although we reserve the right in our sole discretion to pre-screen, refuse or remove such content.
