The "Continental Shift" clause defines the terms and conditions under which a contract or agreement may be affected by significant geopolitical or jurisdictional changes, such as a country changing its continental alignment or legal framework. In practice, this clause might specify how obligations, rights, or enforcement mechanisms are adjusted if the governing law or regulatory environment shifts due to such a change. Its core function is to provide certainty and continuity for the parties involved, ensuring that the agreement remains enforceable and relevant even if major political or legal shifts occur.
Continental Shift. No employee, unless excused, shall leave their work place to wash up and change clothes until the end of their shift, or until their replacement has changed clothes and reported to take over the job. If a replacement fails to report on schedule, the employee shall notify their team leader and shall remain at their post until a replacement is secured. For greater clarity, no employee shall be required to work more than thirteen (13) hours per shift. If an employee is forced over for more than one (1) hour, the employee will receive a meal allowance in the amount of a five dollar ($5.00) gift card.

Continental Shift. Shift Assignment Process
1. Prior to implementation or extension, the Company will meet with the union executive to discuss where the continental shift will be implemented and to provide a start and end date. If duration less than three (3) months:
i. Resident employees will be required to remain in the work centre for the duration
ii. Resident employees must indicate shift preference
iii. Shift assignment will be determined by seniority
iv. Additional positions will be filled by a “Training Opportunity Posting” (TOP)
v. Remaining openings will be filled in accordance with Article 25 of the collective agreement
vi. When continental is no longer required, employees will be reassigned shifts based on shift preference and seniority If during the first three months of the continental it is deemed necessary to extend shift beyond three months:
i. When it is determined that the continental shift is going beyond the initial three month duration, employees will provide their plant wide shift preference, and will be given the opportunity to be re-assigned after the initial three month period.
ii. Resident employees will have the option to be reassigned to other shifts based on shift preference and seniority
iii. Additional positions will be filled by a “Training Opportunity Posting” (TOP) iv. Remaining openings will be filled in accordance with Article 25 of the collective agreement
Continental Shift. Notwithstanding Article 17.01 (a) and Article 17.07 (a), at ratification, in the Refrigeration Maintenance Department, the employee(s) work a continental shift on alternating weeks as follows: Week 1: 3 days X 12 hours, then #1 below applies.17.07 (c) applies Week 2: 4 days X 12 hours, then #2 below 17.07 (b) applies #1 For a three (3) day work week employee, overtime pay will be provided at one and one-half (1-1/2) times the employee's regular hourly rate for all hours worked in excess of twelve (12) hours in a day and or thirty-six (36) hours in a week, and for all hours worked on the fourth, fifth, sixth and seventh day of the employee's regular work week.

Continental Shift. Pay will be averaged at forty (40) hours at straight time and two (2) hours at time-and-one-half per week for employees who work all of their regularly scheduled hours. Employees who are absent will have the time-and-one-half portion of their pay reduced first. There shall be four (4) 20-minute breaks per shift per 12 hour shift. All hours worked in excess of the regular weekly hours will be paid at time-and-one-half. A full week for vacation pay purposes is forty (40) hours at straight time. A shift premium of seventy-seven cents (774) will be paid for all hours worked on the 6:00 p.m. to 6:00 a.m. shift. Shift premium will not be paid for daily overtime during that shift. Any paid days off will be based on twelve (12) hours, except bereavement leave of greater than one (1) day. Each bereavement day an employee takes will count as twelve (12) hours against the entitlement set out in Clause 10.05, which is based on an eight (8) hour day.
