Fingerprint/Background Check. In accordance with Florida Statute, 1012.32 all employees of PROVIDER that work with students in the school district, or have access to confidential records, shall, for a fee, be fingerprinted, and undergo a sexual predator and a Level II criminal background check conducted annually through a contractor approved by the Clay County School Board prior to working with students. Employees of PROVIDER, who instruct students as distant learners shall be fingerprinted, and undergo a sexual predator and level II criminal background check. PROVIDER will certify to BOARD that no employee of PROVIDER working with students of the school district has been convicted of any offense set forth in 1012.467 Fla. Stat. or as a sexual predator as defined by statutes. Under no circumstance shall employees of PROVIDER work with students prior to the completion of a fingerprint and background check. Notwithstanding the results of any criminal background check, the BOARD reserves the right to prohibit any employee of PROVIDER from having contact with students on BOARD property if the BOARD has reason to believe that the safety or health of the students might be in jeopardy. Per the Florida Department of Education, tutors must meet the minimum education requirements of an Associate Degree, 60 hours of college credit, or have received ParaPro Certification. Therefore PROVIDERS shall submit college transcripts or ParaPro assessment results of tutors who are not certified teachers to the BOARD employees for verification of eligibility to provide tutoring to students.

Fingerprint/Background Check. PROVIDER agrees that as a condition of entering into this contract, pursuant to § 1012.32 and § 1012.465, Florida Statutes, any person entering school grounds or having direct contact with students on behalf of PROVIDER must meet Level 2 screening requirements as described in § 1012.32, Florida Statutes. Screening will be at PROVIDER’S or employee’s expense and must be completed and credentials issued by the DISTRICT prior to the screened individual having access to students or to the school grounds. The DISTRICT reserves the right to prohibit any employee of PROVIDER from having contact with students on DISTRICT property if the DISTRICT has reason to believe that the safety or health of the students might be in jeopardy. PROVIDER employees already listed in the Vendor Clearance Database and existing DISTRICT employees will not need to be re- fingerprinted as they are already in the background clearance database. If PROVIDER hires a DISTRICT employee or someone already listed on the Vendor Clearance Database, they will need to submit the name of the employee to (name), (title), for verification of clearance. PROVIDERS shall keep a current list of all employees updated in the DISTRICT SES software and e-mail the DISTRICT’S program specialist if any changes are made to employee list.
Fingerprint/Background Check. Contractor hereby acknowledges that, pursuant to Education Code section 45125.1, employees, agents, and representatives of Contractor and any subcontractor who are expected to come into contact with the District's pupils are required to undergo a fingerprint background check. Contractor will ensure that, before performing any work under this Contract, any employee, agent, or representative of Contractor or any subcontractor who is expected to come into contact with District’s pupils will undergo a fingerprint background check through the Department of Justice Live Scan screening process at Contractor’s sole expense, and Contractor will provide District with a completed Fingerprint Certification form for each such individual. Contractor further acknowledges that other fingerprinting requirements may apply, as set forth in Education Code section 45125 et seq., and that Contractor will comply with any such requirements. Contractor acknowledges that no Contractor or subcontractor employee, agent, or representative shall come into contact with District’s pupils if they have been convicted of a violent felony listed in Penal Code section 667.5(c) or a serious felony listed in Penal Code section 1192.7(c). Notwithstanding anything to the contrary herein, if Contractor is an individual operating as a sole proprietor, if required by Education Code section 45125.1(k), it shall be the responsibility of the District to prepare and submit that individual’s fingerprints to the Department of Justice.

Notwithstanding the results of any criminal background check, the DISTRICT reserves the right to prohibit any employee of PROVIDER from having contact with students on DISTRICT property if the DISTRICT has reason to believe that the safety or health of the students might be in jeopardy.

  • Background Check The Department or Customer may require the Contractor to conduct background checks of its employees, agents, representatives, and subcontractors as directed by the Department or Customer. The cost of the background checks will be borne by the Contractor. The Department or Customer may require the Contractor to exclude the Contractor’s employees, agents, representatives, or subcontractors based on the background check results. In addition, the Contractor must ensure that all persons have a responsibility to self-report to the Contractor within three (3) calendar days any arrest for any disqualifying offense. The Contractor must notify the Contract Manager within twenty-four (24) hours of all details concerning any reported arrest. Upon the request of the Department or Customer, the Contractor will re-screen any of its employees, agents, representatives, and subcontractors during the term of the Contract.

  • Background Checks The State may require that the Contractor and Contractor Parties undergo criminal background checks as provided for in the State of Connecticut Department of Emergency Services and Public Protection Administration and Operations Manual or such other State document as governs procedures for background checks. The Contractor and Contractor Parties shall cooperate fully as necessary or reasonably requested with the State and its agents in connection with such background checks.

  • Criminal Background Check It is the Responsibility of CHESAPEAKE CENTER, INC. to make certain that its employees, agents, volunteers, and contractors, who have contact with students receiving services are fingerprinted and have a background check in compliance with Family Law Article, Annotated Code of Maryland, and Section 5-551 through 5-557. CHESAPEAKE CENTER, INC. may not hire, contract, or otherwise engage an individual to participate in this Cooperative Agreement who has been convicted of a crime involving child abuse or neglect; contributing to the delinquency of a minor; a crime of violence as set forth in Criminal Law Article §14-101, Annotated Code of Maryland; or has evidence of a criminal history which in the opinion of Chesapeake Center, Inc. makes the individual unfit to participate in this Cooperative Agreement.

This background screening will be conducted by SBBC in advance of VENDOR or its personnel providing any services under the conditions described in the previous sentence. VENDOR shall bear the cost of acquiring the background screening required by Section 1012.32, Florida Statutes, and any fee imposed by the Florida Department of Law Enforcement to maintain the fingerprints provided with respect to VENDOR and its personnel. The parties agree that the failure of VENDOR to perform any of the duties described in this section shall constitute a material breach of this Agreement entitling SBBC to terminate immediately with no further responsibilities or duties to perform under this Agreement. VENDOR agrees to indemnify and hold harmless SBBC, its officers and employees from any liability in the form of physical or mental injury, death or property damage resulting from VENDOR’s failure to comply with the requirements of this section or with Sections 1012.32 and 1012.465, Florida Statutes.
