Cloud Hosting services provided by a cloud computing provider or facility to host data, services and/or solutions necessary to enable the Agency to provide certain of the Services to the Client;

2 Definitions Client Content means the materials, including, without limitation, any input or output data, and any Confidential Information that you upload to the Designated Cloud Solution;
Cloud Hosting. The Services are instantiated in the Microsoft Azure platform and Client agrees that the terms of the Microsoft Client Agreement published at xxxxx://xxx.xxxxxxxxx.xxx/licensing/docs/customeragree ment are included in this Agreement. Unisys’s duties to Client for the elements of the Services that use or rely on the Microsoft Azure platform are coextensive with Microsoft’s duties to Unisys for the Microsoft Azure platform (used or relied upon by the Service) according to such Microsoft agreement.
Cloud Hosting. During the Subscription Period, the Licensee’s data and DataSelf software will be hosted on Amazon Web Services servers managed by DataSelf. DataSelf will use commercially reasonable efforts to make DataSelf Cloud service instances available with a monthly uptime percentage of at least 99.9% during any month of the year. Monthly uptime percentage = 100*(1– (number of minutes of unplanned offline services/number of minutes of planned online services)) Planned online services include the scheduled downtime for Windows Server updates (7pm PST on the 3rd Saturday of the month) and the upgrade of Tableau Server twice a year. For information purposes, the average uptime of the DataSelf Cloud Tableau Server was 99.97% in 2022.
Cloud Hosting. The video shall be hosted and streamed from a commercial-grade content delivery network, enabling worldwide streaming of the video. This service is subject to fair use, whereby up to five thousand ‘view-minutes’ are included each month.
Cloud Hosting. During the Subscription Period, the Licensee’s data and DataSelf software will be hosted on Amazon Web Services servers managed by Licensor. DataSelf will use commercially reasonable efforts to make DataSelf Cloud service instances available with a monthly uptime percentage of at least 99.5% during any month of the year. Monthly uptime percentage = 100*(1–(number of minutes of offline services in a month/number of minutes of online services in a month)) For information purposes, the 2018 average monthly uptime percentage was 99.96%.
Cloud Hosting. Literatu delivers Products and Services to Customer via Cloud Hosting Services (Cloud). Where Customer accesses Literatu and Services via Cloud, this clause shall apply
a) During the term of the Agreement, Literatu will provide Customer Products and Services in the manner specified in Schedule 3.
b) If any consents (which may include, without limitation, consents for Literatu to access use, store and disclose Customer Data) are required for Literatu to provide Products and Services on the Cloud, Customer must procure those consents for Literatu. Literatu obligations to provide Cloud services are conditional on those consents having been procured. Customer shall comply with Literatu reasonable requests for confirmation of these consents having been procured.
c) Literatu may configure its system for providing access to the Cloud and deliver internal technical support at its discretion. Customer agrees to comply with such access and use procedures (including as to communications and security) as Literatu notifies Customer from time to time.
d) Customer must provide its own Access Facilities and ensuring that the Access Facilities do not at any time adversely affect Literatu, the Service or the Cloud (including transmission of any virus or similar thing) and are otherwise reasonably appropriate for use in conjunction with the Cloud and the Service.
e) If Customer's use of the Cloud and/or the Service causes undue performance loss, or impairs or threatens to impair the continued proper functioning of Literatu’ equipment or software or that of any of Literatu’ suppliers, the provision of the Cloud and/or the Service to Customer may be suspended without notice.
f) Subject to the terms of this Agreement and during the term of this Agreement Literatu shall provide the Cloud in accordance with the Cloud Hosting provisions defined in Schedule 3.
g) Customer acknowledges and agrees that Literatu may suspend access to, and use of, the Cloud and the Service in order to coordinate scheduled work on Literatu’ infrastructure used to provide access to the Service (Scheduled Maintenance). Except where Literatu is required to undertake urgent repairs or maintenance or suspend access to the Service by law, Literatu will:
i. provide the Customer with reasonable notice of the Scheduled Maintenance; and
ii. use reasonable endeavours to schedule the Scheduled Maintenance for a time which minimises the impact of the suspension on Customer’s access to, and use of, the Cloud and the ...
Cloud Hosting. Continuous due-diligence and compliance reviews. Enabling adequate device protection through a combination of firewall, hard-drive encryption and anti-virus and anti-malware software. Supporting least-privilege and need-to-know principles. Point-in-time recovery and single-tenancy architecture.
Cloud Hosting. 12.1 SWDconnect reserves the right to manage the cloud environment at its discretion for the overall benefit of cloud hosted clients. Any virtual machine which SWDconnect deems at its sole discretion to have a negative effect on the environment may be powered down or suspended.
12.2 SWDconnect deploys all new cloud servers with HyperV tools (VMadditions, LIS) pre-loaded. VMadditions is integral to the smooth running of virtual servers, including managing resources and smooth and safe rebooting. VMadditions must be running at all times, as shutting it down will severely affect the performance of the server, and efficiency of the core controllers i.e. affecting other clients’ virtual servers.
12.3 SWDconnect strictly forbids the creation of nested VM's, or virtual instances within a virtual server. This severely degrades overall performance and will be treated as a violation of SWDconnect’s AUP and Terms & Conditions (contrary to the intended use of the product).
12.4 SWDconnect also strictly forbids any misuse of shared or cloud resources, such as RAM Disks (use RAM memory as storage disk space), which abuses resources and compromises the integrity of the cloud environment.
12.5 SWDconnect may also, at its discretion, restrict the server to limited IOPS (Input Output Operations Per Second) where a client’s use of available virtual resources is negatively affecting the overall environment.
12.6 SWDconnect reserves the right to move a cloud server between our virtual environments and Internet backbones, both within South Africa and internationally as it deems necessary.
12.7 SWDconnect deploys all Cloud servers with an initial OS disk of 25GB. Additional disks can be added in up to 50GB increments, up to the maximum size allowed by the chosen package.
13. 100% website uptime guarantee.
13.1 The 100% website uptime guarantee is applicable only if the web server on which a client's web hosting service resides crashes or goes down at an unscheduled time. This guarantee is not valid if there is any network problem between the client and the web server which prevents the client from seeing the web server, for instance - if the client's ISP's link to the respective data centre goes down or is faulty, but the web server SWDconnect hosts is still up, SWDconnect is not responsible for the client not being able to reach their website.
