Application of Wage Increases. The increase in wages provided for in this Article shall be applied in accordance with the wage or working conditions agreement in effect between Amtrak and the labor organization party hereto. Special allowances not included in fixed hourly, daily, weekly or monthly rates of pay for all services rendered, and arbitraries representing duplicate time payments, will not be increased. Overtime hours will be computed in accordance with individual schedules for all overtime hours paid.

(b) In determining new hourly rates, fractions of a cent will be disposed of by applying the next higher quarter of a cent. (c) Daily earnings minima shall be increased by the amount of the respective daily increases. (d) Existing money differentials above existing standard daily rates shall be maintained. (e) In local freight service the same differential in excess of through freight rates shall be maintained. (f) Other-than-standard rates: (i) Existing basic daily and mileage rates of pay other than standard shall be increased, effective as of the effective dates specified in Sections 1, 2, 3 and 4 hereof, by the same respective percentages and amounts as set forth therein, computed and applied in the same manner. (ii) Effective July 1, 1969, the rates of pay in the weight-on drivers bracket 450,000 and less than 500,000 pounds, as increased above, will be the minimum rates of pay in yard service. (iii) Effective July 1, 1969, in lieu of the rates of pay as increased above for engineers working without firemen, a uniform differential of $4.00 per basic day in freight and yard service, and 4cents per mile for miles in excess of 100 in freight service,will be established for engineers working without firemen, the fireman's position having been eliminated pursuant to the provisions of Award 282.

(g) Prior to application of the First General Wage Increase, the differential of $6.00 per basic day in freight, passenger and yard service, and 6¢ per mile for miles in excess of the number encompassed in the basic day in freight and passenger service for engineers working without firemen on locomotives, on which under the former National Diesel Agreement of 1950 firemen would have been required, will be rolled into and become part of the base rates in all classes of service. Thereafter, the differential will no longer be applied on a daily or per trip basis. In order to apply the differential provided for in Side Letter #20 of the May 19, 1986 Arbitrated Agreement for engineers operating without a fireman and with a reduced train crew, a differential of $2.89 will be paid to engineers operating without a fireman and with a reduced train crew in any class of service paid on a non mileage or hourly basis, or on mileage based runs not exceeding a basic day. On mileage runs exceeding the basic day, the $2.89 differential will be reduced by the amount produced by application of the 6¢ per mile to the overmile rates. For example, on a run of 140 miles the amount added to the overmile rate for operating ten overmiles is $.62. Therefore, the $2.89 will be reduced by that amount, thus producing a differential of $2.27. Appropriate adjustments will be made to the differential when applying the Second and Third General increases in this Article to reflect the intent of Side Letter #20. Payments eliminated include payments under Article 1 of OPS 33-81 and OPS 34-81, dated April 24, 1981, Side Letter 20 of Arbitration Award 458, and Article V – Special Pay Differential contained in Implementation of Public Law 102-29. The differential of $4.00 and .04 cents per mile and/or $6.00 and .06 cents per mile paid to engineers working without a fireman is also eliminated. On the effective date of this agreement, each engineer regardless of length of service, actually working in through freight service (subject to the 130-mile basic day) will receive a flat payment $27.00 for each such working trip or tour of duty, in addition to normal trip payments provided for in other agreements and not cancelled by this agreement. Each engineer in any other class of service will receive a flat payment of $18.00 for each such working trip or tour of duty, in addition to normal trip payments. (f) Existing monthly rates and money monthly guarantees applicable in train service other than passenger will be changed in the same proportion as the daily rate for the class of service involved is adjusted. (g) Existing money differentials above existing standard daily rates shall be maintained. (h) In local freight service, the same differential in excess of through freight rates shall be maintained. (i) The differential of $4.00 per basic day in freight and yard service, and 4$ per mile for miles in excess of the number of miles encompassed in the basic day in freight service, currently payable to engineers working without firemen on locomotives on which under the former National Diesel Agreement of 1950 firemen would have been required, shall be increased to $6.00 per basic day and 6$ per mile respectively, effective July 29, 1991. Effective that date the differential also shall be applicable to such engineers in passenger service. Such differential will be applied in the same manner as the local freight differential. Application of Wage Increases. Retroactivity shall apply only to the general wage increase and shall be based on all hours paid from September 29, 1991 for all employees. Such retroactivity shall be paid within sixty (60) days of the final date of ratification by both parties. Employees who have terminated their employment since September 29, 199 1 shall be given notice within 30 days from the date of ratification by registered mail at their address last known by the Hospital, and shall have sixty (60) days from the date of such notice within which to claim retroactive payment. Retroactive pay will be paid on a separate cheque where the existing payroll system allows. Where the existing payroll system does not allow for such separate cheque, the Hospital will supply the employee with a detailed explanation of the retroactive pay calculations.

In addition, the monetary equivalent of any or all unused personal leave days, sick days and vacation days pursuant to Article 11, Section 2 (d) may be contributed to their 401(k) account subject to the existing protocols of Article XIII of the February 20, 1997 Agreement between CSXT and ATDA and any applicable IRS regulation.
