Vessel Requirements i. Ferry Services shall be provided by means of safe, comfortable, well-maintained, Coast Guard- approved watercraft compatible with the launching and docking facilities provided at the Park. ii. If the United States Coast Guard requires a Certificate of Inspection for the vessel, the Concessionaire must have one and it must be presented to the Department prior to starting any operation under this Agreement. If the United States Coast Guard does not require a Certificate of Inspection for the vessel, the Concessionaire will present to the Department a current Florida Vessel Registration for the vessel, prior to the execution of this Agreement iii. The Concessionaire will not change the vessels or the number of vessels without receiving written pre-approval from the Department.

To protect the integrity of the docks and the security of all vessels, oversized vessels will not be allowed to occupy any slip. Each Member State shall notify the Commission of the following by electronic means: (a) a list of its vessels entitled to fly its flag which it may authorize to conduct fishing activities, in the Regulatory Area, hereinafter referred to as a ‘notified vessel’, in the format prescribed in Annex II.C1 of the CEM referred to in point 27 of the Annex to this Regulation; from time to time, any deletion from the list of notified vessels, without delay, in the format prescribed Annex II.C2 of the CEM referred to in point 28 of the Annex to this Regulation. 2. No fishing vessel shall conduct fishing activities in the Regulatory Area unless: it is listed as a notified vessel; and eligible vessels have been issued an IMO number. 3. No Member State shall: (a) permit a vessel entitled to fly its flag to conduct fishing activities in the Regulatory Area unless it has authorized it to do so; nor authorize a fishing vessel entitled to fly its flag to conduct fishing activities in the Regulatory Area unless it is able to exercise effectively its flag State duties in respect of such vessel. 4. Each Member State shall manage the number of authorized fishing vessels and their fishing effort in a manner that takes due account of the fishing opportunities available to that Member State in the Regulatory Area. 5. Vessel Requirements. The Operator must ensure that: (a) all Vessels used to provide the Ferry Services: (i) are appropriate and adapted to the provision of the Ferry Services; (ii) comply with all Laws, including the requirements of the Relevant Legislation and any relevant regulations; (iii) are staffed by sufficient Staff and that its Staff: (A) have appropriate qualifications, authorisations, experience and training to properly discharge their duties; and (B) understand and comply with their obligations under the Relevant Legislation; (iv) are maintained in accordance with all Laws, including the requirements of the Relevant Legislation and in accordance with the builder's specifications or recommendations; and (v) have a current Certificate of Operation and Certificate of Survey at all times; (b) any person, including any sub-contractor, who maintains the Vessels is suitably qualified in all respects to carry out the required maintenance; (c) any weight or passenger limit applicable to Vessels used to provide the Ferry Services is not exceeded; and (d) all Vessels are clean and tidy when performing the Ferry Services.

Vessel Requirements. 5.1. The Licensee must comply with all vessel requirements as set out below. 5.2. All Vessels must secure and display a current electrical warrant of fitness (EWOF) and ensure all electrical leads are tagged and tested, if accessing shore power. Testing tags must be clearly visible and attached to any corresponding leads at the shore point of power supply. Leads must be in one piece and not contain joining elements. WOF’s must be positioned on the Vessel so they are visible from the shore. 5.3. Vessels must be presentable, tidy, in a state of good repair and working order, and pass any safety test imposed by the Licensor. 5.4. All fitting and mooring lines must be of suitable strength, condition and type to adequately secure the Vessel to the berth or mooring via the cleats provided. 5.5. Vessel halyards, lines and rigging must be secure. 5.6. All parts of the Vessel must be contained within the dimensions of the designated berthing area as outlined within the Marine Berth Licence. 5.7. Vessels must comply with all applicable Statutes, Policies, Rules, Regulations and Bylaws imposed by any relevant regulatory or territorial or other competent authority. 5.8. Live-aboard vessels must be self-contained for all water and wastewater requirements and contain suitable black/grey water holding tanks with active sealing devices that remain activated while the Vessel is moored. Self-contained Vessels may temporarily utilise the potable water taps and black/grey water pump-out facilities provided by the Licensor while berthed in the Kaiapoi Marine Precinct. 5.9. Vessel hulls must be kept clean of marine pests and conspicuous bio-fouling. 5.10. The Licensor can issue a notice of repair to the Licensee if a Vessel is deemed in breach of the vessel requirements (being the requirements set out in clauses 5.2 to 5.9 above). Failure to comply with a notice of repair within the timeframe specified by the Licensor shall constitute a breach entitling the Licensor to terminate this Agreement. 5.11. Vessels occupying berths without a Licence or permission by the Licensor (and this includes, without limitation, vessels owned or controlled by the Licensee which are not the vessel specified for this Agreement), may be forcibly removed from the Kaiapoi Marine Precinct at the Licensee’s expense and sole risk. The Licensor shall not have any responsibility or liability in connection with such removal and to the maximum extent permitted by law excludes any responsibility or liability...
Vessel Requirements. The vessel shall meet all relevant legislation and all load and discharge port regulations and safety standards, and shall comply with the requirements of the International Code for the Security of Ships and of Port Facilities (ISPS Code). If the vessel does not meet all such requirements, or is deemed unsafe, then the vessel may be refused. The Party nominating the vessel shall be liable for all damages (consequential damage is excluded) and costs resulting from the non-compliance with this article. A vessel may not be substituted without written consent of the other Party.

The Customer shall exercise reasonable diligence to ensure that the vessel complies with the U.S. Federal Water Pollution Control Act, as amended, the U.S. Federal Oil Pollution Control Act of 1990 (OPA90) and regulations issued pursuant thereto effective during the term of this Agreement, and have secured and carry onboard the vessel a current U.S. Coast Guard Certificate of Financial Responsibility (COFR)(Water Pollution).
