Customer’s Conduct. The Service allows Customer to send Electronic Communications directly to Kinetix and to and among third parties. Customer shall comply with all applicable local, state, federal, and foreign laws, treaties, regulations, and conventions in connection with its use of the Service, including without limitation those related to privacy and electronic communications legislation.

Customer’s Conduct. Customer and Customer’s employees, independent contractors, and other agents shall comply with all applicable local, state, federal, and foreign criminal and civil laws, treaties, regulations, and conventions in connection with its use of the Service, including without limitation those related to privacy, electronic communications, and anti-spam legislation. Customer shall not send any electronic communications from the Service that are unlawful, harassing, libelous, defamatory, or threatening. Except as expressly permitted by this Agreement, no part of the Service may be copied, reproduced, distributed, republished, displayed, posted or transmitted in any form or by any means. Further, Customer agrees that it nor its employees, independent contractors, or other agents shall try to reverse engineer or assist any third party in attempting to reverse engineer either the Service as provided or the functionality of the Service. Customer shall not access the Service by any means other than through the interfaces that are provided by MARKING SERVICES. Customer shall not license, rent, sell, lease, transfer, assign, distribute, display, host, outsource, disclose, or otherwise commercially exploit or make the Service available to any unauthorized user, including but not limited to, by “mirroring” or “framing” any part of the Service, or by creating Internet links to the Service which include log-in information, user names, passwords, and/or secure cookies. Customer shall not upload, post, reproduce or distribute any information, software or other material protected by copyright or any other intellectual property right (including but not limited to rights of publicity and privacy) without first obtaining the permission of the owner of such rights. Customer shall not in any way express or imply that any opinions contained in Customer’s electronic communications are endorsed by MARKING SERVICES. Neither Customer, nor someone acting on Customer’s behalf, shall use the Service to target for solicitation any MARKING SERVICES Customers for purposes of providing any competitive product. Customer shall ensure that any use of the Service by Customer’s employees (or Customer’s other authorized users) is in accordance with the terms and conditions of this Agreement.
Customer’s Conduct. 16.1 The Customer agrees that it will be solely responsible for all information or data of any kind, whether text, software, files, code, music or sound, photographs or graphics, video or other materials ("Content") which it uploads to the Platform.
Customer’s Conduct. Customer represent and warrant that Your Content Customer’s and any Authorized User’s, use of the Wasabi Service, and the technology related thereto, shall not (i) interfere with the proper working of the Wasabi Services; (ii) give rise to civil or criminal liability, e.g. defamatory, threatening, pornographic, indecent, abusive, libelous or otherwise objectionable actions; (iii) violate or infringe upon any third party right, including any intellectual property right or right of privacy, or that abuses, harasses or stalks any other person; or (iv) initiate a denial of service attack, software viruses or other harmful or deleterious computer code, files or programs such as Trojan horses, worms, time bombs, cancelbots, or spyware.
Customer’s Conduct. Customer is responsible for all activities conducted under its User logins and for its Users' compliance with this Agreement. Customer’s use of the Service shall not include service bureau use, outsourcing, renting, reselling, sublicensing, concurrent use of a single User login, or time-sharing of the Service. IVDesk specifically prohibits Customer allowing access to Service by any unauthorized third party. Customer shall not permit any third party to: i) use the Service for any illegal activity or that violates any local, state, federal, or non-U.S. law, order, or regulation including but not limited to: to store, transmit, reproduce, transmit, communicate or knowingly receive any material which is in breach of confidence, copyright, privacy, trademarks or any other rights of any third party, Spamming, pornography, or other such uses, ii) copy, translate, create a derivative work of, reverse engineer, reverse assemble, disassemble, or decompile the System, Service, or any part thereof or otherwise attempt to discover any source code or modify the System or Service in any manner or form unless expressly allowed in the User Guide, iii) use unauthorized modified versions of the Service, including (without limitation) for the purpose of building a similar or competitive product or service or for the purpose of obtaining unauthorized access to the Service, iv) use the Service in a manner that is contrary to applicable law or in violation of any third party rights of privacy or intellectual property rights, v) publish, post, upload or otherwise transmit Customer Data that contains any viruses, Trojan horses, worms, time bombs, corrupted files or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any systems, data, personal information or property of another, or vi) use or knowingly permit the use of any security testing tools in order to probe, scan or attempt to penetrate or ascertain the security of the Service.
