Consultant Selection. If requested by the Project Manager, Construction Manager must assist the Project Manager and the Council with the process of identifying, soliciting proposals from, and negotiating contracts and/or amendments to contracts with consultants necessary for the completion of the Project. If requested by the Project Manager, Construction Manager must advise Council and make recommendations concerning the scope of services, the fees and the administration of consultants.

If the Funding Tables indicate that Federal funds are used for a Stage/Phase of the project in which consulting services will be performed, DOTD shall advertise and select a consulting firm for the performance of the services necessary to fulfill the scope of work unless the Entity has a selection process which has been previously approved by FHWA and DOTD for the designated Stage/Phase. Following the selection of the consulting firm by DOTD, if applicable, and if the Responsibility Table specifies that the Entity holds the contract, the Entity shall enter into a contract (prepared by DOTD) with the consulting firm for the performance of all services required for the Stage/Phase. The Entity may make a non-binding recommendation to the DOTD Secretary on the consultant shortlist. If the Entity makes a selection pursuant to its approved procedures, the Entity shall submit to DOTD the draft contract for approval prior to execution. No sub-consultants shall be added to the Project without prior approval of the DOTD Consultant Contract Services Administrator. The specified services will be performed by the selected consultant under the direct supervision of the LPA Responsible Charge, who will have charge and control of the Project at all times. The Entity shall be responsible for any contract costs attributable to the errors or omissions of its consultants or sub-consultants. If DOTD is designated as being responsible to complete the Stage/Phase, as per the Responsibility Table, DOTD will perform the specified services. As per the Funding Table, if the Entity is responsible for all costs associated with a Stage/Phase, and the Responsibility Table indicates the Entity is the contract holder, the Entity shall either conduct the specified services or advertise and select a consulting firm (if not previously selected) for the performance of services necessary to fulfill the scope of work for the designated Stage/Phase. If a consulting firm is selected, the Entity shall enter into a contract with the selected firm for the performance of the services. The Entity is prohibited from selecting or approving any consultant or sub-consultant who is on DOTD’s disqualified list or who has been debarred pursuant to LSA-R.S. 48:295.1 et seq.

Best Judgment. Evaluations of the DBE’s estimates must represent the Construction Manager’s best judgment as a professional familiar with the construction industry. Constructability Review(s). Construction Manager shall perform constructability reviews and site verification of the Project as set forth in the Pre-GMP Phase section below. The Construction Manager shall review the design documents for clarity, consistency, constructability and coordination. The results of the review shall be provided in writing and as notations on the documents to the Judicial Council and uploaded to JPIC. The Construction Manager shall also make recommendations to the Judicial Council with respect to constructability, construction cost sequence of construction, construction duration and separation of the contracts for the Project into categories of the work and separate bid trade packages. The Construction Manager, however, shall not perform and is not responsible for any design or architectural services. The Construction Manager’s actions in reviewing the Project design and design documents and in making recommendations as provided herein are advisory only to the Judicial Council. The DBE members are not third party beneficiaries of the Construction Manager’s work described in this paragraph and the DBE remains solely responsible for the contents of design drawings and design documents. Upon Judicial Council’s request, and without considering it an Extra Service, Construction Manager shall, provide value engineering at the 100% Design Development Phase and the 50% Construction Document Phase. This evaluation will consist of a review of the proposed materials, equipment, systems and other items depicted in the design documents and shall be coordinated with the Judicial Council’s design guidelines, Performance Criteria, the Criteria Architect, and the DBE. Consultant Selection. Consultant acknowledges and confirms that he or she has been selected to serve as a Consultant because of his or her expertise in the relevant subject matter and not, in any way, as an inducement to, or in return for prescribing, purchasing, using, recommending preferential formulary status for, or dispensing of any Ironwood product. The parties agree that the payments provided under this Agreement for Consulting Services reflect the fair market value of such Consulting Services, are consistent with arm’s length transactions, and are not in exchange for an agreement by Consultant to prescribe, use or recommend the prescription or use of any Ironwood product. If Consultant’s qualifications relate, even in part, to the Consultant’s holding of one or more professional licenses (e.g., M.D., D.O., etc.), Consultant hereby represents and warrants that those licenses are current and that Consultant is in good standing with any applicable licensing board. Consultant hereby agrees to notify Ironwood if there is any material change to the status of his or her professional license(s).

Consultant Selection. 5.1 The RBI Board will review qualified consultants to perform the Analysis which will be provided by City Utilities of Springfield, Missouri, pursuant to separate contract .
5.2 Should, after review of the consultants, the RBI Board approve proceeding with the Study, the RBI Board will select a consultant to assist it with the project and take appropriate action thereafter.
