AMOUNT OF DISABILITY BENEFITS. The amount of disability benefit shall be 70% of an employee's weekly earnings, as defined in Section 1(g) immediately preceding the date of disability, subject to a maximum weekly disability benefit of $590.00. Effective September 1st, 2006, increase to $600.00. Effective September 1st, 2007, increase to $610.00. Effective September 1st, 2008, increase to $620.00. The weekly maximum will not be less than the amount payable for such week under the Unemployment Insurance Xxx 0000 and its Regulations as amended.

In the event of a lay-off, an employee who i s insured under the terms of this plan shall be considered as still employed for purposes of this benefit up to the end of the policy month next following the policy month in which the employee was laid off. An employee making a claim for an amount of disability benefit after lay-off or termination of employment, for disability established to the satisfaction of the Company and/or insurer as having occurred prior to his lay-off or termination, shall be eligible for an amount of disability benefit provided such disability was accompanied by a continuance of absence that commenced prior to actual lay-off or termination. Successive periods of disability separated by less than six consecutive months shall be considered one period o f disability, unless the subsequent disability i s due t o an accident or illness entirely unrelated to the previous and commences after return to active employment on full time. AMOUNT OF DISABILITY BENEFITS. Notwithstanding the provisions of Article IV, Section 1(b) of the Program, for an employee hired prior to September 20, 2016 at work on or after September 26, 2016, the base hourly rate used to determine amounts of insurance in accordance with the Schedule of Disability Benefits for Sickness and Accident and Extended Disability Benefits shall be the sum of the employee’s base hourly rate plus the cost-of-living allowance in effect on the date of disability minus $0.05. AMOUNT OF DISABILITY BENEFITS. Except as may be otherwise provided herein, the yearly amount of disability benefits to be received by a Participant shall be equal to the yearly amount of Retirement Annuity determined in accordance with Section 17.4 as if his/her Termination of Employment had occurred on the date he/she became disabled, but not less than $1000. The amount of disability benefits so determined for a Participant will be reduced by the amount of any periodic cash payments provided for him/her under or on account of any workers compensation law or similar law which become payable on or after the date he/she first becomes eligible for disability benefits hereunder.
