City Commitments. 14.1 The City will expedite its review of MUP applications for development of the Sites. 14.2 The City will apply the terms of this Agreement to future developers and owners of the five Sites. 14.3 Subject to applicable law, City funding policies and guidelines, and City appropriation, the City will provide financial resources, such as the Housing Levy, to help fund Affordable Housing on Site B-North.

City Commitments. 1. The CITY shall prepare, or cause to be prepared, the necessary surveys, obtain all necessary permits and perform the necessary engineering and construction for the WATER MAIN MODIFICATIONS at no cost to the COUNTY, subject only to the responsibility of the COUNTY relating to the removal of the EXISTING WATER MAIN. The WATER MAIN MODIFICATIONS shall be constructed in a timely manner in order to ensure that the EXISTING WATER MAIN can be abandoned by no later than July 1, 2024. 2. In accordance with the McHenry County Tree Planting and Replacement Policy, the COUNTY shall compensate the CITY for the replacement of twenty-eight (28) trees to be planted on property owned or under the control of the CITY. The CITY shall plant and establish twenty- eight (28) trees within two (2) years of the completion of the IMPROVEMENTS. The CITY shall plant all trees within McHenry County. The CITY shall be responsible for any and all maintenance associated with the trees at no cost to the COUNTY. The CITY certifies that it has a tree planting program to facilitate the expenditure of these funds and that the trees planted will only serve as a public benefit and that the funds will be utilized to purchase and install trees per this AGREEMENT. The CITY agrees that no tree purchased with funds provided pursuant to this AGREEMENT shall be placed on private property. Such placement of trees on private property shall be grounds for immediate breach of this AGREEMENT and the CITY will be required to immediately return to the COUNTY all funds used to place trees on private property. 3. Upon substantial completion of the IMPROVEMENTS, the CITY shall own, operate and maintain the shared-use path on the east side of Xxxxxxx Road and the north side of Xxxxxx Road (west of Xxxxxxx Road) as shown on the PLANS and within the CITY’s municipal boundary at no cost to the COUNTY. The CITY shall submit an application for a facility permit to the COUNTY for said shared-use path. Maintenance is defined as any activity necessary to cause the shared-use path to function in accordance with CITY standards for public improvements. However, should the COUNTY reconstruct Xxxxxxx Road in the future, within the limits of this IMPROVEMENTS, the COUNTY shall repair the shared-use path at no cost to the CITY. 4. Upon substantial completion of the IMPROVEMENTS, the CITY shall own, operate and maintain the sidewalk on the west side of Xxxxxxx Road and north side of Xxxxxx Road (west of Xxxxxxx Road) as show...
City Commitments. To facilitate Xxxxxxxxx’s ability to develop plans for the Project and to commit to a Project timeline, the City agrees to the following commitments should the Project proceed:
City Commitments. City agrees to: 1. Provide timely review and comments on stormwater plans and reports to assist with meeting Partner project delivery times; within 14 days of receiving submittals, if possible, and communicate with project teams if timelines must be modified. 2. Accept long-term operation and maintenance responsibility for stormwater management facilities that manage public stormwater (i.e. combined runoff from schools and adjacent public streets and/or neighborhoods) in the City’s jurisdiction, such as Century HS water quality swale retrofit. 3. Allow enhancement associated with Service Provider Letter No. 18-002531 to be completed by County with the Water Quality Swale Improvement project at Century High School. Issue HSD permits for the Modular Classroom (PUP18-00059) without a Vegetated Corridor Enhancement landscaping plan. 4. Recognize that a programmatic, sub-basin approach to stormwater management projects may take longer to implement than smaller onsite projects, but also have a greater overall community benefit. City will work with CWS to issue permits for County road projects and HSD projects that are dependent on planned partnership projects within reasonable timeframes. In some cases the required stormwater management projects may lag HSD construction projects, but this will be reconciled programmatically with the overall portfolio of projects, as described in County and HSD Commitments.
City Commitments a) City will make the following public improvements in the area (subject to the expected funding): i. Repair the retaining wall along Lincoln St. ii. Make (or have made) road improvements on Main St. iii. Make road improvements on Lincoln St. iv. Make modifications at the Xxxxxxx, Xxxx and Main St. intersection v. Rebuild the sidewalks on Lincoln St b) The City will amend the ground lease agreement dated June 12, 2015 by modifying the dates in order to accommodate the new construction schedule. The significant business terms in the agreement will not change unless both Parties agree. c) City will actively work with LHL, and assist it as needed, during the permit modification and construction period. d) City will provide a Credit Enhancement to LHL in the amount of seven hundred fifty thousand ($750,000.00). The amount will be paid in five (5) annual increments of one hundred fifty thousand ($150,000.00) beginning during the City’s first fiscal year following the substantial completion of the Project . The City shall make the annual incremental payments to LHL within 30 days following each tax payment date or the date payment is actually received by the City from LHL, whichever is later.
City Commitments. The City affirms that the option for Owner to join into, be bound by, and benefit from, the Our Town Agreement under its Section 13.1
City Commitments. In addition to the commitments expressed in other parts of this MOU, City commits to the following: City shall rezone the land and provide other planning and discretionary approvals, to the extent necessary and reasonable, and consistent with applicable law, to effectuate the goals and purposes of this MOU. City shall use best efforts to effectuate the goals and purposes of this MOU during CEQA and other administrative proceedings, regardless of whether City is an interested person, a responsible agency, or the decision-making body.

City Commitments. Other than has outlined in this Agreement, the City does not waive any authority as to actions that occur within the jurisdictional boundaries of the City outside the Property or as to an Unit, Common Area, Conservation Area or Public Improvement once Fully Improved. Specifically, the City retains all authority over any roadway or other improvements within the jurisdiction of the City outside the Property.
City Commitments. 4.1 The City shall: a) name the Named Lands as Kinsmen West Park for the duration of this agreement; b) coordinate the installation of two (2) cedar park signs with the park name and Club logo at a maximum size of fifteen (15) feet long by two (2) feet wide to be installed at the locations identified in ‘Schedule A’; c) pay fifty percent (50%) of the costs associated with the installation and replacement of the two (2) cedar signs during the term of the agreement; d) allow the Club to install additional naming signage at the other entrances to the park, at their own expense and with the approval of the City; e) recognize the Club’s contribution on the donor wall to be installed near the new outdoor recreation amenities identified for West Park; f) reference the Named Lands on all City communication platforms, including but not limited to: news releases, City website, social media and directional signage; g) host a grand opening media ceremony for the new outdoor recreation amenities identified for West Park where the Club will be publicly recognized for their contributions and provided the opportunity to speak about the project;
