Appointed Positions. Notwithstanding any provisions of this Agreement to the contrary, the Parties agree that pursuant to the provisions of Laws 1961, Chapter 108, Sections 1 through 4 as amended by Laws 1969, Chapter 604 and Laws 1978, Chapter 580 and the provisions of this Section, the Chief of the Department may appoint three (3) Deputy Chiefs of Police, five (5) Inspectors, the Supervisor of Morals and Narcotics, the Supervisor of Internal Affairs and the Supervisor of License Inspection to perform the duties and services he/she may direct, without examination. The Parties further agree that such persons shall serve at the pleasure of the Chief of Police; and, that any person removed from one of such positions pursuant to Laws 1969, Chapter 604, Section 2, has the right to return to his/her permanent civil service classification. Notwithstanding the foregoing, if the law is amended to so allow, the Chief of the Department may appoint up to five (5) Deputy Chiefs and up to eight (8) Inspectors.

Appointed Positions. A. The County Judge may appoint an executive secretary to assist with the execution of his administrative duties. The County Judge may appoint a Deputy County Judge/Executive. The County Judge may appoint, subject to the approval of the Fiscal Court, a budget officer to assist with the County fiscal affairs. The County Judge may appoint, subject to the approval of the Fiscal Court, other personnel to assist with the County administrative and fiscal duties. A member of the Fiscal Court may be appointed by a majority of the Fiscal Court to temporarily assume the duties of the County Judge, where both the County Judge and the Deputy County Judge/Executive, if a Deputy County Judge/Executive has been appointed, are absent from the County during an Emergency, or where both are incapacitated due to sickness, injury, or mental incompetence.

It is agreed that the Fire Chief shall appoint Administrative Staff, to include the Operations Assistant Chief, the Special Operations Assistant Chief and the Fire Marshal positions. Candidates for appointment shall currently be an officer in the Galveston Fire Department for at least five (5) years and must agree to accept the position. Section 2. The pay and benefits of this position shall be determined by the City Manager, but shall not be less than applicable to Battalion Chief. Section 3. It is agreed that section 143.014(g) and (h) of the Texas Local Government Code shall apply to the appointment and removal of the Assistant Chiefs. No other section shall apply to such appointment or removal and the Union specifically waives any requirements other than stated in this article. The Fire Chief shall have the right to remove these individuals at-will and without prior notice. The individuals serving as Assistant Chiefs may request to be removed. The Fire Chief shall grant such request within thirty (30) calendar days. Any employee appointed to such positions shall retain all rights and privileges afforded the employee’s previous position including testing for and receiving promotions. Section 4. A job description shall be developed and reduced to writing prior to assignment. Section 5. The City agrees to hire one new Firefighter within ninety (90) calendar days of the appointment.
Appointed Positions. Upon Company's request at any time, Employee will submit an appropriate resignation of any position (e.g., as a director of an outside company but excluding the offices included in this Agreement) for which Employee has been appointed with employment by Company.

The Fire Chief, with the concurrence of the City Manager, may appoint each person occupying an authorized position in the classification immediately below that of the Fire Chief, regardless of title. The total number of appointed positions shall be two (2). Section 2. The two (2) appointed positions of Assistant Fire Chief shall exercise responsibility over Operations and Training. The following credentials and conditions are required by the individuals appointed to the position of Assistant Fire Chief: 1) Appointed in accordance with Chapter 143, TLGC 2) Fire Instructor III with TCFP certification Section 3. Grandfather provision. The requirements set for above are for future employees who are appointed and does not apply to those currently in the appointed positions. Section 4. The appointed positions shall be carried as FLSA exempt. Section 5. Both appointed positions shall be drawn from within the Fire Department in accordance with Chapter 143, TLGC criteria. Section 6. In accordance with Chapter 143, TLGC, if a person who has been appointed to one of the foregoing positions is removed from the appointed position, that person shall be reinstated in the department and placed in a position with a rank not lower than that held by the person immediately before appointment to the position. The person retains all rights of seniority in the department. Section 7. In accordance with Chapter 143, TLGC, if a person holding an appointed position is charged with an offense in violation of civil service rules and is dismissed from the civil service or discharged from his appointed position, the person has the same rights and privileges of a hearing before the commission and in the same manner and under the same conditions as a classified employee.
Appointed Positions. A. The Courtroom Coordinator positions shall be filled by appointment of the Probate Judges and shall serve at their sole discretion and shall be members of the Association. B. Appointees to the Courtroom Coordinator positions who were previously members of the Association and are subsequently removed from the positions shall return to full membership rights of the Association without loss of seniority and shall be placed in the classification held previous to the appointment. The Court may determine the placement of this individual. If the Court determines there is no position available, the Employee may exercise his/her rights under Article 22 of this Agreement. C. Appointees to the Courtroom Coordinator positions who were not previously members of the Association shall have no bumping rights nor opportunity to apply for or demote to other Association positions. D. Members of the Association, who are appointed to exempt court positions shall have the right to return to full membership of the Association without loss of seniority and shall be placed in the classification held previous to the appointment provided they were not terminated from their exempt appointment for cause as determined in the Chief Judge‟s sole discretion. The Court may determine the placement of this individual. If the Court determines there is no position available, then the Employee may exercise their rights under Article 22 of this Agreement.

Appointed Positions. Any teacher who is appointed to a position as listed in Appendix D of this Agreement shall be compensated according to Appendix D. Should a position be created which is not listed in Appendix D, the Board and Association shall seek to agree upon the compensation for that position, and failing such agreement the matter shall be considered during the negotiation of a successor collective bargaining agreement and any adjustment in compensation shall be retroactive to the establishment of the position.
