WORKING OUT OF. CLASS
1. OUT-OF-CLASS The City shall pay employees for working out-of-class because of a temporary position vacancy. Except for exclusions contained within this section, the following provisions apply:
A. When the temporary job assignment for employees is one “normal” working day or longer, payment will be effective beginning the first day.
B. Work performed for less than eight (8) hours on the first day of such assignment shall not be eligible for out-of-class pay, except for the classification of Solid Waste Truck Operator which shall be entitled to working out-of-class pay commencing with the first hour of work and part-time employees shall be entitled to working out-of-class pay commencing with the completion of one “scheduled” work day.
C. Any person assigned to working out of class, shall receive the same salary increase as applicable in a promotion under Article II, Section C-2. No person working out of class may receive less than a five percent (5%) increase over their base monthly salary. For purposes of this section, base monthly salary shall include tenth step. In the event that a person working out of class is computed to receive less than a five percent (5%) increase under the promotion formula, that person shall be retained at their current salary and a five percent (5%) differential shall be added to their base monthly salary during such time as the employee is assigned to the out-of-class opportunity.
D. Part-time employees shall be eligible for “working out-of-class” on the same basis, as a full-time employee. Except that his or her “work day” shall be their hours worked at the out-of-class position.
E. There will be no out of class pay when filling in for an Executive Assistant on “N” days and vacation days. The City will pay out of class for a Senior Secretary who works as an Executive Assistant in absences of at least fifteen (15) consecutive days as a result of vacations, catastrophic illness, return from IOD, FMLA or CFRA time off, pending recruitment approved leave of absence, administrative leave or suspension, jury duty, etc.

WORKING OUT OF. CLASSIFICATION SECTION 1. An employee temporarily assigned to work in a classification with a higher rate must be assigned work in said higher classification for more than one (1) day to be eligible to receive the pay rate of that higher classification for the period he or she was so assigned. Upon completion of such one (1) day worked, the employee shall receive the higher rated compensation for all time worked in the higher rated classification.
A. The employee must be assigned to and must perform functions that are normally performed by the person replaced in order to receive the higher rated compensation for that time period.
B. The term “higher rated classification” refers to positions that pay a higher rate of pay.
WORKING OUT OF. CLASSIFICATION (Out of Class Assignment): Employees may perform duties out of their classifications for five days or more using the Out of Class Assignment process below if the employee will be performing substantially all the duties of the higher classification, or the Temporary Addition of Duties process below if the employee will be performing some, but not the majority, of the duties of the higher classification.

9.2 The Employer has a general management right to detail an employee from his/her assigned position to another position within his/her job classification or to any other classification within the Department. In exercising its discretion, the Employer will reasonably consider the legitimate operational needs and efficiencies of the Department and available staffing options when detailing employees from their bid position.
WORKING OUT OF. CLASSIFICATION
11.1 For purposes of this Article, an out-of-class assignment is defined as an assignment of an employee to perform, on a full-time basis, all of the significant duties and responsibilities of a position different from the employee’s regular position, and which is in a classification higher than the classification held by such employee.
11.2 The Employer shall avoid, whenever possible, working an employee on an out-of-class assignment for a prolonged period of time. Any employee working an out-of-class assignment for a period in excess of ten (10) consecutive working days shall receive the rate of pay for the out-of-class assignment in a higher classification beginning on the ten (10th) consecutive working day of such assignment. The rate of pay for an approved out- of-class assignment shall be the same rate the employee would receive if such employee received a regular appointment to the higher classification.
11.3 An employee who otherwise would receive a shift differential shall not lose the shift differential during any portion of the out-of-class assignment prior to being paid the rate of pay for the higher classification.
WORKING OUT OF. CLASSIFICATION-applies to police officers only A. Corporals may be required to temporarily (less than 80 hours) assume the responsibilities of the Shift Commander in the absence of a Sergeant without any additional compensation above the rate of pay of the Corporal.
WORKING OUT OF. CLASSIFICATION Employees required to work in a higher classification for four (4) or more hours of the regularly scheduled shift shall be paid at the minimum of the higher classification or receive a seven (7%) percent increase to their current rate of pay, whichever is greater, for all hours so worked.