Customer’s Conduct. As a condition of your access and use of the PLATFORM and your submission or access to any ratings, reviews, communications, information, data, text, photographs, audio clips, audio-visual works, or other materials on the PLATFORM (collectively, the “Content”), you agree not to use the PLATFORM for any purpose that is unlawful or prohibited by these Terms and Conditions, or any other purpose not reasonably intended by and by way of example, and not as a limitation, you agree not to: ● Violate these Terms and Conditions, other applicable agreement with HANDLEFORME, and any applicable local, any rules and regulations having the force of law; ● Use the PLATFORM in any manner that violates any relevant law or that infringes, misappropriates or violates any third party’s rights, including, but not limited to, transmitting any Content that may infringe, misappropriate or violate a third party’s rights of publicity, contractual rights, fiduciary rights or intellectual property rights; ● Use the PLATFORM or its Content for any purposes not authorized by these Terms and Conditions, including commercial, political, or religious purposes, including the submission or transmission of any Content that contains advertisements, promotional materials, junk mail, or any other form of solicitation; ● Reproduce, duplicate, copy, modify, sell, re-sell or exploit any Content or the PLATFORM for any commercial, educational, or any other non-personal purpose or any for any purpose unrelated to your personal purchasing decisions, without the express written consent of HANDLEFORME, which consent may be withheld by HANDLEFORME in our sole discretion; ● Post irrelevant Content, repeatedly post the same or similar Content or otherwise impose an unreasonable or disproportionately large load on our infrastructure, interfere or attempt to interfere with the proper working of the PLATFORM or any activities conducted on the PLATFORM; ● Xxxxxx, threaten, intimidate, impersonate, or attempt to impersonate, any other person, falsify your contact or other information, misrepresent a relationship with any person or entity, including misrepresenting a relationship with HANDLEFORME, or otherwise attempt to mislead others as to the identity of the sender or the origin of a review or rating; ● Knowingly provide or submit false or misleading information; ● Use the PLATFORM if you are under the age of eighteen (18); ● Take any action that would undermine the review and rating process under the PLATFO...

Customer’s Conduct. Customer is solely responsible for the contents of its transmissions through the Fax Service, and the Fax Service simply acts as a passive conduit for it to send and receive information of its own choosing. However, Service Provider reserves the right to take any action with respect to the Fax Service that Service Provider deems necessary or appropriate in Service Provider’s sole discretion if Service Provider believes Customer or its information may create liability for Service Provider, compromise or disrupt the Fax Service for Customer or other subscribers to the Fax Service, or may cause Service Provider to lose (in whole or in part) the services of the ISPs or other suppliers of Service Provider. Customer’s use of the Fax Service is subject to all applicable local, state, national and international laws and regulations (including without limitation those governing account collection, export control, consumer protection, unfair competition, anti-discrimination or false advertising). Customer agrees: (1) to comply with all applicable laws regarding the transmission of technical data exported from the United States through the Fax Service; (2) not to use the Fax Service for illegal purposes; (3) not to interfere or disrupt networks connected to the Fax Service; (4) to comply with all regulations, policies and procedures of networks connected to the Fax Service; (5) not to use the Fax Service to infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (6) not to transmit through the Fax Service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature; and (7) not to use the Fax Service to store any “protected health information” (as such term is used in the Health Insurance Portability and Accountability Act of 1996, Pub. L. No. 104-191). Customer further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation.
