AND LOCKOUTS. The union agrees that during the term of this agreement, and regard- less of whether an unfair labour practice is alleged (a) there will be no strike, slow-down or walk-out and the union will not directly or indirectly authorize,encourageor approve any refusal on the part of employees to pro- ceed to the location of normal work assignment where no rare or unusual physical hazard is involved in proceeding to such location. Any employee who violates this clause shall be subject to discipline. The company agrees that during the term of this agreement there will be no lock-out of employ- ees covered by this agreement.

Where an employee expresses a concern for his or her safety in attempting to cross a picket-line or any demonstrations on or at the Client’s premises, the Division will ensure a safe access to the workplace. No employee will be disciplined if he or she refuses to cross a picket line or demonstration out of concern for his or her safety. If employees are prevented from performing their duties because of a strike or lockout, the employees shall report the matter to the Division, and the Division will make every reasonable effort to ensure that such employees are employed elsewhere.

Article UNION SECURITY Employees who are members of the Union must remain members of the Union. Each week the Company must deduct from the wages of each employee comprised in the bargaining unit an amount equivalent to the weekly dues fixed by the Union in accordance with its Bylaws, on a percentage basis. By the 15th day of the following month the Company must remit the total sum of the amounts so deducted to a designated official of the Union. The Company will supply a list of names and the amount deducted which will include the total gross amount earned and the total hours worked including overtime hours, for each employee. The employees must sign a form authorising the Company to deduct the Union dues mentioned above and the Union initiation fee. A copy of this authorising form, which will include the Social insurance Number and address of the employee, will be remitted to a designated official of the Local Union. The Union will save the Company harmless from any and all claims which may be made against the Company for amounts deducted from pay as herein provided.

AND LOCKOUTS. There shall be no lockout by the Employer and no strike by any Employee or Employees during the of this Collective Agreement. No Employee shall be required to cross any legal picket line of a Union representing employees of the Employer. No Employee shall suffer a loss of pay or benefits as a result of a refusal to cross a picket line. ARTICLE MANAGERIAL Managerial responsibilities or decisions will be carried out or made in a manner that is just, reasonable and non-discriminatory. The Union recognizes that it is the right of the Employer to exercise the regular and customary functions of management and to direct its workforce subject the terms of this Agreement. ARTICLE
AND LOCKOUTS. In view of the orderly procedure for settling grievances, during the term of this Agreement, the Company agrees that there will be no lockout of employees and the Union agrees that there will be no strike action, slowdown, sit-down or any other action which will interfere with work or produc- tion. If any such action takes place, the Union agrees to instruct the employees to carry out the provisions of this Agreement and to return to work and perform their regular duties.
